         <head>Agency History</head>
         <p>The Texas Legislature's House Committee to Investigate the Milk
		  Industry of Texas came into existence as a result of two House Simple
		  Resolutions (later numbered 105 and 140). On March 28, 1935, during the Regular
		  Session of the 44th Legislature, Representative Hardin introduced a simple
		  resolution (No. 105) condemning the practices of Borden, Inc. and its
		  relationship with the dairy farmers of Texas. Hardin proposed a committee of
		  five to investigate the activities of such trusts and corporations and to
		  recommend laws to protect Texas citizens. The resolution was referred to the
		  Committee on Federal Relations, which recommended its passage on April 23.
		  Hardin then amended his resolution to ask that a committee of three investigate
		  all dairy and food products corporations in Texas. Subsequent amendments
		  brought the number of committee members back to five and slightly altered the
		  scope of the investigation. The resolution, now asking for an investigation of
		  <emph render="doublequote">the charges of unfair practices within the dairy industry
		  of this State and the causes of the decline in the price of milk paid to the
		  producers</emph> passed on April 23. Representatives Ross Hardin, Traylor
		  Russell (Chair), John W. Fain, Herman Jones of Wise County, and Verner M.
		  Butler of Karnes County were appointed to the Committee to Investigate the Milk
		  Industry of Texas on May 11, 1935.</p>
         <p>The committee was originally to report back to the Legislature by the
		  end of the First Called Session (1935) but, since members had finished taking
		  testimony but had been unable to complete the final report, Representative
		  Russel requested an extension (House Simple Resolution #?) until the Second
		  Called Session. The report was finally printed in the House Journal on November
		  14, 1935, during the Second Called Session of the 44th Legislature, 1935. The
		  report discussed the current relationship between milk producers and
		  distributors, the Houston milk shed (as an example of the best milk production
		  organization in the state), anti-trust violations, and the cream grading
		  program. The committee recommended the creation of a state agency to supervise
		  the dairy industry, the licensing of dairy plants and those who tested milk and
		  cream, the passage of legislation to prevent price manipulation for purchasers
		  of milk products, the passage of a usage law requiring an accurate account of
		  the quantity and class of milk products purchased, the establishing and
		  enforcing of standards for milk sale and labeling, the enforcement of the
		  weight and test law, and the abolishment of the current cream grading program.
		  Legislation based on the recommendations was introduced by Representative
		  Hardin during the Regular Session of the 45th Legislature, 1937.</p>

		  program. The report is signed by the five committee members and stamped with
		  the date (November 14, 1935) it was received and filed in the office of the
		  Chief Clerk of the House of Representatives.</p>
         <p>To prepare this inventory, the described materials were cursorily
