Agency History

The Supreme Court was created in 1836 by the Constitution of the Republic of Texas, Article IV, adopted March 17, 1836. Congress established the court by an act approved December 15, 1836. This court consisted of the Chief Justice, elected jointly by both houses of congress; and the elected judges of the district courts. The Supreme Court had jurisdiction over civil and criminal cases to hear and determine all manner of pleas, complaints, motions, causes, and controversies brought before it by any lower courts, but no appeal could be determined until the lower court had made a final judgement or decree except in particular cases as provided by law. A clerk was appointed by the court. He recorded all the actions of the court and was also charged with preserving the records and transcripts of the court. Following the move to statehood, the First Legislature of the State of Texas organized a Supreme Court, Act of May 12, 1846, to consist of a chief justice and two associate justices, appointed by the Governor with the consent of the Senate, to six-year terms.

The terms of the court changed frequently during the 19th century. Initially, the court met annually at the seat of government on the 1st Monday in December. Legislation passed in 1842 established another annual term to be held at Nacogdoches (January 22, 1842), but changed that by an act passed on February 3, 1842 which directed the court to hold its annual term at Washington, commencing on the 2nd Monday in June. Further legislation in 1845 (February 3, 1845) directed the court to hold annual terms wherever Congress convened, commencing on the 3rd Monday in December. The Act of May 12, 1846 directed the court to meet annually in Austin on the 2nd Monday in December. Legislation passed in 1850 (3rd Legislature, Chapter XII, November 30, 1850) amended this act and directed the court to hold three terms a year, in Austin, Tyler, and Galveston, each term lasting about three months. The court continued to meet in this manner until 1892. Following legislation which reorganized the courts system in 1892, the Supreme Court once again met annually in Austin, which it continues to do today.

The Supreme Court initially heard appeals from civil and criminal cases. The Court of Appeals was created by the Texas Constitution of 1876, Article V, Section 4, which removed all criminal jurisdiction from the Supreme Court, and transferred civil jurisdiction to the Court of Appeals in some situations. In 1879, to help relieve the backlog of pending civil cases in both of these courts a commission of arbitration and award, known as the Commission of Appeals, was created by the 16th Legislature (Chapter 34, Special Session). Civil cases were referred to this commission with the written consent of the parties or their attorneys, and the commission's opinions, unless overturned by the superior appellate court, became the opinion of record of that court. The Commission of Appeals was composed of three judges appointed by the Governor with the consent of the Senate. This Commission was discontinued in 1885, but created again in 1887 (Senate Bill 281, 20th Legislature, Regular Session) to hear civil cases pending before the Supreme Court. It was discontinued in 1892 upon the reorganization of the courts system. A large backlog of cases in the Supreme Court led to the creation of another Commission of Appeals in 1918, which continued until 1945. This commission was divided into two sections, each with three judges appointed as previously. It was abolished in 1945 (Senate Joint Resolution 81, 49th Legislature, Regular Session) and its six judges became associate justices on the Supreme Court, increasing the number of justices to nine, its current number.

A major reorganization of the courts system was undertaken in 1891-1892. A constitutional amendment was passed in 1891, followed by legislation approved April 1892 (22nd Legislature, 1st Called Session). This removed all civil jurisdiction from the Court of Appeals, changing that body to the Court of Criminal Appeals and created the Courts of Civil Appeals (initially three, eventually fourteen courts). The justices of all of these courts, following the expiration of their current terms, were now to be elected by the voters. The mandate of the Supreme Court changed, limiting the appeals which could be sent before it. It now had appellate jurisdiction to questions of law arising in all civil cases for which the Courts of Civil Appeals had appellate but not final jurisdiction. A constitutional amendment in 1940 once again authorized direct appeals from trials to the Supreme Court in a limited class of cases.

The Supreme Court today consists of a chief justice and eight associate justices, elected to six-year overlapping terms. As the highest civil court in the state it has final appellate jurisdiction in most civil and juvenile cases. It also has the authority to conduct proceedings for the removal or involuntary retirement of state judges. The court has many administrative duties as well, including the promulgation of several rules, such as the civil and appellate procedures for the Texas judicial system, and the procedural rules for the Commission on Judicial Conduct; equalizing the dockets among the Courts of Civil Appeals; supervising State Bar operations; and promulgating the rules and regulations for the discipline, supervision, and disbarment of lawyers. The court also has supervisory and administrative control over the judicial branch.

Scope and Contents of the Records

The records of the Texas Supreme Court consist of case files, applications, dockets, minutes, opinions, and indexes, covering the period 1840-1980. Also present are the records of the Texas Commission of Appeals, consisting of minutes, dockets, and opinions, dating 1879-1892, 1918-1943. The records in these accessions document the actions of the justices but do not cover the more routine or administrative functions of the clerk or other aspects of the functioning of the judicial system. Later accessions, located in separate finding aids following this guide, reflect more light on administrative functions of the Supreme Court.

The case files are the most voluminous type of record. Several numbering systems for cases were enacted over the years. Case files presently held by the Texas State Archives are the "M" series (1843-1892), no-prefix-number series (1892-1943), "A" series (1944-1966) and "B" series, (1967-1980). The "C" series and later series are still held by the Supreme Court.

Restrictions on Access

The A and B case files are in off-site storage. Records requested before 10:00 a.m. will usually be available for review by an archivist by 4:00 p.m. the same day. Records requested after 10:00 a.m. and before 3:00 p.m will usually be available for review by an archivist by noon the next day.

Case files may possibly contain documents sealed by the court, and therefore excepted from public disclosure by the Texas Public Information Act, Section 552.107(2). When a researcher requests a case, the file will be reviewed by an archivist in order to remove sealed documents. The researcher will be informed that sealed documents have been removed from the file and it will then be up to the researcher to obtain permission from the Supreme Court to access the documents.

Case files may possibly also contain personal information of jurors and prospective jurors. According to the Texas Code of Criminal Procedure, Article 35.29, information collected by the court or by a prosecuting attorney during the jury selection process about a person who serves as a juror, including the juror's home address, home telephone number, social security number, driver's license number, and other personal information, is confidential and may not be disclosed by the court, the prosecuting attorney, the defense counsel, or any court personnel except on application by a party in the trial or on application by a bona fide member of the news media acting in such capacity to the court in which the person is serving or did serve as a juror. On a showing of good cause, the court shall permit disclosure of the information sought. (Acts 1993, 73rd Leg., ch. 371, § 1, eff. Sept. 1, 1993) The Court of Criminal Appeals has verified that juror information is to be withheld from the public according to the statute cited above. Therefore, when a case is requested, an archivist will review the case to ascertain whether or not juror information is present. If such information is found, the researcher will be informed and the documents will be removed from the file. If an individual wishes to access juror information, they will have to obtain permission from the Supreme Court. Because the judiciary is not covered by the Texas Public Information Act, the Archives cannot estimate how long it will take the Court to respond to a request.

Case files may possibly also contain non-court documents. Before a researcher is granted access to a case, an archivist will review the files and remove all such materials. The researcher will be informed if materials are removed. If the researcher wishes to access the documents, the Archives will contact the Supreme Court to determine the appropriate course of action on a case-by-case basis. Because the judiciary is not covered by the Texas Public Information Act, the Archives cannot estimate how long it will take the Court to respond to a request.

Most records created by state agencies are not copyrighted and may be freely used in any way. State records also include materials received by, not created by, state agencies. Copyright remains with the creator. The researcher is responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).

This early period of the Supreme Court covered the years 1840-1892. The court met in Austin through the year 1850. Beginning in 1851, the court held annual three month terms in three different sections of the state. The sites of these terms were Galveston, Austin, and Tyler. Beginning in the 1850s the Galveston term ran January through March; the Tyler term, April through June; and the Austin term October through December. By the mid 1870s, the Austin term was changed to April through June and the Tyler term to October through December. Beginning in 1879 some cases were referred to the Commission of Appeals. Results of these actions can be found in the minutes and opinions of these early Supreme Court records, and in the records of the Commission (Subgroup 3: Commission of Appeals records).
Several numbering systems were enacted during this period. In January 1841, a new numbering system was begun by the court, causing a duplication of numbers with cases filed prior to that date. When the court began to travel (between Austin, Galveston, and Tyler) the clerk at each of the court sites assigned their own case numbers, causing further duplication. In 1944, all cases created during this period (prior to 1893) were re-numbered with an "M" number and a direct and reverse index was compiled on index cards.
Types of records present in this subgroup include indexes to the cases, dockets, minutes of court proceedings, opinions of the court, and the case files. The records cover the period of the court, 1840-1892. The court generally maintained separate records for each geographical term. In some cases, minutes and opinions were recorded for more than one of the terms, often for multiple-year periods, in the same Volume. Dockets, minutes, and opinions are not present for Tyler and Galveston in the early 1870s, just for Austin. It's likely the court met only in Austin those years, c. 1871-1873.

These are various indexes and registers of the early Texas Supreme Court, dating from 1840-1892. The best access to the early case files (through 1892) is through the "M" index. This is a large card file providing direct and reverse access to the cases. The cards list the style of the case, date filed, "M" case number, and the original case number. Also present is a direct index, beginning in 1870, which initially covered cases heard during the Austin term. It later expanded to include other cases. The index begins in 1870 and continues into the multi-number, multi-docket period, through c. 1941. It gives the style of the case and the original case number (no "M" numbers). The last case numbers present are in the "A" number series. The last Volume is a register of lawyers practicing before the Supreme Court, beginning with the term in Galveston, in December 1882 and continuing into the multi-number, multi-docket period, through 1943. The register provides the name of the lawyer, town, county, and date. Occasionally a date of death is provided in the usually blank remarks column.

Dockets of the court, dating 1840-1892. Dates reflect the court terms, not the filing date of a case. The dockets, except for the first few, cover only a particular geographical term of the court (Austin, Galveston, or Tyler), sometimes covering more than one year.
There are several types of dockets present: court dockets, bar dockets, a motion docket, and a docket of criminal cases. The court dockets (referred to as "dockets") are the most numerous and contain the case or application number, attorneys, parties, county, filing dates, and orders, both of the previous term and present term in many cases. In January 1841, a new numbering system was begun by the court. Any cases continued after January 1840 were given a new number--both the old and new numbers can be found in the earliest dockets for some cases. In many of these dockets, especially those created prior to the Civil war, "M" numbers are given as well for some cases.
The bar dockets, numbering less than a dozen, contain the case number, attorneys, parties, county, and filing dates. The only orders present are from those cases begun in a previous term, and such orders are present only in the later years. These dockets do not contain "M" numbers. The motion docket (1891-1892) gives the docket and application numbers, district, county, attorneys, parties, purpose (rehearing, to dismiss, etc.), date filed, and orders. The other docket is a docket of criminal cases from Austin, 1871-1874, containing the case number, parties, county, crime, and orders.
Most of the dockets are not indexed, making it extremely difficult to locate cases since the entries are arranged by district, then numerically within each section. Also, since "M" numbers are not always present, the original case number has little value. Patrons should consult the direct and reverse "M" number index for locating cases.

These records are the minutes of the early Texas Supreme Court, dating 1841-1892. The early volumes usually cover just one term (Galveston, Tyler, or Austin) for a period of years; in later years, the volumes include two or three of the terms for multi-year periods. Orders and judgements are included with each day's proceedings along with a list of the justices present. Some routine matters appear infrequently in the minutes, such as lists of court costs and the appointment of clerks. Beginning in 1879, referrals to the Commission of Appeals are also noted. Also present, primarily in the 1870s-1890s are copies of selected cases which were referred from one term (i.e., Austin, Galveston, Tyler) to another.
Most of the volumes are not indexed. It is necessary to know the court term and date of the case in order to locate judgements in these records. There is some overlap in dates in these volumes. Minutes in the last ledger extend into the next court period, the multi-number, multi-docket period, through the year 1895. The beginning and ending dates for each volume (and for multiple sessions in the volumes) are given.

The volumes of minutes are arranged roughly in chronological order by the beginning date of each volume.

These records are the opinions of the early Supreme Court, dating 1840-1892. Dates reflect the court terms or the date the opinion was issued. After 1850, most of the volumes cover one geographical term (Galveston, Austin, Tyler) over a period of years. However, a few of the volumes in the 1880s-1890s include two or three geographical terms for single or multi-year periods. The information given includes the style of the case, case number, opinion, and judge delivering the opinion. In most cases the county the case was appealed from is also given. Dissenting opinions, if listed, will follow the opinion of the court. Many of the opinions are not dated; those that are will give the date the opinion was delivered following the opinion. For cases referred to the Commission on Appeals (1880s-1890s), the decision reached by that Commission is given (affirmed, revised, remanded) following the Supreme Court opinion.
Most of the volumes are not indexed. It is necessary to know the court term and style of the case in order to locate the opinions. Most of the Supreme Court opinions have been published.

The opinions are arranged chronologically by the beginning date of the Volume. The beginning and ending dates of each Volume (and for multiple terms in the Volume) are given.

Records are case files, dating c. 1843-1892. Types of materials present in these case files are original petitions (briefs, appeals), original indictments (criminal cases only), transcripts of proceedings from the district court, bills of exception, agreements, demurrer and answer, supplemental answers, statements of facts, testimony, judgements, motions, petitions and/or bonds for writ of error, citations in error, assignments of error, sherift's returns, certifications of costs, and waivers of service. The contents of the files are listed on the jacket of the case file. Access to the files is through the direct and reverse card index file (see Series I).
"M" numbers were assigned in 1944 to case files from this era because there had been several duplicate numbering systems in place. The old numbers can be found on the case files, in the dockets, and on the index cards. A significant number of the case files prior to 1853 were missing when these records were transferred to the State Archives.

Subgroup II - Multi-number, multi-docket period, 1892-1950 (bulk 1893-1943),

The period of the court covered by these records is 1893-1943 (some indexes extend to 1950 and a few docket/opinion entries are present for late 1892 but appear to be part of this period). A new numbering system was begun in late 1892/1893. Applications to the Supreme Court were assigned application numbers. Successful applications became cases and were assigned a new number, called a cause number, while unsuccessful applications simply retained their application number. This created two separate filing systems: case files arranged by cause number and application files filed by application number. Beginning in 1918, many of the cases before the Supreme Court were referred to the Commission of Appeals. Such referrals and results (opinions, etc.) are detailed in the dockets and the minutes of this subgroup, and opinions of the Commission are listed in the opinion books. See Subgroup 3: Commission of Appeals records for the records of this commission.
Types of records present in this subgroup are indexes, dockets (application, court, and motion dockets), minutes to court proceedings, opinions, application files, and case files. The records cover the years 1892-1950. The indexes are not comprehensive and dockets should be used instead for locating the cause or application numbers. Many of the dockets carry both numbers, others just one of the numbers.

These records consist of direct and reverse indexes, 1893-ca. 1941, registers of lawyers practicing before the Supreme Court, 1893-1943 (with entries up to 1950), and an index to expenses and newsclippings, 1940-1941. The first direct index begins in 1870 in the early Supreme Court period and continues through ca. 1941; the next direct and reverse index covers the years 1934-1938. These indexes give the style of the case and cause or application numbers. The registers of lawyers practicing before the Supreme Court begin in 1882 during the early Supreme Court period and continue through 1950. The registers provide the name of the lawyer, town, county, and date. Occasionally a date of death is provided in the usually blank remarks column. Because of the limited time span of these materials, the dockets should be used to access case files from this period.

Three types of dockets are present in this series: application dockets, 1892-1943; court dockets, 1893-1943 (extends to 1944); and motion dockets, 1893-1943 (extends to 1947). The court dockets are the most useful for locating case files.

Information given here is the application number, names of attorneys, parties, county and district the case was from, the filing date, and orders, usually brief--refused, dismissed, granted, etc. In the early years a note giving a date when the costs were paid is present as well. Each Volume has a direct name index.

Beginning with the October term in 1922, these volumes also contain opinions of the Commission of Appeals on certified questions, habeas corpus, and mandamus.
Arrangement
The opinion books, through June 1922, are not indexed and the opinions are filed chronologically. The volumes from October 1922 through June 1928 do contain an alphabetical index to the cases in each Volume. In October 1928, the opinions are filed in the volumes alphabetically, not chronologically any longer. To locate an opinion, you need to know the date it was delivered, especially in the older volumes. From mid-1922 to 1943 the indexes help, but you still need to know the term the opinion was delivered. The Supreme Court opinions have been published in the Texas Reports and Southwestern Reporter.
