Abstract: |
Texas law
authorizes the Governor of Texas to requisition the return of fugitives from
Texas justice who have fled to other states and territories, and also requires
that the Governor of Texas cooperate in the apprehension of fugitives of
justice from other states who have fled to Texas. Rewards are offered by the
governor of Texas to aid in the apprehension of accused criminals who are
evading arrest. Each constitution of the State of Texas has required the Texas
Secretary of State to keep a fair register of all official acts and proceedings
of the Texas Governor and to provide these to the legislature when required.
The Secretary of State maintained both the extradition records and the reward
records for the governor, to document the following things: requisitions of
fugitives of justice on other states, warrants issued on requisitions from
governors of other states, extraditions, and rewards offered for the capture of
fugitives from justice. These records include registers and indexes of
requisitions, extraditions, and rewards; extradition case files; applications
requesting that a reward be issued; reward proclamations issued by the
governor; and also executive record books containing records about fugitives
from justice. Dates covered are 1837-1965 (the bulk covering 1875-1915).

The Texas Constitution of 1845 required the Secretary of
State to "keep a fair register of all official acts
and proceedings of the Governor" and to provide these to the legislature
when required. This duty (and others) were reiterated in the act
"to define the duties of Secretary of State,"
approved May 9, 1846. This authority was reconfirmed by the Constitutions of
1866 (Article V, Section 17), 1869 (Article IV, Section 17) and 1876 (Article
IV, Section 21), and subsequent amendments.
The Secretary of State is a
constitutional officer of the executive branch of state government, appointed
by the governor and confirmed by the senate for a term concurrent with the
governor's (a two-year term at first, a four-year term since 1974). The office
was first created by the Constitution of the Republic of Texas in 1836 (Article
VI, Section 10), and has been continued by each succeeding Constitution.
Extradition of fugitives from justice between Texas and other states was
covered in Article 878 of the Texas Code of Criminal Procedure, adopted by the
6th Texas Legislature, Adjourned Session (August 1856):
"A person charged in any State or Territory of the
United States with treason, felony, or other crime, who shall flee from justice
and be found in this State, shall, on demand of the Executive Authority of the
State or Territory from which he fled, be delivered up to be removed to the
State or Territory having jurisdiction of the crime."
Current
Texas law provides the following provisions for fugitives from justice from
other states: "51.01. A person in any other State of
the United States charged with treason or any felony who shall flee from
justice and be found in this State, shall on demand of the executive authority
of the State from which he fled, be delivered up, to be removed to the State
having jurisdiction of the crime. 51.02. All peace officers of the State shall
give aid in the arrest and detention of a fugitive from any other State that he
may be held subject to a requisition by the Governor of the State from which he
fled."
Current Texas law also provides the following for Texas
fugitives fleeing to other states: "51.09. When the
Governor deems it proper to demand a person who has committed an offense in
this State and has fled to another State, he may commission any suitable person
to take such requisition. The accused, if brought back to the State, shall be
delivered up to the sheriff of the county in which it is alleged he has
committed the offense."
Also, Art. 51.13. Uniform Criminal
Extradition Act: "Sec. 2. Subject to the provisions
of this Article, the provisions of the Constitution of the United States
controlling, and any and all Acts of Congress enacted in pursuance thereof, it
is the duty of the Governor of this State to have arrested and delivered up to
the Executive Authority of any other State of the United States any person
charged in that State with treason, felony, or other crime, who has fled from
justice and is found in this State." The authority was recodified in 1965
by Senate Bill 107, 59th Legislature, Regular Session. (V.T.C.A., Code of
Criminal Procedure, Articles 51.01-51.09
)
Rewards are offered by the governor of Texas to aid in the
apprehension of accused criminals who are evading arrest. Authority for the
governor to issue rewards was first granted by an act of the 1st Legislature,
passed April 18, 1846. The authority was codified in 1965 by Senate Bill 107,
59th Legislature, Regular Session. (V.T.C.A., Code of
Criminal Procedure, Article 51.11

Texas law authorizes the

have fled to other states and territories, and also requires that the Governor
of Texas cooperate in the apprehension of fugitives of justice from other
states who have fled to Texas. Rewards are offered by the governor of Texas to
aid in the apprehension of accused criminals who are evading arrest. Each

There are nine volumes that constitute registers and indexes created by the
staff of the Secretary of State's office, recording four types of action by the
Governor: requisitions on other states, warrants issued on requisitions from
governors of other states, extraditions, and rewards offered for the capture of
fugitives from justice, dating 1883-1965.
Extradition case files,
dating 1837-1901, bulk 1875-1900, typically contain a requisition form, which
is a formal demand by a state and its governor for apprehension and return of a
fugitive from that state. The requisition gives the name of the fugitive, the
alleged crime, the court and county where the charges were filed, the location
where the fugitive was presently thought to be, the agent appointed to bring
the fugitive back, and the date of the requisition. Case files may also contain
supporting documents such as correspondence or a copy of the grand jury
indictment. These case files contain requisitions both to the governor of Texas
from other states for fugitives hiding in Texas, and from Texas governors to
other states for the extradition of fugitives from Texas justice.
Reward application files, which date 1856-1936 (the bulk covering
1875-1915), usually consist of correspondence that gives details of the crime,
in order to convince the governor to issue a reward. The correspondence came
from sheriffs, judges, district attorneys, juries, relatives of the victim, and
members of the community. An application might also contain a copy of an
indictment by a jury or other legal documents. For each application, a form was
filled out by the Secretary of State and the accompanying correspondence placed
inside. This form included such vital information as name of the applicant,
date of the request, name of the fugitive, the criminal offense, where and when
the alleged crime occurred, the amount of reward, and the date of the reward
offer. Reward proclamations are occasionally found in these files.
Reward proclamations issued by the governor date 1849-1942. The original
proclamations were issued on printed forms with the following information:
amount of reward, name of fugitive, criminal charge, county, date, and
signature of governor. The earliest reward proclamations are mixed in with
other gubernatorial records in a series of executive record books kept by the
Secretary of State, dating 1849-1887. Copies of later reward proclamations are
in four volumes dedicated to that purpose (and often also called Executive
record books), 1883-1938. The volumes have alphabetical indexes in the front.
In addition, there are unbound proclamations dating 1937-1942 (#950-985).
Executive record books containing records about fugitives from justice
include a wide variety of other documentation, including correspondence (mostly
outgoing) of the Governors of the State of Texas, primarily with other Texas
and U.S. officials; inaugural and valedictory addresses; executive messages;
proclamations; appointments; passports; pardons and remissions;
extraditions; rewards; reports of state agencies;
etc. These records comprise those executive record books maintained by the
Texas Secretary of State dating 1849-1887.
To prepare this inventory,
the described materials were cursorily reviewed to delineate series, to confirm
the accuracy of contents lists, to provide an estimate of dates covered, and to
determine record types.

Restrictions on
Access
The volumes containing reward proclamations are restricted due
to their fragile physical condition, so researchers must use the microfilmed
copies.
Materials do not circulate, but may be used in the State
Archives search room. Materials will be retrieved from and returned to storage
areas by staff members.
Restrictions on Use
Most records created by Texas state agencies are not copyrighted and may be
freely used in any way. State records also include materials received by, not
created by, state agencies. Copyright remains with the creator. The researcher
is responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).

include statistics: the total numbers of reward proclamations, sometimes broken
down by type of crime (e.g. murder/other crimes in 1870, or eight categories of
crimes in 1896), as well as of extraditions, requisitions made on governors of
other states, and warrants issued on requisitions from governors of other
states. In addition, three reports (1878, 1881, and 1882) actually list the
details on each reward: the name of the fugitive, the county, the charge, the
condition of payment (e.g., "on delivery to sheriff

roughly alphabetically by the first letter of the last name of each fugitive,
and then numerically/chronologically. The indexes are each divided into two
sections (usually labeled on the spine and/or tabs as
"requisitions," and "warrants.") The registers are divided into one or
two or three sections, all but the earliest volume with clear headings for each
of three types of actions (requisitions on other states, extraditions granted,
and rewards offered). |

Each register of requisitions on other states
(1883-1940) contains some or all of the following information: date, number,
who for (i.e., the name of the fugitive), offense, county, who by (i.e., the
name and/or title of the official making the request, e.g. sheriff, county
attorney), state, agent, and conditions. |
|
Each register of extraditions
granted (1889-1940) contains the following information: date, number, name of
executive applying, state, name of fugitive, crime, agent, and remarks. |
|
Each register of rewards offered (1889-1921), contains the following
information: date, number, party wanted, offense and date, county, on whose
application, and conditions. |
|
The earliest register (1883-1889), which
contains an index, and each of the three indexes (1890-1965) are divided into
two sections apiece, the labels for which are confusing and somewhat
inconsistent. The first section of each of the three earliest volumes
(1883-1939) seems to be labeled "requisitions,"
and contains the following information: date, on whose requisition issued
(i.e., usually the Governor of which state), name of the fugitive, name of the
agent, crime, and where to be conveyed (or later, remarks). The same
information is provided in the second section of the last volume (1939-1965),
which seems to be labeled "extraditions." |

The second section of each of the three earliest volumes (1883-1939) seems
to be labeled "warrants,"and contains the
following information: date, reward (amount of money), on Governor of which
state, name of fugitive, name of the agent, crime, to be delivered at, and
remarks. The same information is provided in the first section of the last
volume (1939-1965), which seems to be labeled "requisitions." |

Arrangement |

These registers
and indexes are listed in two groups in the container inventory. Internal
arrangement by the staff of the Secretary of State depends on the type of
volume. A register is arranged numerically, which is also chronologically; in
other words, it is a log registering each type of action (requisitions on other
states, warrants issued on requisitions from governors of other states,
extraditions, and rewards offered) by the governor as it occurs. An index is
arranged roughly alphabetically by the first letter of the last name of each
fugitive, and then numerically/chronologically. Each volume, whether register
or index, is divided into one or two or three sections, for each of the types

Rewards are offered by the
governor of Texas to aid in the apprehension of accused criminals who are
evading arrest. Each constitution of the State of Texas has required the Texas
Secretary of State to keep a fair register of all official acts and proceedings
of the Texas Governor and to provide these to the legislature when required.
These records were created to document applications for rewards for the
apprehension of fugitives from justice. |

These records include
application forms, correspondence, legal documents, and occasional
proclamations, dating 1856-1936, bulk 1875-1915. They comprise the reward
application files formerly maintained by the Texas Secretary of State. The
application files usually consist of correspondence that gives details of the
crime, in order to convince the governor to issue a reward. The correspondence
came from sheriffs, judges, district attorneys, juries, relatives of the
victim, and members of the community. An application might also contain a copy
of an indictment by a jury or other legal documents. For each application, a
form was filled out by the Secretary of State and the accompanying
correspondence placed inside. This form included such vital information as name
of the applicant, date of the request, name of the fugitive, the criminal
offense, where and when the alleged crime occurred, the amount of reward, and
the date of the reward offer. Reward proclamations are occasionally found in
these files. |

Rewards are offered by the governor of
Texas to aid in the apprehension of accused criminals who are evading arrest.
Each constitution of the State of Texas has required the Texas Secretary of
State to keep a fair register of all official acts and proceedings of the Texas
Governor and to provide these to the legislature when required. These records
were created to document the actual proclamations of rewards by the governor.

These reward proclamations issued by the governor date 1883-1942. The
original proclamations were issued on printed forms with the following
information: amount of reward, name of fugitive, criminal charge, county, date,
and signature of governor. Copies of most of these proclamations are in four
volumes of Executive Record Books kept by the Secretary of State, 1883-1938.
The volumes have alphabetical indexes in the front. In addition, there are
unbound proclamations dating 1937-1942 (#950-985). |

These volumes are
composed entirely of reward proclamations. For earlier reward proclamations,
see the series described in this finding aid as Executive
record books containing records about fugitives from justice, where
reward proclamations are mixed in with other kinds of records. |

Note:
Some of the microfilm boxes are misleadingly labeled "Reward register," but the volumes microfilmed are
not registers in the generally accepted sense (i.e., they are not lists, but
are copies of the actual documents). |

Texas law authorizes the Governor of Texas to requisition the return of
fugitives from Texas justice who have fled to other states and territories, and
also requires that the Governor of Texas cooperate in the apprehension of
fugitives of justice from other states who have fled to Texas. Rewards are
offered by the governor of Texas to aid in the apprehension of accused
criminals who are evading arrest. Each constitution of the State of Texas has
required the Texas Secretary of State to keep a fair register of all official
acts and proceedings of the Texas Governor and to provide these to the
legislature when required. Executive record books were created to preserve a
permanent record of the official acts and proceedings of the governors of the
state of Texas, whether through correspondence, addresses and messages,
proclamations, etc. |

Types of records contained in executive record
books include correspondence (mostly outgoing) of the Governors of the State of
Texas, primarily with other Texas and U.S. officials; inaugural and valedictory
addresses; executive messages; proclamations; appointments; passports; pardons
and remissions; extraditions; rewards; reports of
state agencies; etc. Some Secretary of State records are also present,
consisting primarily of election returns, plus a couple of annual reports.
These records comprise those executive record books maintained by the Texas
Secretary of State dating 1849-1887. |

The entire series of Executive
record books has been described in another finding aid, with records of
presidents' and governors' actions present from each administration covering
the years 1835-1917. (

another binder.) Since the executive record books of the Provisional Government
(1835-1836) and of the Presidents of the Republic of Texas (1836-1845) contain
no reward documents, those are not described here. Nor (for the same reason)

record books dating 1887-1917. |
