The passage of the Twenty-first Amendment to the United States
Constitution in 1933 repealed prohibition and the Eighteenth Amendment and made
it necessary for states to enact laws to regulate alcoholic beverages. The
Texas Liquor Control Act (House Bill 77, 44th Texas Legislature, Second Called
Session) created the Texas Liquor Control Board in 1935. The Board assumed its
present name of the Texas Alcoholic Beverage Commission effective January 1,
1970 (House Bill 379, 61st Legislature, Regular Session, 1969). The Liquor
Control Act was codified into the Texas Alcoholic Beverage Code by House Bill
815, 65th Legislature, Regular Session, in 1977. The commission is charged with
the administration and enforcement of the Code which establishes guidelines for
the activities of all persons engaged in any phase of the alcoholic beverage
business. The commission inspects, supervises, and regulates the business of
manufacturing, importing, exporting, transporting, storing, selling,
advertising, labeling, and distributing alcoholic beverages. As of 2001, a
statutory fee is assessed for 61 different types of licenses and permits. Fees
associated with the sale of wine and distilled spirits are paid directly to the
commission, while fees assessed to beer retailers, distributors or
manufacturers located in the state are paid to the county tax assessor of the
county in which the applicant's business is located. The county is allowed a
five percent commission on total fees and the balance is remitted to the
commission and deposited in the state's General Revenue Fund.
The policy-making body of the agency is a three-member commission,
appointed by the governor with concurrence of the senate for overlapping
six-year terms. The agency head administrator is appointed by the commission.
As of 2001, the agency consists of a headquarters office in Austin, 17 district
offices, numerous local offices, and 26 tax collection stations at ports of
entry along the Texas-Mexico border.
Administration of the Texas Bingo Act was transferred from the
Comptroller of Public Accounts
to the Alcoholic Beverage Commission effective January 1, 1990. Under
this act, the commission was charged with licensing and supervising those who
are authorized to conduct bingo games or who manufacture or sell bingo
equipment. This responsibility was transferred to the Texas Lottery Commission
in April 1994.

The minutes of the Liquor Control Board date 1964-1969. For the Texas
Alcoholic Beverage Commission, minutes date 1970-1987 and 2004-2009,
transcripts date 1988-2003, and agenda date 2004-2009.
The general files and staff correspondence from the executive division
of the Texas Alcoholic Beverage Commission include minutes from Commission
meetings, correspondence, memos, and staff reports. Subject matter in the
records include the issuance of alcoholic permits and licenses, interpretations
of the Texas Alcoholic Beverage Code, analysis of proposed legislation,
assignments of Commission personnel, and commemoration of the Commission's 50th
anniversary in November 1985.
The press releases span 1975-1996, although not all years are
represented.
To prepare this inventory, the described materials were cursorily
reviewed to delineate series, to confirm the accuracy of contents lists, to
provide an estimate of dates covered, and to determine record types.

The Texas Alcoholic Beverage Commission inspects, supervises, and
regulates the business of manufacturing, importing, exporting, transporting,
storing, selling, advertising, labeling, and distributing alcoholic beverages
in Texas. These records include correspondence, memos, Commissioner's minutes,
staff reports, Attorney General opinions, speeches, audit reports, invitations,
newspaper clippings, and travel vouchers. Materials date from 1985 to 1987. The
correspondence and other records are between the Texas Alcoholic Beverage
Commission's Executive Division and each division within the agency, with other
state agencies, with members of alcohol-related businesses, and with the
public. Subjects include issuance of licenses and permits, responses to
inquiries asking for rulings on the Texas Alcoholic Beverage Code (TABC),
commendations from the public on service by Commission employees, complaints
about alleged violations of the TABC, changing alcohol agents' assignments,
requests for Attorney General opinions, and comments on federal laws. Internal
records include summaries of agency activities, audit/property reports, staff
travel requests, and merit raises. There are also records commemorating the
Commission's 50th anniversary in November 1985. |

The Texas Alcoholic Beverage Commission inspects, supervises, and
regulates the business of manufacturing, importing, exporting, transporting,
storing, selling, advertising, labeling, and distributing alcoholic beverages
in Texas. These records consist of correspondence, dating from 1977 to 1985, of
three individuals on the Texas Alcoholic Beverage Commission's Executive
Division staff: Michael W. McKinney, Chief of Staff Services from January 1977
to August 1979, and Executive Assistant to the Administrator from September
1979 through December 1983; Randy Yarbrough, Personnel and Budget Director,
1977-1985; and Joe Darnall, Executive Assistant to the Administrator in
1984-1985. Subjects covered in the correspondence of Darnall and of McKinney as
Executive Assistant to the Administrator include responses to reported alcohol
violations, interpretations of the Alcoholic Beverage Code, speech topics, and
analyses of proposed legislation. Correspondents include lawyers, legislators,
members of alcohol-related industries, and the general public. The
correspondence of Yarbrough and of McKinney when he was Chief of Staff Services
covers such internal matters as staff training, agency budgets, hiring
practices, management by objectives, salaries, and position classifications.
