minutes (namely, trade secrets, excluded from disclosure by Section
552.110 of the Texas Public Information Act) in the copies transferred to the
Archives and Information Services Division of the Texas State Library and
Archives Commission. Therefore there are no restrictions in these copies.
Meeting documentation in the Texas
Agriculture Resource Protection Authority meeting files contains witness
registration forms that need to be reviewed for home addresses of state
employees, that may be restricted under Texas Public Information Act, 552.117.
Producer Board files may contain home
addresses and social security numbers of board members that may be restricted
under Texas Public Information Act, 552.117.

Agency History
The Texas Department of Agriculture was established by legislation of
the 30th Legislature (House Bill 274 and Senate Joint Resolution 13, Regular
Session) in 1907. Until then, official agricultural business had been conducted
by the Department of Agriculture, Insurance, Statistics, and History.
Commissioner Robert Teague Milner was appointed until the 1908 general election
could be held. The new agency had a staff of four, including the commissioner.
Departmental duties included gathering statistics, publishing agricultural
information, and holding farmers' institutes to promote advanced farming
methods and practices. Under Milner the agency began to reflect the role it
would play as a regulatory arm and advocate for cotton farmers. A cotton bureau
was established in 1907 to prevent falsifying the size of Texas cotton crops.
In his only report to Governor Thomas M. Campbell, Milner complained that the
$17,038 department budget was inadequate. In 1908 Milner accepted the
presidency of Texas A&M University. Edward Reeves Kone was selected to take
his place and was elected to office in 1908, 1910, and 1912. Kone frequently
traveled around the state to talk to farmers. In 1910 he and members of his
staff made a 1,280-mile rail tour of Texas to give demonstrations to thousands
of farmers and persuaded the legislature to increase the agency's budget to
$30,178 for fiscal year 1909-10.
Fred Davis succeeded Kone in 1915 and worked to improve the lot of
cotton farmers. Although cotton dominated Texas agriculture, prices paid to
farmers rarely covered costs. Davis urged growers to figure expenses and
withhold cotton from the market until a fair predetermined price was reached.
Though his campaign failed, it helped farmers develop more accurate estimates
of production costs. A severe drought in 1917, up to then the driest year in
Texas history, added to producers' economic woes. The department recorded crop
and livestock losses in two-thirds of the state. Through Davis' efforts the
department helped to get farmers who had food and feed to sell in contact with
prospective buyers. This project was a forerunner of the agency's
direct-marketing program. During Davis' final year in office, 1920, the
department had 137 employees in seven divisions and a $225,422 budget.
George B. Terrell, commissioner from 1921 to 1930, increased the
department's services to farmers and promoted the state's citrus industry. In
1925 the department's duties were greatly expanded when it assumed tasks
previously handled by the Department of Markets and Warehouses, including
inspection of weights and measures, operation of the market news service, and
supervision of gins, warehouses, and farmers' co-ops (House Bill 2, 39th
Legislature, Regular Session, 1925). The marketing bureau encouraged sales of
more than $2.5 million in Texas agricultural products by introducing sellers to
prospective buyers. Terrell continued a battle begun under Davis against the
pink bollworm, a destructive pest that threatened the state's cotton industry.
James E. McDonald succeeded Terrell in 1931. During his administration the Low
Water Dam and Jacks and Stallions divisions were founded and eliminated. The
Low Water Dam Division encouraged farmers to conserve water by building sloughs
and ravines. Jacks and Stallions distributed registered and high-grade mules
and horses over the state for the purpose of breeding. McDonald's
administration also saw the establishment of processing plants for Texas fruits
and vegetables and the expansion of the sweet potato, tomato, citrus,
black-eyed pea, watermelon, truck-farming, poultry, dairy, and nursery and
floral industries. McDonald was reelected every two years until
twenty-five-year-old John C. White defeated him in 1950.
In the first major overhaul of the department, White decentralized the
agency, initiated the first cooperative effort with Mexico to control insect
pests, encouraged state legislation for registration and analysis of
agricultural chemicals, and established laboratories to test chemical residues
and contaminants before and during harvest. Under White the department
inaugurated the Texas Agricultural Products marketing project to promote Texas
products. It also began the Family Land Heritage Program, an annual program
honoring Texas farmers and ranchers who have worked their land for 100 years or
more. From the spring of 1975 to January 1983 the department published TDA
Quarterly, a glossy magazine on agricultural issues designed for a popular
audience. White resigned in 1977 to become deputy United States secretary of
agriculture. Governor Dolph Briscoe appointed Reagan V. Brown to succeed him.
In 1978 Brown was elected under the new statute providing four-year terms for
statewide elected officials (proposed by Senate Joint Resolution 1, 62nd
Legislature, Regular Session, 1971). To prevent the spread of the Mediterranean
fruit fly from California to Texas in 1981, Brown required California produce
to be fumigated before entering the state. Under special legislation passed
during the fruit-fly crisis, the department was authorized to seize or destroy
infested products and to stop interstate and intrastate traffic to enforce the
law (House Bill 151, 67th Legislature, First Called Session, 1981). Brown also
worked to halt the spread of the imported fire ant.
Jim Hightower became the eighth commissioner of agriculture on New
Year's Day, 1983. His major initiatives included establishing a state network
of farmers' markets and wholesale marketing cooperatives, expanding the program
to help producers sell directly in international markets, updating the existing
Texas Agricultural Products promotion (renamed the Taste of Texas program),
helping farmers and ranchers get financing to build processing and marketing
facilities, encouraging new agricultural development of such products as wine
grapes and native plants, opening an office of natural resources to work with
rural residents and farmers on farmland conservation, rural water quality, and
water conservation, and increasing the department's voice in shaping national
policies that affect Texas agriculture. In addition, the department's Right to
Know Division, established to implement the 1987 agricultural-hazards
communication act (House Bill 1896, 70th Legislature, Regular Session), worked
to keep farmers and farmworkers informed on hazardous pesticides they might
encounter in their work. In 1986 the department began publishing the Texas
Gazette, a bimonthly newsletter about department affairs, and the fall of 1987
saw the first issue of Grassroots, an irregularly published serial focusing on
the environment and consumer topics. The department also continued its
publication of numerous brochures on both specialized and popular topics,
ranging from directories of agricultural cooperatives to Texas wines and
wineries. In the late 1980s the department had a staff of 575 and administered
forty-nine laws that affected numerous agriculture-related matters, including
pesticide registration, egg quality, accuracy of scales and gasoline pumps,
citrus fruit maturity, seed purity, and fire ant control.
Since the enactment of the Texas Sunset Act in 1977 the Texas
Department of Agriculture has been subject to review every twelve years by the
Texas Sunset Advisory Commission. When the department came up for its first
review in 1989, controversy occurred over the possibility of either making the
post of agricultural commissioner an appointed one or eliminating the
department entirely. Though eventually the department was continued with an
elected commissioner, several changes were implemented in the agency's
structure, including the establishment of a nine-member board, chaired by the
agriculture commissioner, which was charged with overseeing pesticide
regulation (Senate Bill 489, 71st Legislature, Regular Session, 1989). This was
an authority that had previously been granted to the commissioner of
agriculture alone. In 1994 the commissioner of agriculture was Rick Perry, who
defeated Jim Hightower in the 1990 election. The budget for fiscal year 1995
was $21,584,790. At that time the Texas Department of Agriculture had market
and regulatory powers and administered over fifty laws. To perform its duties
it had five regional centers, seven suboffices, and eleven divisions.
In 1998, Susan Combs, a fourth-generation rancher, was elected the
state's 10th commissioner of agriculture and is the first woman to hold this
position in the state's history. The department, with headquarters in Austin,
has twelve district offices-in Amarillo, Beaumont, Brenham, Dallas, Houston,
Lubbock, Odessa, San Antonio, San Juan, Stephenville, Tyler, and Vernon. Its
consumer-services division is one of the largest in the state administration.
Current duties include promoting Texas agricultural products locally,
nationally and internationally; assisting in the development of the
agribusiness industry in Texas; regulating the sale, use and disposal of
pesticides and herbicides; controlling destructive plant pests and diseases;
and ensuring the accuracy of all weighing or measuring devices (such as grocery
scales and gas pumps) used in commercial transactions.
TDA includes: five regional centers in Dallas, Houston, Lubbock, San
Antonio, and San Juan; four suboffices in Amarillo, Corpus Christi, El Paso,
and Tyler; three seed laboratories in Giddings, Lubbock, and Stephenville; six
export pens in Brownsville, Del Rio, Eagle Pass, Houston, and Laredo; six
Cooperative Inspection Program Facilities in Alamo, Austin, Brownsville,
Gorman, Pearsall, and Pleasanton; and a pesticide laboratory in Brenham.
Agricultural programs are carried out by the Marketing and Agribusiness
Development Division, Pesticide Programs Division, Producer Services Division,
and Regulatory Programs Division. Supporting TDA divisions consist of
Administration, Communications, General Counsel, Intergovernmental Affairs and
Internal Audit. In addition, the Texas Agricultural Statistics Service and the
Texas Cooperative Inspection Program are joint federal-state programs operated
by TDA and the federal government. The service provides state, district, and
county estimates for major field crops, small grains, livestock, fruit, pecans,
and vegetables, while the inspection program oversees the quality inspection of
fresh fruits, vegetables, nuts, and peanuts. TDA also works in conjunction with
the Agriculture Resources Protection Authority on pesticide issues, the Texas
Boll Weevil Eradication Foundation, Inc. regarding boll weevil eradication, the
Texas Food and Fibers Commission on natural fibers development and plant food
protein research, and a variety of advisory boards. Finally, TDA administers
the Texas Agricultural Finance Authority, which provides financial assistance
to agriculture related businesses for the production, processing, marketing,
and export of Texas agricultural products.

documents, press releases, speeches, pamphlets, computer tapes and disks,
database printouts, photographs, contact sheets, negatives, slides, printed
materials, audiotapes, videotapes, and motion picture film that document the
Texas Department of Agriculture (TDA) from 1924 to 2001 (bulk 1960-1997).
Meeting files document the Texas Agricultural Finance Authority, the
Texas Agricultural Diversification Program Board, the Texas Agriculture
Resources Protection Authority, the Texas Board of Plant Breeder Examiners, the
Texas State Seed and Plant Board, the Texas Produce Recovery Fund Board, the GO
TEXAN Partner Program Advisory Committee, the Texas Prescribed Burning Board
and a variety of other related bodies. The materials document the work of the
boards and committees in administering the programs that provide loans and
grants to agriculture-related businesses; promoting agricultural
diversification in Texas and market expansion and consumer awareness of Texas
agricultural products; establishing environmental rules, regulations and
prescribed burning standards; and managing seed quality and development,
pesticides and pest eradication, herbicides, and ground and surface water. The
materials also include meeting materials from non-Texas organizations with
which members of the Department of Agriculture staff were involved or
concerned.
Among the other major records series, Producer
Board files document the creation, activities, and occasional
dissolution of the local Texas producer boards operating under the oversight of
the TDA. Boards represented various agricultural products and livestock,
addressing subjects such as pests and predators, disease, marketing, education,
crop and livestock production, drought, and other topics of concern to each
board's particular product. The Reports series
includes both budget and market reports. The market reports document the daily
demand in Texas for various commodities and include the status of those
commodities in other regional markets. Produce covered by the reports includes
turkeys, eggs, chickens, rice, fruits and vegetables, grains, watermelon, grain
sorghum, and pecans. Litigation files document
possible violations of Texas agriculture laws and the restitutions made by the
violator, particularly regarding the sale of agricultural products with an
expired or invalid license, improper use of pesticides, and investigations of
complaints involving the application of pesticides. Speeches and Press releases
illustrate the public activities of Commissioners John C. White, Reagan Brown,
Jim Hightower, and Rick Perry. Additional information about the agency's

A variety of sound, video, and motion picture recordings document many
of the activities and public appearances of Commissioners Jim Hightower and
Rick Perry. Subjects of the footage include TDA regulatory and promotional
activities, TDA offices and other facilities, Texas agricultural products in
all phases from field to retailer, tours of agricultural facilities including
processing plants, gins, sheds, wineries, etc., press conferences on TDA
activities, the State Fair of Texas and other livestock shows, conferences on
agriculture-related areas, interviews of Texas producers and others involved in
agriculture, and general shots of Texas agricultural areas throughout the
state. All records are unedited.
The photographic media document the Department of Agriculture's
concerns, responsibilities, and events. Subjects include livestock,
agricultural products, agricultural processing, farmers, ranchers, crops,
agricultural equipment, agricultural pests, fairs, meetings, and the activities
of commissioners John C. White, Reagan V. Brown, Jim Hightower, and Rick Perry.
Some of the images were probably used in department publications.

These records consist of copies of minutes of board meetings and
work sessions of the Texas Agricultural Finance Authority, dating 1988-2001.
These minutes document the work of the board in administering the programs that
provide loans and grants to agriculture-related businesses. Among other things
the minutes include summaries of reports and presentations by board members,
staff, and other interested parties; requests for discussion, with the ensuing
comments; motions made by board members and the results. Minutes are created to
document in a thorough but usually summary fashion the official actions of the
board in its meetings.

Historical Sketch
The Texas Agricultural Finance Authority (TAFA) was created in
1987 (House Bill 49, 70th Legislature, 2nd Called Session) as a Public
Authority within the Texas Department of Agriculture. TAFA provides financial
assistance to to eligible agricultural and non-agricultural businesses in
partnership with banks or other agricultural lending institutions through seven
programs. Administered by the commissioner of agriculture and governed by a
board of directors, the authority provides financial assistance for the
production, processing, marketing, and export of Texas agricultural products.
The Loan Guaranty Program provides financial assistance through loan guarantees
to eligible agricultural businesses that are, or propose to be, engaged in
innovative, diversified, or value-added production, processing, marketing, or
exporting of an agricultural product or other agricultural-related rural
economic development projects. The Direct Loan Program may provide a direct
loan to an eligible applicant in cooperation with the applicant's lender. The
Loan Participation Program provides assistance to lending institutions for
eligible agricultural projects through the purchase of an undivided interest in
a loan made by a lender. The Young Farmer Loan Guarantee Program provides
financial assistance through loan guarantees to eligible applicants from 18 to
39 years of age who wish to establish or enhance their farm and/or ranch
operation or establish an agricultural-related business. The Farm & Ranch
Finance Program provides financial assistance to eligible and creditworthy
applicants for the purchase of farm land and/or ranch land that will be in full
time agricultural use. The Linked Deposit Program encourages private commercial
lending at below market rates to eligible applicants for certain projects.
Eligible projects include: production of an alternative crop, a value-added
project, a project that is located in a USDA- or Presidential-declared disaster
area, and a project using water conservation techniques or purchasing water
conservation equipment. Finally, the Rural Development Finance Program provides
loan guarantees to rural, non-agricultural businesses. The applicants must be
located within the state who can provide significant benefits for rural areas,
show evidence of creation or retention of employment, and prove evidence of
reasonable equity in the project.

members: the commissioner of agriculture, the director of the Institute for
International Agribusiness Studies of Prairie View A&M University, and four

These records consist of minutes, meeting supporting documentation
(namely correspondence, memoranda, notes, budget statements, and agenda), and a
manual of the Texas Agricultural Diversification Program Board (TADP), dating
1988-1992, 1994. These materials document the work of the board in promoting
agricultural diversification in Texas, and include such items as discussion and
action on active grants, discussion and action on rules for matching grants,
discussion on the awarding of matching grants in each category, updates on
sources for Agricultural Diversification Program funds, updates on the linked
deposit program and the microenterprise loan program. A majority of the files
contain only minutes, a few files contain additional supporting documentation.
One of the two manuals, detailing TADP grant procedures, was put together in
1994 by the Texas Agricultural Finance Authority in order to continue the grant
program which had, by that time, been taken over by the Department of
Agriculture's office of the Assistant Commissioner for Intergovernmental
Affairs. The other manual, dating 1992, details the rural microenterprise loan
program.
Minutes are created to document in a thorough but summary fashion
the official actions of the board in its meetings.
Historical Sketch
The Texas Agricultural Diversification Program Board was created
in 1987 by House Bill 49, 70th Legislature, 2nd Called Session, to assist the
commissioner of agriculture in the creation and implementation of the
agricultural diversification program created by that act. The board's duties
included the awarding of grants and the recommendation of additional criteria
for awarding grants. The grants awarded by the program included the following:
a grant program supporting research and innovation leading to organizational or
marketing improvement in businesses based on agriculture, or to the
commercialization of new crops, new agricultural products, or new production
processes; a business assistance grant program; a grant program to provide seed
money for self-financing small business incubators; and a linked deposit
program to encourage commercial lending.
The board was composed of eight members: the commissioner of
agriculture; the director of the Institute for International Agribusiness
Studies of Prairie View A&M University; four members appointed by the
governor with the advice and consent of the Senate (the governor also appointed
one of these members as the chair of the board); one state representative
appointed by the Speaker of the House (ex-officio, non-voting); and one state
senator appointed by the Lieutenant Governor (ex-officio, non-voting). The
appointed members served two-year terms. The board held its last meeting in
1992.

Historical Sketch
The Texas Agriculture Resources Protection Authority was created
by Senate Bill 489, 71st Legislature, Regular Session, 1989. It is the
coordinating body for the policies and programs of pesticide management and
regulation conducted by the following Texas state agencies: Department of
Agriculture, Department of Health, Natural Resource Conservation Commission,
Agricultural Extension Service, Soil and Water Conservation Board, and
Structural Pest Control Board. The Authority may promulgate its own rules, and
also advises the above agencies concerning any pesticide-related rules that
they propose and adopt. In addition, the Authority collects, analyzes, and
disseminates information necessary for the effective operation of all existing
or proposed programs regulating pesticides; provides professional advice to
private agencies and citizens on pesticide-related matters; and advises the
governor and the legislature on these issues. The Department of Agriculture
provides for the administrative and enforcement functions of the Authority.
The required annual meetings of the Texas Agriculture Resources
Protection Authority (the Authority) are to be held on the first Monday of June
each year at 10 a.m. at a location designated by the commissioner for use of
the Authority unless a different date, hour, or place is specified by request.
Alternative annual meetings or special meetings may be called by the presiding
officer of the Authority or by a majority of the members of the Authority.
Quarterly reports of agency pesticide regulatory enforcement
activities must be submitted to the Authority no later than the 30th day
following the end of each fiscal year quarter by the Texas Department of
Agriculture, the State Soil and Water Conservation Board, the Texas
Agricultural Extension Service, the Texas Department of Health, the Texas
Natural Resource Conservation Commission, and the Texas Structural Pest Control
Board. The reports must be in a format and include information prescribed by
the Authority, which reviews and makes comments regarding the information
provided by the agencies. The agencies receive a copy of any comments made by
the Authority on its report and have an opportunity to respond to any comments.
In addition, the Authority makes its comments available to the public upon
request.
The Authority has enforcement authority over activities that (1)
relate to the use or handling of pesticides or pesticide products including the
application, loading, storage and disposal of or contamination by pesticides;
(2) are in an area over which the agency has the authority to manage, direct,
control or set limitations on by promulgation of regulations or otherwise; and
(3) are in an area over which the agency has the authority to set penalties for
failure to comply with laws or regulations relating to that activity or to
compel performance by use of other legal remedies.
Board members include the Texas Agriculture Commissioner, the
director of the Texas Agricultural Experiment Station, the dean of the College
of Agricultural Sciences of Texas Tech University, the dean of the University
of Texas School of Public Health at Houston, the director of the environmental
epidemiology program of the Texas Department of Health, the chief of the
groundwater conservation section of the Texas Natural Resource Conservation
Commission, the director of the Institute for International Agribusiness
Studies of Prairie View A&M University, the executive director of the Texas
Structural Pest Control Board, and the executive director of the State Soil and
Water Conservation Board. Governor appointees include a person representing
consumer interests; an agricultural producer; a commercial, noncommercial, or
private licensed pesticide applicator; a pesticide dealer or someone involved
in developing or manufacturing agricultural chemicals; a farm worker or a farm
worker representative; and a member of an organization primarily engaged in
environmental conservation or protection efforts. Board members do not receive
compensation for service except for expenses incurred while performing the
Board functions. Appointed members serve a two-year term. The governor appoints
the presiding officer. Board meetings are held annually and at the call of the
presiding officer or a majority of the members. The Authority has no staff,
offices, or legislative budget appropriation, instead it relies on the Texas
Department of Agriculture for support.

Historical Sketch
The Texas Board of Plant Breeder Examiners was created by House
Bill 114, 38th Legislature, 2nd Called Session, 1923; its stated purpose was
to safeguard the public in the purchase of pure bred
cotton seed. Its name was changed in 1929 to the Texas State Seed and
Plant Board, and its authority expanded beyond cotton seed, to all agricultural
and horticultural seeds and plants (House Bill 176, 41st Legislature, 1st
Called Session, 1929). The board approves and issues licenses for registered
and certified seed growers, promulgates rules and regulations governing the
producing of Foundation, Registered and Certified seeds, and prescribes the
qualifications and approves appointments of inspectors employed under the law.
The board also makes final decisions regarding sanctions and disputes
concerning seed certification and dispute arbitration.
The Board of Plant Breeder Examiners (and its successor the State
Seed and Plant Board) was composed of three persons experienced in the science
of plant breeding, appointed by the Commissioner of Agriculture and the
President of Texas A&M College. In 1943 membership of the State Seed and
Plant Board was modified to include three ex officio members: the chief of the
Division of Seed Certification of the Department of Agriculture, the head of
the Department of Genetics at Texas A&M College, and the head of the
Department of Plant Industry at Texas Tech College.
The current board reflects changes made in 1959 (increasing the
membership to five, appointed by the governor), with the addition of one member
in 1961. The State Seed and Plant Board is now composed of six members
appointed by the governor (with the advice and consent of the senate) for
two-year terms, including: the head of the Seed Division of the Department of
Agriculture; an individual from the Soils and Crop Sciences Department, Texas
Agricultural Experiment Station, Texas A&M University; an individual from
the Department of Plant and Soil Sciences, Texas Tech University; an individual
who is licensed as a Texas Foundation, Registered, or Certified seed or plant
producer (not employed by a public institution); an individual who sells Texas
Foundation, Registered, or Certified seeds or plants; and an individual who is
actively engaged in farming but not a producer or seller of Texas Foundation,
Registered, or Certified seeds or plants (added in 1961). The board elected the
chair annually until 1997; now the governor names the chair.

Historical Sketch
The Texas Produce Recovery Fund is a special trust fund
administered by the Texas Department of Agriculture, without appropriation, for
payment of claims against commission merchants and retailers. The Texas Produce
Recovery Fund Board was created by House Bill 1436, 67th Legislature, Regular
Session, in 1981 to advise the Department of Agriculture regarding the produce
recovery fund. Specifically, the Board is to advise the department on all
matters relating to the fund, including budget and revenues; advise on the
adoption of rules relating to the payment of claims and administration of the
fund; and conduct adjudicative hearings on disputed claims presented for
payment from the fund. If the department pays a claim submitted against a
merchant or retailer, the merchant or retailer must either reimburse the fund
or pay the claimant or suffer the loss of their license.
The Board is composed of six members appointed by the governor
with the advice and consent of the Senate. Two members are producers, two are
commission merchants and retailers, and two are members of the general public.
Each member must reside in a different senatorial district and serve a six year
staggered term. In order to hold a claim investigation hearing, the Board is
required to have a quorum.

The Texas Oyster Advisory Committee was created by House Bill
2719, 76th Legislature, Regular Session, 1999, for the purpose of providing
guidance and direction for the Texas Department of Agriculture's program to
promote and advertise the Texas oyster industry. The body was mandated to use
current market research to develop an oyster marketing plan to increase oyster
consumption, conduct a public relations campaign to create a responsible and
accurate image of the industry, and provide information, education, and
training to consumers on safe and proper handling of oysters.
The Committee is composed of nine members, one member appointed by
the Commissioner of Agriculture to represent consumer interests and eight
members appointed by the commissioner from a list of nominations submitted by
certified oyster dealers. The members are to serve staggered three year terms
without compensation and elect a chair from among their number.

Historical Sketch
The Texas Prescribed Burning Board was created by House Bill 1432,
76th Legislature, Regular Session, in 1999, for the purpose of establishing
minimum standards for prescribed burning in Texas. The standards must ensure
that the burning is the controlled application of fire to naturally occurring
or naturalized vegetative fuels under specified environmental conditions in
accordance with a written prescription plan designed to confine the fire to a
predetermined area and to accomplish planned land management objectives. The
standards should also require that at least one certified and insured
prescribed burn manager is on site during the conduct of the burn, establish
appropriate guidelines for the size of burning crews, and include standards for
notification to adjacent land owners, the Texas Natural Resource Conservation
Commission, and local fire authorities.
The Board was established within the Texas Department of
Agriculture and is composed of employees of the Texas Forest Service, the Texas
Parks and Wildlife Department, the Texas Natural Resources Conservation
Commission, the Texas Agricultural Extension Service, the Texas Agricultural
Experiment Station, the Texas Tech University Range and Wildlife Department,
the Department of Agriculture, the State Soil and Water Conservation Board, and
five individuals who are either owners of agricultural land, self-employed or
employed by someone other than a governmental agency, or appointed by the
commissioner of agriculture. Each member serves a two year term and the members
elect a presiding officer from among their number. The board was to establish
an advisory board composed of individuals representing property owners,
conservation interests, environmental interests, insurance interests, and
agriculture, forestry, and livestock producers.

Historical Sketch
In 1999 the Texas Legislature decided that the state needed a
Texas agricultural product promotion program to increase consumer awareness of
and expand the markets for Texas Agricultural products and determined that the
Texas Department of Agriculture, through the GO TEXAN Partner Program, program
grants and matching funds, was the proper department to accomplish this goal
(House Bill 2719, 76th Legislature, Regular Session). The GO TEXAN program was
established to encourage the development and expansion of markets through the
participation of eligible applicants who provide funds to be matched for
promotional marketing programs implemented by the Texas Department of
Agriculture. Specifically, the Program is to develop procedures for acceptance
and administration of funds received to administer the program; develop
application screening and selection procedures; develop a general promotional
campaign for Texas agricultural products and advertising campaigns for specific
Texas products based on successful project requests; develop advertising
programs and promotional materials for use by program participants; contract
with media representatives to disperse promotional materials; and receive
matching funds and establish internal reporting requirements. For the purposes
of the program, an eligible applicant must be a state or regional organization
that promotes the marketing and sale of Texas agricultural products and does
not stand to profit directly from specific sales of agricultural commodities; a
cooperative organization; a state agency or board that promotes the marketing
and sale of agricultural products; a national organization or board that
represents Texas producers and promotes the sale of Texas products; an eligible
small business; or any other appropriate entity. Program monies are maintained
in the general revenue fund in the GO TEXAN partner program account.
The Advisory Board is composed of at least eight members
appointed by the Commissioner of Agriculture to assist the department in the
implementation of the GO TEXAN Partner Program. The members include two
individuals from the Texas Department of Agriculture; one representative from
the United States Department of Agriculture; one representative each from
television, print, and radio advertising media; one representative from the
advertising profession; one consumer representative; and other members the
Commissioner determines to be necessary. Advisory Board members serve at the
pleasure of the Commissioner and without compensation. The Board reviews
applications of eligible participants and approve or denies funding, advises
the department on matters related to the administration of the account; and
advises the department on the adoption of rules relating to the administration
of the GO TEXAN Partner Program. The Commissioner provides the Board with staff
necessary to assist the Board in fulfilling its duties.
The distinction between GO TEXAN Partner Program Advisory
Committee and the GO TEXAN Partner Program Advisory Board is unclear and
possibly non-existent.

Records comprise minutes, agenda, drafts, memoranda,
correspondence, financial statements, contracts, complaint and request forms,
and lists of attendees of a variety of Texas Department of Agriculture
committees and related local non-profit organizations concerned with pest
management. The materials range in date from 1977 to 1989 and 1994 to 1998. The
records particularly reflect the efforts of the Department, the committees, and
the associations to eradicate such pests as aphids, fruit flies, and the boll
weevil. Some committees, especially those reflected in the set of minutes and
agenda, seem to have been organized for the purpose of pest eradication, many
with regional zones of jurisdiction. Earlier, the Department of Agriculture
seems to have worked largely with local crop related non-profit organizations
and associations to effect the local eradication of pests.

of meeting supporting documentation) remain in the
original chronological order since different committees had very similar names
and reorganization might have led to greater confusion. The researcher should
note that the state's fiscal year begins runs from September 1st through August
31st.

statements, hearing transcripts, bonds, oaths, election results, legal
documents, press releases, newspaper clippings and pamphlets, ranging in date
from 1968 to 1998, that document the creation, activities, and occasional
dissolution of the local Texas producer boards operating under the oversight of
the Texas Department of Agriculture. The records concern the boards' concerns
with administrative tasks such as obtaining certification, developing and
managing budgets, assessing fees, and holding local referendums, elections, and
meetings. Subjects addressed by the boards include pests and predators,
disease, marketing, education, crop and livestock production, drought, and
other topics of concern to each board's particular product. Major products
represented by the boards include cotton, pecans, wheat, citrus, grain sorghum,
corn, peanuts, mohair, rice, and sheep and goats.

Historical Sketch
Under Texas' Commodity Check-Off law
(House Bill 457, 60th Legislature as amended by House Bill 764, 61st
Legislature) non-profit agricultural organizations were able to petition the
Texas Department of Agriculture to be certified to conduct a referendum among
producers of agricultural products. The referendum would determine whether a
majority of those producers wished to establish a self-assessment programs to
raise funds to conduct programs of research, disease and insect control,
education, and promotion designed to encourage the profitable production,
marketing, and use of their respective products. Organizations that could prove
to have substantial influence with and support of producers were certified in
public hearings by the Department of Agriculture to hold the referendums among
producers of the product in question. The referendums determined whether or not
a producer board was desirable, and if so, who should sit on the resulting
boards. Boards were considered quasi-public/private bodies and their budgets
were to be approved by the Texas Department of Agriculture. Board members were
required to take oaths of office and were considered state employees.
Some boards represented the production of a certain product across
the entire state, others simply represented a single county if the production
of a certain crop in that county was substantial enough.
Arrangement
Records remain in the original order in which they arrived
(somewhat chronologically by board). The records of the specific boards and
committees have, however, been listed alphabetically by agricultural product,
preceded by a few general files, to aid in the retrieval of records of each
particular board. Dates reflect the actual contents of each file, not
necessarily the dates written on the file folder, which are frequently
inaccurate. Where possible, a basic description of the origins and composition
of each board has been provided.

conduct a referendum among corn producers to determine whether a majority of
voters wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and promotion
designed to encourage the profitable production, marketing, and use of corn.
Certification was originally granted on April 28, 1977 and a referendum was
held on July 29, 1977 but it does not seem to have passed. The Association was
again certified on December 21, 1979, a second referendum was held on February
27, 1980, and the Texas Corn Producers Board was created. The Board consists of
nine members, one third of which are elected biennially for six year terms.

In 1975, the Mohair Council of America of San Angelo, Texas

Certification was granted on October 29, 1975, the referendum was held and
passed on February 10, 1976, and the Texas Mohair Producers Board was created.
The Board was comprised of twelve members, one-third of whom were elected
biennially for six year terms. In 1976 the Board entered into a contractual
agreement with the Mohair Council of America based in San Angelo, Texas, to
have the Council implement a number of the purposes for which the Board was
created.

Texas Peanut Producers
Association
In 1969, the Southwestern Peanut Growers' Association of Gorman,
Texas (chartered as a non-profit corporation in 1937) became the first producer
organization to petition the Texas Department of Agriculture under Texas'
Commodity Check-Off law (House Bill 457, 60th
Legislature as amended by House Bill 764, 61st Legislature) to be certified to
conduct a referendum among peanut producers to determine whether a majority of
voters wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and promotion
designed to encourage the profitable production, marketing, and use of peanut
products. Certification was granted on July 16, 1969, the referendum was held
and passed in September 24, 1969, and the Texas Peanut Producers Board was
created. The Board was comprised of nine members, one-third of whom were
elected biennially for six year terms.

Texas Pecan Producers Board
During 1972, the Texas Pecan Growers Association of College
Station, Texas petitioned the Texas Department of Agriculture under Texas'
Commodity Check-Off law (House Bill 457, 60th
Legislature as amended by House Bill 764, 61st Legislature) to be certified to
conduct a referendum among pecan producers to determine whether a majority of
voters wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and promotion
designed to encourage the profitable production, marketing, and use of pecan
products. Certification was granted on June 15, 1972, the referendum was held
and passed in October 1972, and the Texas Pecan Producers Board was created.
The Board was comprised of twelve members, four of which were elected
biennially for six year terms. In July 1980 the members of the Pecan Board
decided to dissolve the board and transfer the remaining funds to the Texas
Pecan Growers Association, which would continue to support the goals of the
Board.

Check-Off law (House Bill 457, 60th Legislature as amended by House Bill
764, 61st Legislature) to be certified as the organization to conduct a
referendum among pork producers to determine whether a majority of voters
wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and sales
promotion relating to pork products. Certification was granted on February 20,
1974, the referendum was held and passed May 14, 1974, and the Texas Pork
Producers Board was created. The Board had fifteen officers, one-third of whom
were elected biennially to serve six year terms.

During 1972, the Texas Sheep and Goat Raisers Association of
San Angelo, Texas petitioned the Texas Department of Agriculture under Texas'
Commodity Check-Off law (House Bill 457, 60th
Legislature as amended by House Bill 764, 61st Legislature) to be certified to
conduct a referendum among sheep and goat raisers to determine whether a
majority of voters wished to establish a self-assessments program to raise
funds to conduct programs of research, disease and predator control, education,
and promotion designed to encourage the profitable production, marketing, and
use of sheep and goat products. Certification was granted on January 7, 1972
and the referendum was held but failed to passed in March 1972. A second
referendum, however, appears to have been successfully passed in November 1992,
and by early 1993 the nine member Texas Sheep and Goat Producers Board was
holding meetings and developing bylaws.

Texas Soybean Producers Board
The Texas Soybean Association, an affiliate of the American
Soybean Association, was chartered in Texas as a non-profit organization in
1967 for the purpose of functioning to assist programs supporting research,
education, and market promotion for soybeans. During 1969-1970, the
organization petitioned the Texas Department of Agriculture under Texas'
Commodity Check-Off law (House Bill 457, 60th
Legislature as amended by House Bill 764, 61st Legislature) to be certified as
the organization to conduct a referendum among soybean producers to determine
whether a majority of voters wished to establish a self-assessment program to
raise funds to conduct programs of research, disease and insect control,
education, and sales promotion relating to soybeans. Certification was granted
on July 20, 1970, the referendum was held and passed, and the Texas Soybean
Producers Board was created. The Board had nine officers, three of which were
elected biennially to serve 6 year terms. In 1984, due to financial
difficulties, the Board asked permission of the Texas Department of Agriculture
to reorganize the program by entering into a one-year, potentially renewable,
contractual agreement with the American Soybean Association. Independant
records of this Board do not seem to appear again in the Department of
Agriculture records until the 1992-1993 fiscal year.

Board
During 1995, the Texas Vegetable Association, established in
1977 to support vegetable research and educational programs and to represent
the interests and needs of vegetable producers, petitioned the Texas Department
of Agriculture under Texas' Commodity Check-Off
law (House Bill 457, 60th Legislature as amended by House Bill 764, 61st
Legislature) to be certified as the organization to conduct a referendum among
spinach producers in the Winter Garden area to determine whether a majority of
voters wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and sales
promotion relating to spinach. Certification was granted during the summer of
1995, the referendum was held and passed, and the Texas Wintergarden Spinach
Producers Board held its organizational meeting in October of that year. The
Board had six officers, one-third of whom were elected biennially to serve six
year terms.

During 1970, the Texas Turkey Federation of Bryan, Texas
petitioned the Texas Department of Agriculture under Texas'
Commodity Check-Off law (House Bill 457, 60th
Legislature as amended by House Bill 764, 61st Legislature) to be certified to
conduct a referendum among turkey producers to determine whether a majority of
voters wished to establish a self-assessment program to raise funds to conduct
programs of research, disease and insect control, education, and promotion
designed to encourage the profitable production, marketing, and use of turkey
products. Certification was granted, the referendum was held and passed on July
28, 1970, and the Texas Turkey Producers Board was created. The Board was
originally composed of fifteen board members (gradually decreasing), one third
of which were to be elected biennially for terms of 6 years. In 1983 the Texas
turkey producers voted to discontinue operation of the Texas Turkey Producers
Board, its operations were privatized and returned to the Texas Turkey
Federation. The Texas Poultry Federation and the Texas Turkey Federation (and
Texas Turkey Producers Board) were closely affiliated organizations, in some
cases the letterhead of both organizations seems to have been used
interchangeably.

The records comprise reports, correspondence, memoranda, Attorney
General opinions, and worksheets compiled by the Texas Department of
Agriculture to document both daily and/or weekly market reports on a variety of
Texas commodities from 1951 to 1990 and biennial budget requests, working
papers, and cost savings/revenue enhancement plan records from 1969 and 1985 to
1988. The market reports document the daily demand in Texas for each commodity,
the weight, sex, size, grade, and quality of the commodity the processors were
selecting, the price being paid, any relevant USDA (U.S. Department of
Agriculture) announcements or releases, and, occasionally, export/shipping
statistics and weather reports. For comparison, the reports also include the
status of that commodity in other regional markets as the information was made
available by leased wire services. Produce covered by the reports includes
turkeys, eggs, chickens, rice, fruits and vegetables, grains, watermelon, grain
sorghum, and pecans.
Arrangement
These records remain in the order in which they arrived. The
budget reports, listed first, are roughly in order by fiscal year and remain in
the order received. The market reports have been intellectually arranged
roughly by type of commodity. Note that in some cases the titles of reports are
very similar, if not identical, but the compiled reports do contain different
market reports.
