Agency History

The first census of Texas school age children was mandated by an act passed by the 5th Texas Legislature, Regular Session, on January 31, 1854. From 1854 to 1905, annual censuses of school children were conducted in each county by the office of county tax assessor. The responsibility for taking annual scholastic censuses was transferred to the newly created office of county superintendent of schools beginning in 1905 (29th Legislature, Regular Session, Senate Bill 218). From 1905 to 1969 the county superintendent's office compiled and sent a consolidated census roll to the Texas State Board of Education and filed a copy with the county clerk. The original individual enumerated census forms were retained by the county superintendent of schools. After 1969, copies of the rolls were no longer required to be filed with the county clerk (61st Legislature, Regular Session, House Bill 534). In 1989, custody of all scholastic census records in the hands of elected county officials was transferred to the Texas State Library and Archives Commission by the Local Government Records Act (Sec. 201.008, Local Government Code). The Act did not automatically physically transfer any scholastic census records to the Library and Archives Commission, but school districts could offer census records to the commission for historic preservation.

Scope and Contents of the Records

Scholastic census records document the counting of school age children by counties and districts so the state could apportion funds for their education. Records are individual "family census blanks" used in the scholastic censuses for Fort Worth Independent School District between 1928 and 1970. Forms list the name and number of the school district, name of the parent or guardian, and the name, address, birth date, age, sex, and any physical handicaps for each child. Each form is signed and dated by the census enumerator. There are incomplete census returns for several years; the missing portions are noted in the inventory.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

Arrangement of the Records

These records are arranged in two overlapping chronological runs as maintained by the agency. The forms are then subdivided by race, between "white" and "colored" or "black," and filed alphabetically by family surname.

Restrictions

Restrictions on Access

Materials do not circulate, but may be used in the State Archives search room. Materials will be retrieved from and returned to storage areas by staff members.

Scholastic census records dated 75 years ago and earlier are unrestricted and may be accessed by the public (Texas Government Code, Section 552.0215, right of access to certain information after 75 years).

Scholastic census records dated less than 75 years ago are restricted and must be redacted for gender, race, and disability information for the student and any student family members (siblings) listed in the record, unless proof of death of any of those individuals is provided. (Texas Government Code, 552.101 and Family Educational Rights and Privacy Act (FERPA))

To obtain a copy of their own scholastic census record dated less than 75 years ago, on-site patrons must show photo identification (driver's license, state personal ID, U.S. passport, or U.S. military ID). Remote requestors must make their request in writing (to archinfo@tsl.texas.gov or to Texas State Library and Archives Commission, P.O. Box 12927, Austin, TX 78711). Requests by phone are not accepted. The record provided will be redacted for gender, race, and disability for everyone except the former student (in other words, for all the siblings), unless proof of death is provided for any of those siblings.

Social Security Administration requests for scholastic census information that are made in writing on SSA letterhead (mailed or faxed) do not require archivist review and the requested information will be provided regardless of record date. SSA requests made by email will require archivist review for information excepted from disclosure, unless the request can be resubmitted on SSA letterhead through mail or email. Phone requests are not accepted.

The following information applies to scholastic census records dated less than 75 years ago: because of the possibility that portions of these records fall under Public Information Act exceptions including, but not limited to, student records (Texas Government Code, Sections 552.026 and 552.114, in conformity with the Family Educational Rights and Privacy Act of 1974), an archivist must review these records before they can be accessed for research. The records may be requested for research under the provisions of the Public Information Act (Texas Government Code, Chapter 552).

The researcher may request an interview with an archivist or submit a request by mail (Texas State Library and Archives Commission, P.O. Box 12927, Austin, TX 78711), fax (512-463-5436), email (director.librarian@tsl.texas.gov), or see our web page https://www.tsl.texas.gov/agency/customer/pia.html. Include enough description and detail about the information requested to enable the archivist to accurately identify and locate the information. If our review reveals information that may be excepted by the Public Information Act, we are obligated to seek an open records decision from the Attorney General on whether the records can be released. The Public Information Act allows the Archives ten working days after receiving a request to make this determination. The Attorney General has 45 working days to render a decision. Alternately, the Archives can inform you of the nature of the potentially excepted information and if you agree, that information can be redacted or removed and you can access the remainder of the records.

Restrictions on Use

Most records created by Texas state agencies are not copyrighted. State records also include materials received by, not created by, state agencies. Copyright remains with the creator. The researcher is responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).

Technical Requirements

A microfilm reader is necessary to view these records. Microfilm readers are available in the Lorenzo de Zavala State Archives and Library Building. Ask staff members for exact locations.
