Agency History

State regulation of chiropractic practice was originally enacted in 1943, but the statute was declared unconstitutional the following year. In 1949 the 51st Texas Legislature, Regular Session, House Bill 721, created the Texas Board of Chiropractic Examiners. The board interviews applicants, conducts examinations, and issues licenses to practice chiropractic. It also approves reciprocity with boards of other states with requirements similar to those in Texas, and, beginning in 1993, licenses and regulates chiropractic facilities in Texas. The board promulgates rules and regulations, annually registers persons licensed to practice chiropractic, and revokes licenses on grounds specified in the Chiropractic Act. It also registers all chiropractic radiological technologists in the state.

The board has appointed an Enforcement Committee to review and analyze all inquiries and complaints against practitioners and to take appropriate action to determine if a violation of the Chiropractic Act has occurred. The entrance examination is offered twice a year. The board publishes an annual register of persons licensed to practice chiropractic in the state. In 1996, the board oversaw approximately 3,500 licensed chiropractors.

The policy-making body of the agency is a nine-member board, appointed by the governor with the advice and consent of the senate for overlapping six-year terms. Six members must be licensed, practicing chiropractors who have resided in the state for at least five years preceding appointment, and three members must represent the general public. These are nonsalaried positions, and the governor designates the president.

Scope and Contents of the Records

The Texas Board of Chiropractic Examiners licenses and regulates chiropractors and chiropractic facilities in the state of Texas. These records consist of copies of agenda, minutes, and transcripts of meetings of the Texas Board of Chiropractic Examiners, dating 1963-1998 and 2004-2005. Agenda and minutes are from the quarterly meetings of the board. Records of meetings dating October 1991 and November 1992 to July 1995 are verbatim transcripts. During their meetings the board hears reports from the executive director and from committees. Beginning in 1996, the committee reports form the largest part of the minutes (Item IV on the agenda). Committees include enforcement, licensure and educational standards, technical standards, and rules. Actions of the committees in regulating licensed chiropractic professionals and handling complaints include license suspensions and revocations, requests for reinstatements, and license renewals. The minutes also include the ratification and names of the examinees who passed the board exam during that quarter.
