Agency History

The Teacher Retirement System of Texas (TRS) was established in 1937 (Senate Bill 47, 45th Texas Legislature, Regular Session) after voters in 1936 approved a constitutional amendment authorizing the legislature to provide a retirement program for persons employed in Texas public education in professional and business administration, supervision, and instruction. Though the legislature established the system in 1937, it did not fully fund it until 1941, when a constitutional amendment was passed that allowed regular contributions from teachers to be matched with contributions from the state. In 1949 the system extended eligibility to auxiliary school employees and in 1977 the distinctions between teachers and staff were eliminated. Originally membership was voluntary, but it later became compulsory; membership now covers all employees of the public school system.

TRS is a pension trust fund funded by state and member contributions and investment earnings. It provides retirement, disability, and death and survivor benefits for its members. The TRS Board of Trustees is responsible for the general administration and operation of the retirement system. The board appoints an executive director (who is responsible for administering the system), a medical board, and a retiree insurance advisory committee. The state auditor annually audits the records of the system. The board employs actuaries, investment consultants and advisers, and other professionals necessary to govern the system prudently. The board is composed of nine members (originally six members) appointed by the governor with consent of the senate.

TRS administers the Texas Public School Employees Group Insurance Program, created by the legislature in 1985, which provides a basic level of catastrophic health and insurance coverage for public school TRS retirees who are not eligible to participate under the state employee or higher education plans. In September 1996 coverage was extended to members who are employees of public school districts that join the program. This program is funded by contributions from active members, contributions from the state, premium payments by participants, and investment income from a dedicated trust.

Scope and Contents of the Records

These records consist of minutes, agenda and meeting files created by the TRS Board of Trustees, the Advisory Committee on Retirement Benefits, the Investment Advisory Committee, the Audit Committee, and the Legal Services Department, dating 1937-1966, 1969-2011.

Minutes and agenda of the TRS Board of Trustees, the Advisory Committee on Retirement Benefits, the Investment Advisory Committee and the Audit Committee date 1937-1966, 1969-2011. TRS Board of Trustees minutes and agenda discuss approval of minutes; review of investments and insurance issues; discussion, recommendations and reports from various committees; pending legislation; budgetary items; the Internal Audit Plan; and position nominations. The Advisory Committee on Retirement Benefits records include proceedings from a November 10, 1975 open hearing meeting. Investment Advisory Committee material can be found quarterly with select Board of Trustees minutes and includes reports on the investment performance of the TRS trust. Audit Committee materials include summaries of actions taken to address concerns in the audit plan or annual report, audit reports completed during each quarter, quarterly status reports of management action on outstanding audit recommendations, and the status of the current fiscal year audit plan. Individual audit reports provide results, recommendations, and management actions taken to address audit recommendations.

Meeting files consist of meeting files, supporting documentation and email correspondence from the TRS Board of Trustees and the Legal Services Department, dating 1990-1993, 2005-2008. TRS Board of Trustees meeting files include documents sent in advance of meetings for briefing purposes, along with exhibit items, documentation for agenda items, workshop materials and meeting notes. Legal Services Department records include summary of litigation files and printed emails, some with attached drafts of preambles, rules and regulations.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

The records have been arranged into two series. Within each series, records are arranged chronologically with some overlap:

Restrictions on Access

The Public Information Act allows the Archives ten working days after receiving a request to make this determination. The Attorney General has 45 working days to render a decision. Alternately, the Archives can inform you of the nature of the potentially excepted information and if you agree, that information can be redacted or removed and you can access the remainder of the records.

This series consists of minutes and agenda from the TRS Board of Trustees, dating 1937-1966, 1969-2003; the Advisory Committee on Retirement Benefits, dating 1975; the Investment Advisory Committee, dating 1987, 1990-1993; and the Audit Committee, dating 1990-1992, 1995-2011. TRS Board of Trustees minutes and agenda discuss approval of minutes, review of investments and insurance issues, discussion, recommendations and reports from various committees, pending legislation, budgetary items, the Internal Audit Plan, and position nominations.
