The Texas House of Representatives Committee on Redistricting has
jurisdiction over all matters pertaining to legislative districts, both House
and Senate, and any changes or amendments; congressional districts, their
creation, and any changes or amendments; establishing districts for the
election of judicial officers or of governing bodies or representatives of
political subdivisions or state agencies as required by law; and preparations
for the redistricting process. Redistricting entails the revision of existing
districts into new districts with different geographical boundaries. The Texas
Constitution (Article III, Section 28) requires the legislature to redistrict
seats in the Texas House of Representatives and the Senate during its first
regular session after publication of each United States decennial census, which
occurs in each year ending in zero. The U.S. Constitution (Article I, Section
2) calls for reapportionment of congressional seats according to population
from a decennial census. Texas state law (Senate Bill 2, 72nd Legislature, 2nd
Called Session, 1991) provides for a decennial reapportionment of State Board
of Education boundaries, and the Texas Constitution (Article V, Section 7a) and state law
(V.T.C.A., Government Code, Section 24.941 et seq.) provide for a statewide
reapportionment of judicial districts within three years of the federal
decennial census. As a result of these provisions, the 72nd Legislature was
involved in redistricting the boundaries for the Texas House of Representatives
and Senate, the U.S. Congress, the State Board of Education, and the state's
judicial districts.
The basic purpose of decennial redistricting is to equalize population
in state and congressional districts after publication of the federal census
indicates an increase, decrease, or shift in population location. Two primary
requirements govern all redistricting decisions. First, districts of a given
type (Texas House of Representatives and Senate, U.S. Congress, State Board of
Education) must have equal or nearly equal populations; and, second, districts
must be drawn in a manner that does not have the purpose, and will not have the
effect, of denying or abridging the right to vote on the basis of race or
language group. These requirements are based on the guarantees of the
Fourteenth (the equal protection provision) and Fifteenth (prohibiting voting
discrimination because of race) Amendments to the U.S. Constitution, the
federal Voting Rights Act, and Article I, Section 2 of the U.S.
Constitution.

Records of the Texas House of Representatives Committee on Redistricting
reflect the reassessment of legislative, congressional, judicial, and
educational district boundaries as necessitated by the 1990 United States
Census according to federal and Texas state laws and the Texas Constitution.
Records include maps, statistics, agenda, notices of hearings, testimony,
correspondence, memoranda, proposals, witness affirmations, summaries of public
hearings, news clippings, news releases, petitions, handouts, reports, copies
of bills, Attorney General opinions, copies of court cases, court orders, audio
cassettes, recommendations, resolutions, address lists, and notes, dating
1966-1992, bulk 1990-1992. Representative D.R. "Tom" Uher (D-Bay City) served as chair of the 11
member committee before and during the 72nd Legislature when the majority of
these records were created. Representative Delwin Jones (R-Lubbock) served as
vice-chair of the Committee. The committee's work was complicated by
controversies surrounding the U.S. Census Bureau's population counts for
1990.
In order to meet U.S. Justice Department requirements for access to
the Legislature during redistricting, the Senate Select Committee on
Legislative Redistricting, together with the House Committee on Redistricting,
held a series of joint regional hearings in 1990, 1991, and 1992 throughout the
state designed to gather and solicit information pertinent to the redistricting
process. Amendments and proposals for redistricting were submitted to the 72nd
Legislature in 1991. However, claims from thousands of cities across the
country alleging the 1990 preliminary census undercounted their populations
gave rise to litigation and controversy and further complicated the committee's
work. Besides being a determining factor in political redistricting, the census
counts are critical in determining allocation of federal funding, grants, and
services. Correspondents include constituents individually and as members of
task forces or political parties, other state or local officials as well as
other legislators expressing opinions and concerns regarding congressional,
legislative, judicial and State Board of Education redistricting.
Maps are of Texas or of portions of the state illustrating proposed
boundaries for redistricting. Statistical data involve district population
analyses detailing size, ethnicity, and voting age of a district's population.
The Texas Legislative Council staff prepared much of the population and
ethnicity data, maps, and election histories used by the committee. The council
is a nonpartisan service agency for the Texas Legislature providing legal and
data processing services, and serving as a source of impartial research and
information.
The term "communities of
interest" refers to groups of people sharing mutual interests, such as
coordinating and cooperating closely in transportation, economic development,
and land use planning and implementation. Examples of communities of interest
include neighborhoods, towns and cities, rural and urban areas, counties or
larger geographical areas. Private sector community organizations and services
might also be coordinated through an alliance of Chambers of Commerce.
Maintaining communities of interest is a traditional redistricting principle.
The federal Voting Rights Act, Section 5, prevents the enforcement of new laws
or practices that would diminish minority voting rights.
To prepare this preliminary inventory, the described materials were
cursorily reviewed to delineate series, to confirm the accuracy of contents
lists, to provide an estimate of dates covered, and to determine record
types.

Because of the possibility that portions of these records fall under Public Information Act exceptions including, but not limited to: confidentiality of a memorandum of a communication of a resident with a member of the legislature (V.T.C.A., Government Code, Section 306.003); confidentiality of a communication of a citizen with a member of the legislature (V.T.C.A., Government Code, Section 306.004); confidentiality of communication of an assistant or employee of the Texas Legislative Council with a member of the legislature (V.T.C.A., Government Code, Section 323.017); and privacy (V.T.C.A., Government Code, Section 552.101), an archivist must review these records before they can be accessed for research. Most records created by Texas state agencies are not copyrighted and
may be freely used in any way. State records also include materials received
by, not created by, state agencies. Copyright remains with the creator. The
researcher is responsible for complying with U.S. Copyright Law (Title 17
U.S.C.).

Public hearing and meeting files of the House Committee on Redistricting record the committee's actions to gather public response and
illustrate the controversies arising from the committee's proposals. Types of
records in this series include correspondence, agenda, handouts, witness
affirmations, testimony, petitions, maps, reports, news releases, audio
cassettes, notices of hearings, address lists, and statistics, dating from 1978
to 1992. Together with the Senate Select Committee on Legislative
Redistricting, the House Committee on Redistricting held a series of 14 joint
regional hearings in 1990 throughout the state designed to gather and solicit
information pertinent to the redistricting process. In 1991, with the release
of the controversial 1990 United States Census figures and the 1991 Regular
Session (72nd Legislature) in progress, the committee held another series of
public hearings in Austin and in select areas throughout the state on the
subjects of congressional, legislative, and State Board of Education
redistricting. The 72nd Legislature dealt with redrawing congressional
districts, state House and Senate districts, State Board of Education (SBOE)
districts, and possibly judicial districts. Most of the maps are
computer-generated maps produced for the committee by the Texas Legislative
Council and illustrate proposed changes to districts. Data available to the
legislature in 1991 for redistricting considerations includes census data,
consisting of voting age, total population by race/ethnicity for counties,
Voting Tabulation Districts (voting precinct approximation), census blocks, and
election history information. Earlier material documents redistricting work
done by the 67th and 68th Legislatures after the 1980 U.S. Census. Researchers

Research files of the House Committee on Redistricting reflect the
redistricting committee's information-gathering efforts to resolve
controversies surrounding both the 1980 and 1990 federal census counts. Types
of records in this series include news releases, news clippings, summaries of
public hearings, articles, correspondence, memoranda, copies of court cases,
and state Attorney General opinions, dating 1966-1992, bulk 1980-1992. Press
releases were issued by the U.S. Department of Commerce and Congressman Tom
Sawyer (D-OH) as chair of the Subcommittee on Census and Population. The
purpose of this subcommittee was to ensure that the population counts derived
from the 1990 decennial census were as accurate as possible before they were
transmitted to the states for various uses, including legislative
redistricting. This subcommittee held a hearing in Austin in July of 1990 to
invite participation in resolving the census count issue. Controversy revolved
around the 1990 Census count because of suspected undercounts of portions of
the population. |

Materials do not circulate, but may be used in the State Archives search
room. Materials will be retrieved from and returned to storage areas by staff

under Public Information Act exceptions including, but not limited to:
confidentiality of a memorandum of a communication of a resident with a member
of the legislature (V.T.C.A., Government Code, Section 306.003);
confidentiality of a communication of a citizen with a member of the
legislature (V.T.C.A., Government Code, Section 306.004); confidentiality of
communication of an assistant or employee of the Texas Legislative Council with
a member of the legislature (V.T.C.A., Government Code, Section 323.017); and
privacy (V.T.C.A., Government Code, Section 552.101), an archivist must review
these records before they can be accessed for research. The records may be
requested for research under the provisions of the Public Information Act
(V.T.C.A., Government Code, Chapter 552). The researcher may request an
interview with an archivist or submit a request by mail (Texas State Library
and Archives Commission, P. O. Box 12927, Austin, TX 78711), fax
(512-463-5436), email (Dir_Lib@tsl.state.tx.us), or see our web page (http://www.tsl.state.tx.us/agency/customer/pia.html). Include enough description and detail about the information
requested to enable the archivist to accurately identify and locate the
information. If our review reveals information that may be excepted by the
Public Information Act, we are obligated to seek an open records decision from
the Attorney General on whether the records can be released. The Public
Information Act allows the Archives ten working days after receiving a request
to make this determination. The Attorney General has 45 working days to render
a decision. Alternately, the Archives can inform you of the nature of the
potentially excepted information and if you agree, that information can be
redacted or removed and you can access the remainder of the records. |

records in this series include memoranda, correspondence, proposals, testimony,

telephone, proposals, and recommendations made by legislators or members of
congress to the committee are recorded here along with correspondence. County
files were created to organize possible communications with residents or
officials from various counties including proposals, correspondence, testimony,
and maps pertaining to each county. |

News clippings files of the House Committee on Redistricting
illustrate press reportage of the conflict engendered by legislative
redistricting plans. Records are news clippings dating 1990-1992. Among those
protesting redistricting outcomes, Hispanic and civil rights groups filed
lawsuits claiming the 1990 census data used by the committee may have excluded
hundreds of thousands of Texans because it did not adjust for minority
undercounts. Considerable debate also resulted from differences between
Republican and Democratic redistricting goals. |
