Agency History

The Texas Secretary of State is a constitutional officer of the executive branch of state government, appointed by the governor and confirmed by the senate for a term concurrent with the governor's (a two-year term at first, a four-year term since 1974). The office was first created by the Constitution of the Republic of Texas in 1836, and has been continued by each succeeding Constitution.

The Secretary of State has an enormous number of duties and responsibilities, including the following: authenticating the publication of all laws passed by the state legislature; approving comptroller's accounts against the state prior to payment; maintaining a register of all official acts and proceedings of the governor, and all appointments to state boards and commissions; interpreting and enforcing the Texas Election Code, as the state's chief election officer; keeping the Seal of the State of Texas; and maintaining many business-related filings, including corporation and Uniform Commercial Code filings.

The office of the Secretary of State is divided into five divisions: Executive, Elections, Business and Public Filings, Administrative Services, and Information Technology Services.

The Business and Public Filings Division (called Statutory Filings Division prior to 2002), composed of four sections (Corporations, Statutory Documents, Texas Register, and Uniform Commercial Code Sections), assists the secretary in most of his/her duties not related to elections.

The Statutory Documents Section records the charters of home rule cities; files amendments of charters of incorporated towns and villages; appoints, reappoints, and commissions all notaries public for the state (since 1940); files bonds or copies of bonds for state officers and state employees, members of governing bodies of certain constitutionally authorized political subdivisions, and general law districts; files the constitutional statement of bribery; issues cards to all labor organizers in the state; files labor union annual reports; registers business opportunity sellers in Texas; registers health spas, athlete agents, and credit service organizations; licenses and regulates automobile clubs; files deeds of cession; etc.

Beginning in 1913 (House Bill 13, 33rd Legislature, Regular Session), the legislature has required each city with a population of more than 5,000 to file certified copies of their city charters and amendments to charters with the Secretary of State. The Secretary of State then issues certifications and files the charters and amendments by date of receipt. Prior to the law of 1913, cities were chartered by the Texas Legislature; therefore earlier charters and amendments were entered into the statutes. City charters serve as the official record of the creation or incorporation of a city, defining its boundaries and its form of government. Amendments to city charters certify changes to the terms of those charters. The Statutory Documents Section records the charters of home rule cities and files amendments of charters of incorporated towns and villages.

Scope and Contents of the Records

Beginning in 1913, the Texas state legislature has required each city with a population of more than 5,000 to file certified copies of their city charters and amendments to charters with the Texas Secretary of State. City charters serve as the official record of the creation or incorporation of a city, defining its boundaries and its form of government. Amendments to city charters certify changes to the terms of those charters. The Statutory Documents Section records the charters of home rule cities and files amendments of charters of incorporated towns and villages.

These records consist of home rule city charters and amendments to city charters filed with the Texas Secretary of State, 1913-2006. A typical city charter is organized into articles, chapters, and/or sections on the following: the city's name, boundaries, and powers; the city council and mayor; administrative organization; municipal court; elections; initiative, referendum, and recall; finance; taxation; franchise and public utility; general provisions; submission of the proposed charter to voters; etc. Some of the documents authorize the consolidation of two or more towns or cities. Correspondence to and from the office of the Secretary of State (including certification) is contained in the files, as well as ordinances, resolutions, proclamations, council minutes, court orders, city election returns, maps, etc.

In addition to the official copies, this inventory also contains a listing of a limited number of unprocessed city charter files, 1941-1954. While these appear mostly to duplicate a portion of the official files contained in Books 10-14, there may possibly be some additional material. Other reasons for keeping these files include the fact that (not being bound) they might be easier to photocopy, and also that they group all charters for each city together for this limited time period, in alphabetical order.

The Secretary of State prepares and continues to update an alphabetical index of cities represented in the records. This index is available in the State Archives Search Room, indicating the following: name of city, county, whether charter, amendment, consolidation, etc., date filed, book and page numbers, and sometimes remarks (e.g. type of government, date adopted). The book and page citations in that index follow one of two formats, depending on where the charter or amendment is found. Prior to 1913, the citations include a Roman numeral followed by an Arabic numeral (e.g., II-450 or IX-6): the Roman numeral indicates the volume, and the Arabic numeral indicates the first page, within H.P.N. Gammel (compiler and arranger), The Laws of Texas. The Archives and Information Services Division of the Texas State Library and Archives Commission holds copies of Gammel's Laws; the researcher may request them, currently by the following call number: 345.1/T3GA (plus the volume number). Volumes 1-20, plus the analytical index, are also now online at http://texinfo.library.unt.edu/lawsoftexas/. Beginning in 1913, two Arabic numerals (e.g. 7-860) indicate the book number and the page numbers that the Secretary of State assigned to the city charters, and which are now in the holdings of the Texas State Archives. The call number guide for these documents follows immediately.

City charters and amendments filed after the last entry in the list below are still retained by the Statutory Documents Section of the Office of the Secretary of State, to which the researcher should inquire.


 

Arrangement of the Records

These records are arranged by the Secretary of State chronologically, in the order that they were filed with the Secretary of State. The unprocessed charter files are listed at the end, in alphabetical order. An alphabetical index of city charters and amendments, prepared by the Secretary of State, is available in the State Archives Search Room. Researchers should note, however, that this index contains numerous omissions; a better search strategy is to do a search of the online folder inventory.

Materials do not circulate, but may be used in the State Archives search room. Materials will be retrieved from and returned to storage areas by staff members.

Restrictions on Use

Most records created by Texas state agencies are not copyrighted and may be freely used in any way. State records also include materials received by, not created by, state agencies. Copyright remains with the creator. The researcher is responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).

Technical Requirements

The early volumes of city charters are in extremely poor physical condition. Permission of the preservation archivist is required before photocopying from these volumes (Books 2-8).

Texas State Archives staff completed an appraisal of the Texas Secretary of State holdings already in the custody of the Texas State Archives in December 1998. Fifty-seven series of these holdings were determined to be archival, including city charters and amendments.
