Agency HistoryThe Texas House of Representatives Special Committee to Investigate Charges Against Representative H.J. Neinast was created by a Simple Resolution of the 37th Texas Legislature, Regular Session, introduced and adopted by the House of Representatives on January 13, 1921. The resolution charged that the newly elected Representative Henry J. Neinast from Washington County was ineligible to serve and should not be seated because he had pled guilty in 1919 to a federal charge of conspiracy and obstruction of the selective service laws during World War I. The committee of seven members was formed upon passage of the resolution to investigate these charges and to determine if Neinast should be seated as a member of the 37th Legislature. The committee held hearings in late January 1921, subpoenaed witnesses and documents, and received testimony from Neinast and Washington County officials and residents about the guilty plea, Neinast's activities, and claims of his disloyalty. The committee confirmed that Neinast had pled guilty to the federal charge and then had to decide if this was a misdemeanor or a felony and if it barred Neinast, legally or otherwise, from serving in the House. After conducting its investigation, the committee agreed with most of the resolution's charges and recommended that Neinast not be seated as the representative from Washington County. The House adopted the committee's report by a vote of 114 to 13, expelled Neinast, and declared his seat vacant. Sam D.W. Low, who had been representative for Washington County in the 33rd through 35th Legislatures, succeeded Neinast to the position.
