to the Public Information Act, we are obligated to seek an Open Records Opinion
from the Attorney General before the files can be provided to the researcher.
The Public Information Act allows the Archives ten business days after
receiving the written request to make this determination.

Agency History
The House Committee on Public Education is a standing committee of the
Texas House of Representatives. The committee designs and creates the House
policies on public education matters. As a standing committee, the Committee on
Public Education functions continuously, including the interim between
legislative sessions. The Committee on Public Education's chairman during the
71st and 72nd Legislatures was Representative Ernestine Glossbrenner. As
chairman of this committee, Representative Glossbrenner was entitled to serve
as a member of the Legislative Education Board. This Board, created in 1987,
oversees and reviews the implementation of legislative education policy,
including fiscal policy.
Scope and Contents of the Records
Types of records include minutes, agenda, copies of legislative bills
and resolutions, correspondence, memos, bill analyses, legislation summaries,
committee reports, attorney general opinions, and computer models of financial
studies. Records date from 1982 to 1992 but are primarily from 1988 to 1992.
Records are from the House Committee on Public Education and its chairman,
Representative Ernestine Glossbrenner, and cover Representative Glossbrenner's
and the Committee's activities from the 71st and 72nd Legislatures and during
the interim between legislative sessions.
The pressing education issue of the day, and strongly reflected in
these records, was state financing of public schools. This issue was brought to
the forefront by various court cases, including Edgewood Independent School
District, et. al. v. Kirby, et. al., which found the current method of state
funding of public schools unconstitutional and resulted in a court mandate for
the Legislature to devise a new method of public school financing. School
financing overshadowed all other education issues for the Committee for several
years and was not resolved in the time frame of these records. Besides school
financing, other issues of concern to the Committee as shown in these records
include a proposed revamping of the powers and duties of the Commissioner of
Education, Legislative Education Board activities, oversight of the State Board
of Education, and school district redistricting. Also included are records from
special committees created to study specific education topics: Public School
Employee Group Insurance Interim Subcommittee (1988-1989), Governor's Task
Force on Public Education (1990), Joint Interim Committee on Proprietary
Schools (1991), and Joint Committee for Cost Adjustment for Public Education
(1992).
Arrangement of the Records
The first four boxes of Committee records include copies of minutes
and agenda from State Board of Education meetings arranged chronologically. The
rest of the Committee's records are in chronological order beginning with the
71st Legislature, through the interim session, and finishing with the 72nd
Legislature. The records are roughly divided into either legislative bill files
or subject files but they are not in order within those designations.
