Historical Note

The roots of Stewart Title Company run back to the decade after the civil war. By the 1870s, land transactions were increasing rapidly due to the large population growth of the city of San Antonio and Bexar County. These transactions required an assurance on the part of the purchaser that the seller had the right to convey. It was becoming clear that the necessity of abstracting land titles reached an increasing level of prominence in land conveyances.

The first abstract companies in Bexar County were established in San Antonio during the mid-1870s by Dr. Theodore Roziene and by a group of five prominent citizens who formed the Occidental Land Company, which changed its name to the West Texas Abstract and Guarantee Company in 1890. In that same year, Henry Hildebrand and Ben Stribling formed Hildebrand & Stribling Abstract Company and five years later formed Bexar Abstract Company in 1895. They allowed the charter of Hildebrand & Stribling to expire in 1901 thereby merging the two firms.

West Texas Abstract and Guarantee Company changed their place of business to Houston in 1909. Bexar Abstract Company was then able to consolidate their operation by acquiring the abstract books of the West Texas Company when it moved. They had also previously acquired the records of Theodore Roziene upon his death in 1901.

Stewart Title Company began in the 1890s in Galveston, Texas when Maco Stewart, a well known lawyer, acquired an existing abstract plant there. Together with other family members Stewart expanded his operation to Beaumont after the discovery of oil at Spindle Top created a demand for abstracting land titles. The Stewarts incorporated under the name Stewart Title Guaranty Company in 1908 and two years later opened an office in Dallas. In 1911, the Stewarts established the San Antonio office by leasing and later purchasing Bexar Abstract Company's records. Thus by acquiring Bexar Abstract Company, Stewart Title Company had also obtained the records of the former companies of Roziene, Occidental Land Company, West Texas Abstract and Guarantee Company, and Hildebrand & Stribling. Stewart Title Company went on to expand outside of Texas beginning in 1956; since then, it has grown to over 2800 offices nationwide.

Scope and Content Note

The Stewart Title Company Records are in part, a compilation of the land records obtained by Stewart Title Company as a result of its acquisition of Bexar Abstract Company in 1911. The records also include the company's own land records which were built upon those acquired from 1911 forward. Additionally, there are some administrative and client records that were maintained by both Stewart and its parent companies. The land records consist of mostly handwritten transcriptions of public records bound in volumes and legal size Abstracts of Title, which are chronological listings of the public records pertaining to a particular tract of land. The records represented were made between the 1870s and the 1960s and include transcriptions of documents made as early as 1731. They are divided into three series: Bound Volumes of Transcribed Public Records, Abstracts of Titles, and Journals, Ledger Books, Records.

The Bound Volumes of Transcribed Public Records series incorporates bound volumes of transcribed public records acquired by Stewart Title Company from Bexar Abstract Company to include the records of Roziene, Occidental Land Company, West Texas Abstract and Guarantee Company, and Hildebrand & Stribling. They consist of 110 Boxes containing 716 volumes of transcribed public records, internal bookkeeping ledger books, indexes and journals, typed and handwritten abstracts and copies of published indexes from the Texas General Land Office and two miscellaneous published volumes, one being on Jurisprudence and the other of the Tennessee Digest.

The Abstracts of Titles series consists of 275 Boxes containing 8 ½ inch by 14 inch folders of abstracts of title to tracts of land mostly within Bexar County indexed by various methods and include some miscellaneous correspondence files.

The Journals, Ledger Books, and Records series is comprised of 70 mostly oversized Boxes containing journals, ledger books and indexes of various use and purposes ranging from company accounting records to indexes relating in part to the above mentioned first series together with general abstract uses. This series also includes two files of maps pertaining to land divisions within Bexar County.

Appendix 1: This is an index of Divisions 1 through 92 which is one of the methods of indexing used by Stewart Title Company corresponding to divisions of the City of San Antonio arbitrarily made by Stewart Title for internal use only. (Also found in Box 331, Folder 1)

The Addition ranges in date from 1909-1951. Included are deeds of trust, maps, Release of Vendor's or mortgage lien, Vendor's lien note, Assignment of lien, Trustee's deed, and various other types of documents pertaining to the sale of lands are predominantly in Texas with names mentioned in Dallas county, Kaufman county, Eastland county and Henderson county. There are also out of state sale of lands from Oklahoma.

Notes to Researchers

It is important to note that these records contain a varied assortment of methods of record keeping due to the time period and changing technology and because there are several companies represented. City Block (CB) numbers and New City Block (NCB) are synonymous with one another. Another designation of CB was used later starting perhaps in the 1930s or 1940s referring to "County Block," which may be found within the Stewart Title Records but which are not used for any method of indexing found herein. The "name index" located in Series 3, Box 391, Volume 2 is used in connection with the Individual Indexes found in Boxes OM22 through OM35. In Series 2, one method of indexing of Abstracts of Title is by Division first then Range if necessary (if there are a large number in a division). The divisions are numbered 1 through 92 and the index to them is located in Box 331, Folder 1 and in Appendix 1. There is no graphic index of these divisions. They must be located by street name or area as indicated in the index. It is important to search through the various ways the abstract of title are organized to ascertain if a particular one you are searching for is present in the records.

The terms Abstract of Title, Abstract Manifold or simply Abstract have no association with an Abstract Number assigned by the State of Texas. State abstract numbers are an indexing of land grants issued by the sovereign government (Spain, Mexico, Republic of Texas or State of Texas) within a given county and published by the General Land Office.

Included in the collection is a notebook created by Carol Miller in 1994. She was a graduate student in the UTSA History Department and worked with the collection for 2 ½ years. Included in the notebook is additional research about the Company and records that might be of use to the researcher. Ask the Archives staff for its location.

Richard Leigh Watkins was one of the former owners of records that make up the Stewart Title Company Papers. His papers were separated to create the Richard Leigh Watkins papers.

Bound Volumes of Transcribed Public Records
	This series contains books by the West Texas Abstract and Guarantee Company and Hildebrand and Stribling Abstract Company originally prepared for in-house use. Abstracts of Titles

Abstracts of titles indexed in various ways, originally prepared by both Bexar Abstract Company and its parent companies or by Stewart Title Company. The abstracts represented are only of the land Stewart Title Company (or its parent companies) issued either Abstract Certificates or Title Insurance Policies on or otherwise had the need to research. The abstracts of titles found in this series of records are almost exclusively in Bexar County and are indexed in any one or more of the following methods:

by a City Block (CB) Number used synonymously with New City Block (NCB) Number, if the tract is within the city limits of San Antonio, beginning with NCB A2 and continuing through to NCB 13131 with not all numbers represented;
by a brand or index number beginning with 2.001 and ending with 3.300 corresponding to State Abstract Numbers 1 through 1300 with not all represented;
by a Division number ranging from Division 1 to 91 (see Appendix 1) corresponding to different areas within or near the City of San Antonio with not all represented;
by name arranged in alphabetical order of early settlers generally with large holdings;

Included are Deeds of Trust, maps, Release of Vendor's or mortgage lien, Vendor's lien note, Assignment of lien, Trustee's deed, tax receipts and various other types of documents pertaining to the sale of lands and are predominantly in Texas with names mentioned in Dallas county, Kaufman county, Eastland county and Henderson county. There are also out of state sale of lands from Oklahoma.
