The Texas House of Representatives' Committee on Business and Industry
began in 1993 with the 73rd Legislature. An earlier incarnation of this
committee may have been the House Committee on Business and Commerce. Business
and Industry is a standing House Committee with nine members. It has
jurisdiction over all matters pertaining to: industry and manufacturing;
industrial safety and adequate and safe working conditions, and the regulation
and control of those conditions; hours, wages, collective bargaining, and the
relationship between employers and employees; the regulation of business
transactions and transactions involving property interests; the organization,
incorporation, management, and regulation of private corporations and
professional associations and the Uniform Commercial Code and the Limited
Partnership Act; the protection of consumers, governmental regulations incident
thereto, the agencies of government authorized to regulate such activities, and
the role of the government in consumer protection; and oversight of the
following state agencies: the Texas Workers' Compensation Commission, the Texas
Workers' Compensation Research Center, the State Office of Risk Management, and
the Risk Management Board.
During the interim session of the 73rd Legislature, the committee was
assigned three charges by the Speaker of the House: to study the various
insurance pools that provide workers' compensation coverage for public entities
(cities, school districts, water districts, etc.) and determine whether or not
regulation is needed; to study the method by which the state provides workers'
compensation to its employees; and to conduct active oversight of the agencies
under the committee's jurisdiction. To meet these charges, the committee
divided into three sub-committees, namely the Subcommittee on Public Insurance
Pools, the Subcommittee on State Employees' Workers' Compensation, and the
Subcommittee on Legislative Reporting Requirements.
During the 75th Interim Session (1997-1998), Speaker James E. "Pete"
Laney assigned the committee five tasks: 1) to study the development of
commerce on the Internet to determine whether existing consumer protection laws
are adequate to deal with the present and future issues that may arise; 2) to
review consumer protection issues as they pertain to telemarketing and
determine whether the registration of telemarketers may be necessary to provide
adequate protection of the public; 3) to study the issues surrounding
"truth-in-hiring" legislation and investigate the possibility of protecting
both employees and employers when prospective employers request job references;
4) to review the Texas Free Enterprise and Antitrust Act of 1983 and assess its
adequacy in protecting the public interest when mergers and acquisitions occur;
5) and to review workers' compensation insurance carriers' payments and denials
of medical benefits and supplemental income benefits and determine whether
carriers' actions are reasonable and consistent with the overall design. On
this occasion the committee divided itself into five subcommittees, namely the
Subcommittee on Internet Consumer Protection, the Subcommittee on
Telemarketing, the Subcommittee on Truth-in-Hiring Legislation, the
Subcommittee on Mergers and Acquisitions, and the Subcommittee on Workers'
Compensation Insurance Carrier Practices.

reviewed to delineate series, to confirm the accuracy of contents lists, to
provide an estimate of dates covered, and to determine record types.

chronological order by legislative session. Each subcommittee has a separate
group of files within the appropriate interim session, some of the groups are

Restrictions on Access
Because of the possibility that portions of these records fall under
the Public Information Act exceptions including violations of the privacy of
individuals, these records must be reviewed by an archivist before they can be
accessed for research. The records may be requested for research under the
provisions of the Public Information Act (Texas Government Code, Chapter 552).
The researcher may request an interview with an archivist or submit a request
by mail, fax, or email including enough description and detail about the
information requested to enable the archivist to accurately identify and locate
the information requested. If our review reveals records covered by exceptions
to the Public Information Act, we are obligated to seek an Open Records Opinion
from the Attorney General before the files can be provided to the researcher.
The Public Information Act allows the Archives ten business days after
receiving the written request to make this determination.
Restrictions on Use
Where necessary, records will be redacted or restricted to comply
with the Public Information Act and the Attorney General's decision.
