Agency History

In Milam County, the office of the county school superintendent was first established in 1873. In the first years, the president of the school board or school directors served as the ex-officio superintendent. The role was transferred to the county judge in 1876. In 1887, the Texas legislature gave county commissioner courts the authority to create a full-time office. The superintendent of schools oversaw the administration of the county school districts, the board of county school trustees, and the management of school funds. Most county offices of the superintendent closed with the ending of state financial support in 1978.

The first census of Texas school age children was mandated by an act passed by the 5th Texas Legislature, Regular Session, on January 31, 1854. From 1854 to 1905, annual censuses of school children were conducted in each county by the office of county tax assessor. The responsibility for taking annual scholastic censuses was transferred to the office of county superintendent of schools beginning in 1905 (29th Legislature, Regular Session, Senate Bill 218). From 1905 to 1969, the county superintendent's office compiled and sent a consolidated census roll to the Texas State Board of Education and filed a copy with the county clerk. The original, individual enumerated census forms were retained by the county superintendent of schools. After 1969, copies of the rolls were no longer required to be filed with the county clerk (61st Legislature, Regular Session, House Bill 534). In 1989, custody of all scholastic census records in the hands of elected county officials was transferred to the Texas State Library and Archives Commission by the Local Government Records Act (Texas Local Government Code, Section 201.008). The Act did not automatically physically transfer any scholastic census records to the Library and Archives Commission, but school districts could offer census records to the commission for historic preservation.

Scope and Contents of the Records

The Milam County Office of the Superintendent of Schools records primarily concern the annual scholastic census mandated by the Texas legislature for the appropriations of funds to each school district. The records include enumerated census forms, summaries of the number of school age children by district, "consolidated rolls of scholastics" or lists of school age children, financial ledgers of school district accounts, birth registries, and correspondence ranging from 1888 to 1978, bulk 1909 to 1970. Milam County scholastic census forms, 1899-1969, include the census forms or blanks used to survey students, which contain demographic information including name, address, birth date, age, sex, physical handicaps, and the names of parent or guardian for each student. Milam County scholastic census records, 1916-1970, include consolidated rolls of the names of students, summaries of the total number of students in each school district in Milam County and lists of handicapped children based on the census forms. Some years contain a small amount of correspondence from the Superintendent. Milam County Superintendent of Schools financial records, 1888-1977, contain ledgers of the school district accounts documenting deposits and withdrawals, primarily from 1888 to 1930. Birth registers for common schools, 1954-1976, undated, contain two volumes of lists of students and birth dates.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

These records are organized into four series:

Materials do not circulate, but may be used in the State Archives search room. Materials will be retrieved from and returned to storage areas by staff members.

Scholastic census records dated 75 years ago and earlier are unrestricted and may be accessed by the public (Texas Government Code, Section 552.0215, right of access to certain information after 75 years).

Scholastic census records dated less than 75 years ago are restricted and must be redacted for gender, race, and disability information for the student and any student family members (siblings) listed in the record, unless proof of death of any of those individuals is provided. (Texas Government Code, 552.101 and Family Educational Rights and Privacy Act (FERPA))

To obtain a copy of their own scholastic census record dated less than 75 years ago, on-site patrons must show photo identification (driver's license, state personal ID, U.S. passport, or U.S. military ID). Remote requestors must make their request in writing (to archinfo@tsl.texas.gov or to Texas State Library and Archives Commission, P.O. Box 12927, Austin, TX 78711). Requests by phone are not accepted. The record provided will be redacted for gender, race, and disability for everyone except the former student (in other words, for all the siblings), unless proof of death is provided for any of those siblings.

Social Security Administration requests for scholastic census information that are made in writing on SSA letterhead (mailed or faxed) do not require archivist review and the requested information will be provided regardless of record date. SSA requests made by email will require archivist review for information excepted from disclosure, unless the request can be resubmitted on SSA letterhead through mail or email. Phone requests are not accepted.

Detailed Description of the Records

Milam County scholastic census forms,1899-1969,
27.24 cubic ft.

The scholastic census was taken in each school district in Milam County to tabulate and report to the Texas State Board of Education the total number of school age children to determine the amount of funds each district would receive for the school year. The Office of the Superintendent of Schools was responsible for administering the census from 1905 to 1969. Milam County scholastic census forms, 1899-1969, include demographic information on each student. Students were enumerated for a given year if he/she was between the ages of 6 and 17 beginning on September 1st of that year. The forms were collected in the spring of the year listed, in preparation for the school year beginning in fall of that same year. The forms contain each student's name, birth date, gender, race, nationality indicated by language spoken at home, handicaps, address, name of guardian or parent, and signature of person rendering the child. Later years of the forms also include the length of time the parents have resided in Milam County. The information from these forms was used to tabulate the yearly summaries and consolidated scholastic rolls. There are no forms for 1903 and 1931. The "Scholastic census annual tabulations" are handwritten tallies of students by letter of the alphabet of the surname and by race for some years between 1934 and 1970. The tabulations were found while rehousing the census forms, and the date the tabulations were created is unclear.
Arrangement
These records are in the original order as maintained by the agency and are arranged chronologically by year. In some years, one form was used per student, and in other years, one form was used per household. For each year, the forms are filed alphabetically by the first letter of the surname, though not necessarily in alphabetical order within each letter. Surnames beginning with Mc are filed after all other M surnames. From 1927 to 1965, the forms are subdivided by race within each letter, between "white" and "colored" or "negro." The "colored" or "negro" forms are filed before the "white" for each letter. In a few instances, forms were misfiled by race, so both sections should be checked.

Milam County scholastic census records, 1916-1970,

The scholastic census was taken in each school district in Milam County to tabulate and report to the Texas State Board of Education the total number of school age children to determine the amount of funds each district would receive for the school year. The Office of the Superintendent of Schools was responsible for administering the census from 1905 to 1969. The records include a "consolidated list of scholastics" for every school district in Milam County for each year based off of the collected census forms. The consolidated lists specify the student's name, name of guardian, birth date, race, and handicaps. Each year has a summary of students, tabulating the total number of students in the common and independent school districts. Additional records include lists of transfer students and summaries of handicapped or exceptional children in a district. There is a small amount of correspondence to and from the Superintendent of Schools relating to the tabulation of the census. The records are dated 1916 to 1970.
Arrangement
These records are arranged chronologically by school year. The "summary of scholastics" and the "consolidated roll of scholastics" are tabulated separately for the common and independent districts. All common school districts are tabulated together into one summary. The consolidated roll of scholastics is listed alphabetically by surname until the 1954-1955 school year, where it is then broken down into county school district numbers first, then alphabetically. Each independent school district has its own summary and consolidated census roll. Early records of the independent school districts are sometimes only labeled with their county district number according to the following assignments: Cameron #901, Gause #902, Milano #903, Rockdale #904 and Thorndale #905. For both the common and independent districts, the records tabulate "white" and "colored" scholastics separately.
For the 1940s and 1950s, the consolidated census roll of the preceding year was used to tabulate the scholastic summary, edited with blue lines indicating if a student had transferred school districts for that year. For this reason, the records for the subsequent year should be checked for the consolidated census roll of the previous school year.
The records were removed from their original bindings and rehoused for preservation concerns. In most cases, the records for each school year were bound individually, and this order was maintained. For the school years in the late 1940s and early 1950s, the records were scattered among several different bound copies. The records were removed from their bindings and assembled as best as possible back to their original years. Copies of the original cover label precede the records in each folder to document from which volume the records originated. In some cases, the date range on the cover does not accurately reflect the dates of the records.

Financial records of the Milam County Superintendent of Schools date 1888-1978, undated, bulk 1888-1930 and are mostly ledgers tracking the financial accounts for each of the county's school districts, listed by number, and name. The ledgers record the date of transaction, the name of payee, the name of the fund credited or debited, the reason for the transaction, and the total amount. Examples of payments recorded include teacher salaries, school supplies, and maintenance costs. The ledgers show account deposits, including the total funds received each year calculated from the scholastic census. The district's total enrollment is also listed per year, broken down by race. The accounts for each county are sometimes broken down into funds for "white" and "colored" scholastics as well. Some volumes also include lists of names of handicapped students, transfer students between districts, and teachers.

Scholastic census records dated 75 years ago and earlier are unrestricted and may be accessed by the public (Texas Government Code, Section 552.0215, right of access to certain information after 75 years).
Scholastic census records dated less than 75 years ago are restricted and must be redacted for gender, race, and disability information for the student and any student family members (siblings) listed in the record, unless proof of death of any of those individuals is provided. (Texas Government Code, 552.101 and Family Educational Rights and Privacy Act (FERPA))
To obtain a copy of their own scholastic census record dated less than 75 years ago, on-site patrons must show photo identification (driver's license, state personal ID, U.S. passport, or U.S. military ID). Remote requestors must make their request in writing (to archinfo@tsl.texas.gov or to Texas State Library and Archives Commission, P.O. Box 12927, Austin, TX 78711). Requests by phone are not accepted. The record provided will be redacted for gender, race, and disability for everyone except the former student (in other words, for all the siblings), unless proof of death is provided for any of those siblings.
Social Security Administration requests for scholastic census information that are made in writing on SSA letterhead (mailed or faxed) do not require archivist review and the requested information will be provided regardless of record date. SSA requests made by email will require archivist review for information excepted from disclosure, unless the request can be resubmitted on SSA letterhead through mail or email. Phone requests are not accepted.

Two volumes documenting Milam County student birth information contain lists of names of children, dates, parents' names, and race and date 1954-1976 and undated. The first undated volume in Box 1993/005LR-30 appears to be a birth register, with multiple years associated with each name, but it is not clear which date is the birth date; the dates range from the late 1800s to the mid-1900s and the date the registry was initially begun is unknown. Volume 1993/005LR-54 was started in September 1, 1954 to comply with a county board ruling requiring all six-year-old children to present a birth certificate to enroll in a public school in Milam County. This register contains notes on where the original birth certificate is filed.
