The Texas Ethics Commission was created by a constitutional amendment
which the voters approved in November 1991 (Article III, Section 24a); it was
established by Senate Bill 1, 72nd Legislature, Regular Session, 1991, and
began operations in January 1992. It has the following powers: to pursue sworn
complaints alleging violations of state ethics laws (investigations into sworn
complaints are confidential, but formal hearings on allegations are public); to
penalize violators of state ethics laws; to sponsor ethics training and
informational programs, and to explain compliance guidelines; to issue advisory
opinions, which apply ethics laws to specific situations of fact; to require
regulatory agencies of the executive branch to develop rules for the
commission's approval that limit the acceptance of benefits from regulated
entities; to recommend salary levels for members of the legislature and the
lieutenant governor, which are submitted to the voters at the next general
election; to set the per diem paid to legislators and to the lieutenant
governor.
The laws and regulations that the commission enforces include those
concerning the following: political contributions and expenditures and
political advertising; lobbyist activities; financial disclosure and conduct of
state officers and employees; and the contributions and expenditures for the
race for speaker of the house. Prior to the creation of the Ethics Commission,
the Secretary of State's office administered the filings required by these
ethics laws. The advisory opinions which the commission issues concern these
laws as well as laws governing bribery, corrupt influence, and abuse of office.
These advisory opinions can be used as a defense in a criminal prosecution or
in a matter involving civil penalties if the defendant relied on an opinion of
the commission in making decisions regarding his or her behavior, or if the
defendant's situation is substantially similar to that outlined in the opinion
(the identity of a person requesting an advisory opinion is confidential).
The Ethics Commission consists of eight members representing the
general public, serving overlapping four-year terms. Four are appointed by the
governor, two by the lieutenant governor, and two by the speaker of the house,
all of them chosen from lists provided by senate and house caucuses
representing political parties required by law to hold primary elections
(currently the Democratic and Republican parties). They are non-salaried
positions, and the members annually elect a chair.
The Ethics Commission was preceded by a Public Servant Standards of
Conduct Advisory Committee, created in 1981 to expire in 1983 (House Bill 3,
67th Legislature, Regular Session); and a State Ethics Advisory Commission
(appropriation: Senate Bill 22, 68th Legislature, 1st Called Session,
1983).

Copies of minutes and agenda of meetings of the Texas Ethics
Commission Transition Task Force, dating October-December 1991, are following
by minutes and agenda for the Texas Ethics Commission dating 1992-2008. The
summary minutes include the following: advisory opinion requests (AORs),
usually with the question and a summary answer (these form the most voluminous
part of the minutes); commission comments, executive director comments, and
comments from the public; discussion and action on proposed rules; briefings,
discussion, and possible action on a variety of other items, including the
budget, the strategic plan, the electronic database, interagency contracts,
training programs for state employees and members of the legislature, an
imaging system to replace the microfilming of archived records, requests to
waive certain fines assessed for late filings of reports, etc. No minutes have
been located by the Ethics Commission or by the State Archives for either the
Public Servant Standards of Conduct Advisory Committee, or the State Ethics
Advisory Commission, predecessors of the Ethics Commission created in 1981 and
1983.
There are five organizational charts of the Texas Ethics Commission,
dating July 2001-February 2003. Names of all 35 to 36 employees are included in
these one-page charts, along with their job titles.
Advisory opinions consist of copies of 29 ethics advisory opinions
issued by the Texas State Ethics Advisory Commission in 1984 and 1986, the bulk
of them from 1984. Each opinion contains a brief statement of the request for
opinion, the opinion itself, and a summary of the opinion, and is signed by the
chairman of the State Ethics Advisory Commission. The opinions concern such
issues as lobbying activities and expenses, campaign contributions, travel,
personal use of state equipment, amendments to financial statements made after
filing, loans by candidates to political action committees, use of political
contributions to purchase a residence, compensation for services rendered by
the executive director of a state regulatory agency to an out-of-state industry
in the regulated field, etc.
The largest groups of records are the ethics filings, including
contribution and expenditure reports of candidates and officeholders, and state
officers personal financial statements. Contribution and expenditure reports of
candidates and officeholders, and of specific-purpose political committees,
with associated correspondence, date 1979-1996, bulk 1992-1994. Included are
accounts from primary, general, and special elections. The following
officeholders (and candidates for those positions) are required to file these
reports with the Texas Ethics Commission: statewide elective offices (governor,
lieutenant governor, attorney general, state comptroller, land commissioner,
agriculture commissioner, railroad commissioners, supreme court justices, and
court of criminal appeals judges); state senators and state representatives;
courts of appeals justices; members of the State Board of Education; district
judges; district attorneys from multi-county districts; and certain county
chairs of political parties. Each candidate, campaign manager, or assistant
campaign manager was required to keep a record of all funds received and
disbursed. The reports include the following: names and addresses of all
contributors of more than $50 aggregate, plus the amounts; names and addresses
of all persons and entitites receiving expenditures of more than $50 aggregate,
plus the amounts and the purposes; and a summary.
State officers personal financial statements date 1992-1996. They
consist of financial disclosure statements of the following: state officers
(i.e., elected officers at the state or district level, appointed officers,
salaried appointed officers, appointed officers of major state agencies, and
executive heads of state agencies), candidates for elective office, and party
chairmen. Files report the financial activities of the individual, and of his
spouse and dependent children (if the individual had actual control over that
financial activity during the preceding calendar year).
Administrative correspondence dates 1997-2000 and undated, with the
bulk of it from 1999. It includes correspondence, memoranda, a request for
offer (RFO), vendor's responses to the RFO, reports and studies, surveys, bill
analyses, notes, spreadsheets, and audiocassettes of Texas Senate hearings. All
of this material relates to the development of an electronic filing system.

Restrictions on Access
Because of the possibility that portions of these records fall under
Public Information Act exceptions including, but not limited to, bank account
numbers (V.T.C.A., Government Code, Section 552.136); driver's license numbers
(V.T.C.A., Government Code, Section 552.130); and home addresses and phone
numbers of government employees or officials (V.T.C.A., Government Code,
Section 552.117), an archivist must review Candidate-officeholder and specific-purpose political committee
contribution and expenditure reports and State
officers personal financial statements before they can be accessed for
research. The records may be requested for research under the provisions of the
Public Information Act (V.T.C.A., Government Code, Chapter 552). The researcher
may request an interview with an archivist or submit a request by mail (Texas
State Library and Archives Commission, P. O. Box 12927, Austin, TX 78711), fax
(512-463-5436), email (Dir_Lib@tsl.state.tx.us), or see our web page

Include enough description and detail about the information requested to enable
the archivist to accurately identify and locate the information. If our review
reveals information that may be excepted by the Public Information Act, we are
obligated to seek an open records decision from the Attorney General on whether
the records can be released. The Public Information Act allows the Archives ten
working days after receiving a request to make this determination. The Attorney
General has 45 working days to render a decision. Alternately, the Archives can
inform you of the nature of the potentially excepted information and if you
agree, that information can be redacted or removed and you can access the
remainder of the records.
Materials do not circulate, but may be used in the State Archives
search room. Materials will be retrieved from and returned to storage areas by
staff members.
Restrictions on Use
Most records created by Texas state agencies are not copyrighted and
may be freely used in any way. State records also include materials received
by, not created by, state agencies. Copyright remains with the creator. The
researcher is responsible for complying with U.S. Copyright Law (Title 17
U.S.C.).

Texas State Archives staff completed an appraisal of the Texas Ethics
Commission records in May 2000, revised June 2006. (This appraisal report is

and also in the search room of the Texas State Archives.) Thirteen series on
the agency’s retention schedule were determined to be archival: Legislative
appropriation requests, Strategic Plans, Organization charts, Meeting agenda
and minutes, General-purpose political committee contribution and expenditure
reports, Candidate-officeholder and specific-purpose political committee
contribution and expenditure reports, State officers personal financial
statements, Speaker of the House reports, Correspondence - administrative,
Filer notebook lists, Sworn complaint orders - non-confidential, Training
materials, and Published ethics opinions.
The archival requirement for the legislative appropriation requests,
strategic plans, and organization charts is fulfilled by sending copies of the
legislative appropriation requests and strategic plans (which contain
organization charts) to the State Publications Depository Program of the Texas
State Library and Archives Commission. The Texas Documents Collection holds
legislative appropriations requests dated 1992-2005 (for FY 1994-FY 2007), and
strategic plans for the years 1992-1998 (published in 1992), 1995-1999
(published in 1994), 1998-2003 (published in 1998), and 2001-2005 (published in
2000), received via the State Publications Depository Program.
Filer notebook lists, Sworn complaint orders - non-confidential, and
Training materials have so far not been transferred by the Ethics Commission to
the Texas State Archives. Speaker of the House reports have been transferred to
the Texas State Archives by the Secretary of State, but not by the Ethics
Commission.
The Ethics Commission transfers copies of minutes and agenda to the
Texas State Archives regularly, usually on an annual basis.
The Texas Ethics Commission periodically mounts its recent minutes and
agenda on the agency web site
(http://www.ethics.state.tx.us/tec/meetings.htm),
earlier ones as HTM files, later ones as PDF files. As of February 2009, this
includes minutes and agenda from Commission meetings dating from January 2005
to the present.
The record copies of minutes and agenda are maintained by the Texas
Ethics Commission.

The Texas Ethics Commission (as of 2000) was organized into five
divisions: Enforcement, Disclosure Filings, Advisory Opinions and Education,
Administration, and Computer Services. There were at that time 33 full-time
equivalent employees. These records document that structural organization,
consisting of five organizational charts of the Texas Ethics Commission, dating
July 2001-February 2003. Names of all 35 to 36 employees are included in these
one-page charts, along with their job titles. |

Among the duties of the Texas Ethics Commission are to issue
advisory opinions, which apply ethics laws to specific situations of fact. The
commission was preceded by a Public Servant Standards of Conduct Advisory
Committee, created in 1981 to expire in 1983; and a State Ethics Advisory
Commission in 1983. These records consist of copies of 29 ethics advisory
opinions issued by the Texas State Ethics Advisory Commission in 1984 and 1986,
the bulk of them (1984-1 thru 27) from 1984. Each opinion contains a brief
statement of the request for opinion, the opinion itself, and a summary of the
opinion, and is signed by the chairman of the State Ethics Advisory Commission.
The opinions concern such issues as lobbying activities and expenses, campaign
contributions, travel, personal use of state equipment, amendments to financial
statements made after filing, loans by candidates to political action
committees, use of political contributions to purchase a residence,
compensation for services rendered by the executive director of a state
regulatory agency to an out-of-state industry in the regulated field, etc. |

These opinions were transferred because of gaps in the holdings of
the Texas Documents Collection of the Texas State Library and Archives
Commission, which has some, but not all of these opinions. The Texas Documents
Collection also has Ethics Advisory Opinions,
Number 1 thru 426, issued by the Texas Ethics Commission, 1992-2000. |

Historical Notes |
|
From the beginning of its existence, one of the fundamental duties
of the Texas Ethics Commission has been to issue ethics advisory opinions. If a
person subject to one of the ethics laws requests (in writing) an opinion on
any of those laws "in regard to a specified existing
or hypothetical factual situation," the Ethics Commission is required to
issue such a written opinion. The name of the person requesting the opinion is
confidential. The Ethics Commission may also issue a written advisory opinion
on its own initiative. Furthermore, "the commission
shall number and categorize each advisory opinion issued and annually shall
compile a summary of its opinions in a single reference document." (Texas
Government Code, Sections 571.091 and 571.095) |

The laws and regulations that the commission enforces include
those concerning the following: political contributions and expenditures and
political advertising; lobbyist activities; financial disclosure and conduct of
state officers and employees; the contributions and expenditures for the race
for speaker of the house; the contributions to Governor-for-a-Day and Speaker's
Reunion Day ceremonies; representation before state agencies by legislators or
former agency board members; and financial statements of judges of statutory
county courts or statutory probate courts who elect to file with the Ethics
Commission in lieu of the county clerk. The advisory opinions which the
commission issues concern these laws as well as laws governing bribery, corrupt
influence, and abuse of office. |

The Ethics Commission was preceded by a Public Servant Standards
of Conduct Advisory Committee, created in 1981 to expire in 1983 (House Bill 3,
67th Legislature, Regular Session); and an 11-member State Ethics Advisory
Commission (House Bill 2154, 68th Legislature, Regular Session, 1983), which
issued ethics advisory opinions. In addition, the House Ethics Committee (of
the Texas Legislature) was authorized to issue ethics advisory opinions, some
of which were summarized in the Texas Register in 1983 and 1984. |

One of the primary functions of the Texas Ethics Commission is to
receive and make available to the public the various ethics filings required by
Texas law, including the contribution and expenditure reports of candidates for
public office, and the specific-purpose committees created to support (or
oppose) the election of those candidates. These records are those contribution
and expenditure reports of candidates and officeholders, and of
specific-purpose political committees, with associated correspondence, dating
1979-1996, bulk 1992-1994. Included are accounts from primary, general, and
special elections. The following officeholders (and candidates for those
positions) are required to file these reports with the Texas Ethics Commission:
statewide elective offices (governor, lieutenant governor, attorney general,
state comptroller, land commissioner, agriculture commissioner, railroad
commissioners, supreme court justices, and court of criminal appeals judges);
state senators and state representatives; courts of appeals justices; members
of the State Board of Education; district judges; district attorneys from
multi-county districts; and certain county chairs of political parties. Each
candidate, campaign manager, or assistant campaign manager was required to keep
a record of all funds received and disbursed. The types of reports include the
following: 30th day before an election, 8th day before an election or runoff,
July 15, January 15, final report, 48 hour report required by modified
reporting procedure, 15th day after appointment of campaign treasurer by an
officeholder, and annual report of unexpended contributions. |
|
The first page of each report gives the following information: the
first full name and address of the candidate or officeholder; office held or
office sought; name, address, and telephone number of campaign treasurer; date
and type of election if applicable; date span and type of report; full name and
address of political committee accepting political contributions or making
political expenditures for the filer, and full name and address of the
committee's campaign treasurer. The contributions portion of each report
includes the following information: full name and complete address of each
person from whom contributions in an aggregate amount of more than $50 were
received, the dates, and the amounts (divided among money, loans of money, or
in-kind contributions); full name of financial institutions and guarantors of
loans, date of loan, amount, and interest rate if below prime. The expenditures
portion of each report includes the following information: full name and
complete address of each person or entity to whom any expenditure in an
aggregate amount of more than $50 were made, the date, the amount, and the
purpose. Finally is a summary, including the following: the total of all
contributions received aggregating $50 or less; the total of all expenditures
made aggregating $50 or less; and the grand totals of all contributions and
expenditures for the reporting period. |
|
Correspondence is between the candidate/officeholder or his/her
campaign treasurer and the staff of the Ethics Commission, and (in addition to
simple cover letters) concerns late filings, failure to file, the consequences
of those actions, and other issues. Also included are occasional statements of
organization from political action committees (PACs), usually accompanied by a
cover letter from the PAC to the candidate; these account for most of the
earliest documentation prior to 1992. Documents prior to the creation of the
Texas Ethics Commission in 1992 were maintained by the Disclosure Filings
Section of the Office of the Texas Secretary of State. |

State officers personal financial statements,

One of the primary functions of the Texas Ethics Commission is to
receive and make available to the public the various ethics filings required by
Texas law, including State officers personal financial statements. Personal
financial statements were created to comply with state ethics legislation
providing for the disclosure of financial assets and possible conflicts of
interest of elected, salaried, or appointed officers and executive heads of
state agencies, and candidates for elected office. These filings help to ensure
public accountability from state officers, encouraging high ethical standards
by means of public scrutiny of the appropriate records. |
|
These records consist of financial disclosure statements of the
following: state officers (i.e., elected officers at the state or district
level, appointed officers, salaried appointed officers, appointed officers of
major state agencies, and executive heads of state agencies), candidates for
elective office, and party chairmen. The records date 1992-1996. Files report
the financial activities of the individual, and of his spouse and dependent
children (if the individual had actual control over that financial activity
during the preceding calendar year). Financial activities include the following
types of assets and liabilities: (1) a list of all sources of occupational
income, identified by employer, or if self-employed, by the nature of the
occupation; (2) identification by name and the category of the number of shares
of stock of any business entity held or acquired, and if sold, the category of
the amount of net gain or loss realized from the sale; (3) a list of all bonds,
notes, and other commercial paper held or acquired, and if sold, the category
of the amount of net gain or loss realized from the sale; (4) identification of
each source and the category of the amount of income in excess of $500 derived
from each source from interest, dividends, royalties, and rents; (5)
identification of each guarantor of a loan and identification of each person or
financial institution to whom a personal note or notes or lease agreement for a
total financial liability in excess of $1,000 existed at any time during the
year, and the category of the amount of the liability; (6) identification by
description of all beneficial interests in real property and business entities
held or acquired, and if sold, the category of the amount of the net gain or
loss realized from the sale; (7) identification of a person or other
organization from which the individual or the individual's spouse or dependent
children received a gift of anything of value in excess of $250 and a
description of each gift, except: a gift received from an individual related to
the individual at any time within the second degree by consanguinity or
affinity, as determined under Subchapter A, Chapter 573 of the Texas Government
Code; a political contribution that was reported as required by law; and an
expenditure required to be reported by a person required to be registered under
Texas Government Code, Chapter 305; (8) identification of the source and the
category of the amount of all income received as beneficiary of a trust and
identification of each asset, if known to the beneficiary, from which income
was received by the beneficiary in excess of $500; (9) identification by
description and the category of the amount of all assets and liabilities of a
corporation or partnership in which 50 percent or more of the outstanding
ownership was held, acquired, or sold; (10) a list of all boards of directors
of which the individual is a member and executive positions that the individual
holds in corporations, firms, partnerships, or proprietorships, stating the
name of each corporation, firm, partnership, or proprietorship and the position
held; (11) identification of any person providing transportation, meals, or
lodging expenses permitted under Texas Penal Code, Section 36.07(b), and the
amount of those expenses, other than expenditures required to be reported under
Texas Government Code, Chapter 305; and (12) any partnership, joint venture, or
other business association, excluding a publicly held corporation, in which
both the state officer and a lobbyist registered under Texas Government Code,
Chapter 305 have an interest. |

One of the primary functions of the Texas Ethics Commission is to
receive and make available to the public the various ethics filings required by
Texas law. The 1991 enabling legislation required that the Texas Ethics
Commission "establish an electronic data base
composed of statements and reports filed with the commission,"
cross-referenced, and subject to online public access. It also allowed the
commission to "develop computer software to
facilitate the discharge of its statutory duties." The commission has
scanned paper copies of the most frequently requested filings onto optical
disks, and accepts electronic filings. Passed 1999, House Bill 2611 (76th Texas
Legislature, Regular Session), requires certain candidates, officeholders, and
political committees to file reports of contributions and expenditures
electronically. This series of administrative correspondence specifically
relates to that function. |

These records include correspondence, memoranda, a request for
offer (RFO), vendor's responses to the RFO, reports and studies, surveys, bill
analyses, notes, spreadsheets, and audiocassettes of Texas Senate hearings. All
of this material relates to the development of an electronic filing system.
Dates covered are 1997-2000 and undated, with the bulk of it from 1999. |
