The Texas Adult Probation Commission was created by the 65th
Legislature in 1977 (Senate Bill 39, Regular Session) to promulgate rules
establishing standards for case loads, programs, facilities, and other aspects
of probation services and establishing a code of ethics for probation officers
and providing for their enforcement. The commission was empowered to require
probation offices to keep and submit financial and statistical records, to
inspect and evaluate probation offices, and to conduct or participate in
studies of corrections methods and systems. The commission also provided state
aid to probation offices that complied with standards. The commission was
composed of three district court judges and two citizens not employed in the
criminal justice system appointed by the Chief Justice of the Texas Supreme
Court; and three district court judges and one citizen not employed in the
criminal justice system appointed by the presiding judge of the Texas Court of
Criminal Appeals. Members served overlapping six-year terms. Chair was elected
by the commission.
In 1989, the Texas Department of Criminal Justice (TDCJ) and the Board
of Criminal Justice were created (House Bill 2335, 71st Legislature, Regular
Session). The Board is composed of nine members appointed by the governor with
the advice and consent of the senate to six year overlapping terms. The
governor may not appoint more than two members who reside in an area
encompassed by the same administrative judicial region. This new agency
absorbed the functions of three agencies: the Department of Corrections, the
Board of Pardons and Paroles, and the Texas Adult Probation Commission. The
Adult Probation Commission became the Community Justice Assistance Division of
TDCJ on January 1, 1990. The Division is managed by a director and advised by a
12-member Judicial Advisory Council, appointed by the chief justice of the
Texas Supreme Court and the presiding judge of the Texas Court of Criminal
Appeals. Duties of the Community Justice Assistance Commission include
establishing minimum standards for programs, facilities, and services
administered by local probation departments, and providing funding for such
programs, facilities and services. It is also responsible for creating an
application process and procedures for funding community corrections facilities
through its grant program. A major task of the division is to aid local
community supervision and corrections departments, counties and municipalities
through the grant program. The Division also provides funding to local entities
for residential services, community corrections, electronic monitoring, and
risk assessment. For a probation department to receive funding from the
Division, the department must submit a local community justice plan and meet
all Division standards. Probation departments must submit periodic financial
audits and statistical reports to the Division.

records present include correspondence, memoranda, newsclippings, minutes and

press releases, oaths of office, and resolutions from the legislature. Records
are from the Texas Adult Probation Commission with a very few files from the
Community Justice Assistance Division (TDCJ) and date from 1971 to 1991, bulk
1977-1990. The meeting files cover the entire existence of the Texas Adult
Probation Commission (TAPC); the audiotapes cover the latter years of the
Commission. The executive correspondence files also cover the entirety of the
TAPC with a few files covering the transition period of the agency during its
absorption by TDCJ. Also present are files of contracts between county
probation departments and various service agencies. Records reflect the work of
the commission in compliance with its legislative mandate.
To prepare this inventory, the described materials were cursorily
reviewed to delineate series, to confirm the accuracy of contents lists, to
provide an estimate of dates covered, and to determine record types.
