Agency History

The Criminal Justice Division (formerly called the Office of Criminal Justice Planning) within the Texas Governor's Office administers federal and state funding to local, regional and statewide criminal justice-related projects. The goals of the Criminal Justice Division are to support programs that protect people from crime; reduce the number of crimes committed; and promote accountability, efficiency, and effectiveness for the criminal justice system. Duties of the Criminal Justice Division include or have included: assisting the Governor in developing policies, plans, programs, and proposed legislation for improving the criminal justice system; preparing the comprehensive state criminal justice plan; administing the Criminal Justice Planning Fund; administering federal funds (grants) to state agencies, units of local government, and other eligible applicants for programs and projects recommended by the Texas Criminal Justice Council (later known as the Texas Criminal Justice Division Advisory Board); and providing assistance, through a federal grant, to parolees seeking employment.

The Criminal Justice Division is administered by an Executive Director, appointed by the Governor for an indefinite term. In addition to his administrative duties, the Executive Director provides interpretations of statutes, both for state agencies and the general public involved in law enforcement and criminal justice. In October 1973, the Executive Director appointed an individual as General Counsel, to assist in providing statute interpretations and in other matters relating to policies and procedures.

Passage of the federal Omnibus Crime Control and Safe Streets Act of 1968 made necessary the creation of a body to administer that Act's provisions, and so the Texas Criminal Justice Council was created by an Executive Order of Governor John Connally on October 18, 1968, and later reorganized by Governor Preston Smith, on October 8, 1971, Executive Order 71-5. The Council was composed of the Governor, who served as chair, several ex-officio members (state administrators in criminal justice-related agencies), and several representatives of local governments. These latter members were appointed by the Governor for three-year terms. An Executive Director was also appointed by the Governor.

The Criminal Justice Council was provided staff from the Office of Criminal Justice Planning (which later became the Criminal Justice Division) of the Governor's Office. The Texas Criminal Justice Council was renamed the Texas Criminal Justice Division Advisory Board in 1974. Duties of the Council were to develop a comprehensive plan for the improvement of criminal justice throughout the state; to assist the Governor in criminal justice related matters; to develop, review, and recommend criminal justice programs and projects for the state, regional, and local government units; to oversee the administration of all programs enacted under the provisions of the Omnibus Crime Control and Safe Streets Act of 1968; and to assist staff in preparation and passage of criminal justice legislation. A principal component of the Council was its Executive Committee. This committee was composed of ten members from the Council, appointed by the Governor. Duties of the committee were to recommend the funding of planning and action grant applications, recommend the annual criminal justice plan of the Council, appoint subcommittees, and provide support and assistance to the Executive Director and staff of the Council. This staff was administered by the Council's Executive Director, who later became the Executive Director of the Criminal Justice Division.

General files of the Executive Director of the Criminal Justice Division, largely those of Robert C. Flowers, Executive Director during Governor Dolph Briscoe's administration, reflect the close interaction of the Executive Director with the General Counsel of the Criminal Justice Division. Types of materials include correspondence, memorandums, studies, reports, copies of laws and regulations, meeting minutes, printed materials, publications, clippings, and notes covering the period 1971-1980, bulk 1973-1979. These files concern the establishment of policies and procedures; interpretation of statutes; existing and proposed legislation; federally funded programs, such as the Comprehensive Employment and Training Act program, and the federal crimes program; grants issued to sub-state recipients; civil rights concerns; and financial activity, such as audits and budgets. Meeting files of the Criminal Justice Council, and its successor, the Criminal Justice Division Advisory Board, contain general minutes and other meeting records of the Council/Board and minutes of the Executive Committee and subcommittees. Subcommittees represented are: Courts subcommittee, Corrections subcommittee, and Police subcommittee. Files consist of minutes, meeting agendas, memorandums, grant applications to be considered, correspondence, drafts of minutes, copies of the state criminal justice plan, reports and other items to be discussed, clippings, and sign-in sheets of meeting attendees, dating 1969-1982. Two sets of meeting files are held, the first listed spanning 1969 to 1978, the second set spanning 1973 to 1982.

Criminal justice plans, 1974-1976,
15 cubic ft.

The Criminal Justice Division (formerly called the Office of Criminal Justice Planning) within the Texas Governor's Office administers federal and state funding to local, regional and statewide criminal justice-related projects. Files consist largely of state and regional criminal justice plans, reviews, and correspondence covering the period 1974-1976. Grant applications for criminal justice programs and projects were made by state agencies, units of local governments (generally regional councils of government, but also cities, counties, and school districts), and private nonprofit corporations. Regional councils of government are associations of local governments, organized and governed by elected local officials, that serve as multipurpose planning agencies for multi-county state planning regions. The councils are the focal point for various state and federal planning and development programs and provide technical assistance, service, or training to member governments. They also review and comment on local government applications to federal grant programs to determine if the proposed project is consistent with regional plans or policies. A major portion of their financial support is federal, with state and local governments providing additional funding.

Criminal justice plans dating 1974-1976, prepared generally by regional councils of government, include planning area population and characteristics; crime and delinquency problems; capabilities of the criminal justice system (law enforcement, courts, corrections systems, and problems and needs); goals and objectives; status of current activities; proposed projects and projected costs of each; and evaluation of the proposed program. Membership of the regional council and the local and regional planning commissions that were involved is also given. Some of these plans are accompanied by an additional set of materials: correspondence, contracts, budgets and monthly reports of expenditures, statements of grant awards, reviews and comments of the programs, and the overall planning design of the regional planning commission. The records are arranged into two sets by date span. The latter set consists only of criminal justice plans.
