Texas Research and Oversight Council on Workers' Compensation are comprised
of
legislative files, reports and studies, publication development files,
administrative correspondence, news and press releases, plans and planning
records, and speeches and papers relating to workers' compensation in
Texas.
The records date from 1989 to 1999. Records predating 1995 are from the
Texas
Workers' Compensation Research Center and the Legislative Oversight
Committee
on Workers' Compensation Insurance, predecessor agencies to the Research
and
Oversight Council created as part of the Workers' Compensation Commission
in
1989. Among issues addressed in the records are on-the-job injuries, drugs
in
the workplace, insurance deductibles and premiums, managed care and health
care
costs. Additional records include agency rules, policies and procedures,
organizational charts, executive orders, and legal opinions. |

The Texas Research and Oversight Council on Workers' Compensation,
commonly referred to as the ROC, was created on September 1, 1995 by House
Bill
1091, 74th Legislature, Regular Session, 1995, which amended the Worker's
Compensation Act, Senate Bill 1, 71st Legislature, Second Called Session,
1989,
to establish a new entity to serve as an advisory body to the Texas
Workers'
Compensation Commission. The new council merged the functions of the Texas
Workers' Compensation Research Center and the Legislative Oversight
Committee
on Workers' Compensation Insurance, 1989-1995, both of which were created
as
part of the Texas Workers' Compensation Commission in 1989. The Texas
Workers'
Compensation Research Center advised the Workers' Compensation Commission
and
conducted professional studies on benefits delivery, cost and quality of
medical benefits, drugs in the workplace, insurance policies and rates,
rehabilitation and re-employment of injured workers, workers' litigation,
workplace health and safety and other workers' compensation related topics.
House Bill 1091, which created the Texas Research and Oversight Council on
Workers' Compensation, directed that the council assume the research and
advisory duties of the Research Center and that it conduct a study of the
Texas
Workers' Compensation Insurance Fund. The act established the composition
of
the board of directors of the Research and Oversight Council as follows:
three
members of the Texas Senate appointed by the lieutenant governor, three
members
House of Representatives appointed by the speaker of the house, one Texas
Workers' Compensation Commission commissioner who represents employers and
one
who represents employees, and the commissioner of insurance or a designee.
Board members serve at the will of the appointing officer or agency. The
board
is required to conduct research on the performance of the workers'
compensation
system and to receive testimony, reports, proposed or new rules, and
specific
recommendations for legislation from public and private entities involved
in
the workers' compensation system.
The mission of the Texas Research and Oversight Council on Workers'
Compensation is to support the development of an effective and efficient
workers' compensation system serving the state of Texas by conducting
professional studies and research; monitoring, assessing and making
recommendations concerning the operational system; and providing the
general
public with information and assistance. It is organized into three
sections:
organizational, research and oversight. For additional information see the

charts. Records predating 1995 are from the Texas Workers' Compensation

Impairment Schedule, dating from 1993 to 1996. Research agenda records include
planning and information for the agency, correspondence from Texas state
institutions of higher education and other state agencies commenting on the
1995 proposed agenda and a request for proposals to administer a survey
providing data on the status of former workers' compensation policy holders in
Texas. Impairment schedules are used to determine the extent and severity of
workers' disabilities or injuries and how much compensation they are entitled
to receive. The Texas Impairment Schedule is a modification of the national AMA
schedule. Records on the Texas Impairment Schedule include correspondence with
doctors on the proposed implementation of the plan, background reports,
guidelines for administering workers' compensation and lists of consulting and
review doctors participating in the program. |
