Agency History

The Texas House of Representatives is one arm of the Legislature of the State of Texas (the other being the Texas Senate), which the Texas Constitution (Article III, Section 1) vests with all legislative power of the state. The primary legislative power is enacting laws, and the most visible function of the legislature is to make public policy through drafting, considering, and passing bills and resolutions. Biennially, the House of Representatives elects a speaker from its membership to serve as its presiding officer. The House of Representatives consists of 150 representatives elected in even-numbered years for two-year terms. A representative must be at least 21 years old, a qualified voter, and a resident of Texas for at least two years and of the district represented for at least one year immediately preceding election.

In addition to legislative powers, the legislature exercises other types of authority. Constituent powers include the ability to alter the state constitution, and the members' authority to exercise powers of attorney in behalf of their constituents. Directory and supervisory powers allow the legislature to regulate the state's administrative machinery, made up of boards, commissions, and departments that conduct the affairs of state. The legislature establishes and funds these bodies and defines their functions. Executive powers of each house include selection of legislative officers, employees, and chairs and members of committees. Investigative powers are exercised through the formation of standing, special, interim, and joint committees to study an issue. House committees are usually charged with a particular purpose by the speaker, although this may also be accomplished by a resolution adopted by the house. Each legislative house holds judicial powers over its members, including punishing or expelling members for cause.

The legislature meets in regular session on the second Tuesday in January of odd-numbered years and in special sessions when convened by the governor. The length of the regular session is limited to 140 days. Special sessions are limited to 30 days, but the number of special sessions that may be called is not limited. Only legislative matters submitted by the governor may be considered in special session. All legislative sessions, except for the senate's executive session, are open. Neither house may, without the consent of the other, adjourn for more than three days or move to a place other than where the legislature is sitting. Two-thirds of each house constitutes a quorum, the number of members required to conduct business. If a quorum is not present, a smaller number may vote to adjourn and compel absent members to attend. The house is required to keep and publish a journal of its proceedings and to record the vote on any question on which three members who are present demand an actual count of yeas and nays.

The House of Representatives functions through committees set up under its own rules. The house maintains more standing committees than the senate. By custom the speaker appoints standing, special, and conference committees, although the house is free to designate its own method of selection. Under the Legislative Reorganization Act of 1961, the committee system was expanded, and provisions were made whereby standing, special, and general investigating committees created by each body could function whether or not the legislature was in session. As of 2017, the house has 38 standing committees: Agriculture and Livestock; Appropriations; Business and Industry; Calendars; Corrections; County Affairs; Criminal Jurisprudence; Culture, Recreation, and Tourism; Defense and Veterans' Affairs; Economic and Small Business Development; Elections; Energy Resources; Environmental Regulation; General Investigating and Ethics; Government Transparency and Operation; Higher Education; Homeland Security and Public Safety; House Administration; Human Services; Insurance; International Trade and Intergovernmental Affairs; Investments and Financial Services; Judiciary and Civil Jurisprudence; Juvenile Justice and Family Issues; Land and Resource Management; Licensing and Administrative Procedures; Local and Consent Calendars; Natural Resources; Pensions; Public Education; Public Health; Redistricting; Rules and Resolutions; Special Purpose Districts; State Affairs; Transportation; Urban Affairs; and Ways and Means.

Biographical Sketch

Texas Representative Paul Hilbert, a Republican from Houston, served in the Texas House of Representatives for 18 years from the 68th (1983) through the 77th (2001) Texas Legislature, representing House District 150 (encompassing portions of northwest Harris County). Hilbert was born on March 24, 1949, in St. Louis, Missouri. He earned a Bachelor of Arts and Masters in Business Administration from Xavier University, and in 1975 he earned a Juris Doctorate from South Texas College of Law. He began practicing law in Harris County in 1975.

In 1982, Hilbert was elected to the Texas House of Representatives. Important issues for Hilbert included water and energy regulations, property taxes and appraisals, annexation, economic development, law enforcement, and education. He served on as a member on numerous committees during his time in office, such as: Cultural and Historical Resources Committee (1983 and 1991) and its Subcommittee on Budget and Oversight (1983 and 1991, 1991 as chair); Committee on Urban Affairs (1983-1985); Child Abuse and Pornography, Select, Interim Committee (1985); Ways and Means Committee (1987, 1999-2001); Elections Committee (1987 as vice chair,); House Committee on State Affairs (1989, 1995-2001) and its Subcommittee on Privatization Ethics and Accountability (1998 as chair); Business and Commerce Committee (1989); Judicial Selection Committee (1989); Oil Spills and Water Pollution Abatement Committee (1989); Appropriations Committee (1991); Committee on Judicial Affairs (1993); Licensing and Administrative Procedures Committee (1991); Calendars Committee (1995-2001); Civil Practices Committee (1995-1997 as vice chair); State Affairs (1995-2001); and Revenue and Public Education Funding, Select Committee (1997 as vice chair).

Hilbert also held many positions throughout his community. He served on the Boards of the Houston Northwest, Tomball, Cypress-Fairbanks, and Humble Chambers of Commerce. He was involved in economic and business development consulting and served as an instructor and Faculty Advisory Board member at North Harris County College. Hilbert died while in office in October 2001, and is buried in St. Louis, Missouri, with a cenotaph in the Texas State Cemetery in Austin. Debbie Riddle was sworn in on April 10, 2002 to serve the rest of Hilbert's term.

A number of the records did not have folder titles (if foldered at all). These mostly occurred in the Subject files series, and these records were foldered in the order found. Duplicate records may exist.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

Communications between Representative Hilbert and citizens/residents of the state of Texas as well as the Texas Legislative Council are considered confidential under Texas Government Code, Chapter 306 and Chapter 323.

Because of the possibility that portions of these records fall under Public Information Act exceptions including, but not limited to, social security numbers (Texas Government Code, Section 552.147); home addresses, phone numbers, and personal family information of government employees and officials (Texas Government Code, Section 552.117); confidentiality of certain email addresses (Texas Government Code, Section 552.137); names of recipients of social services (Texas Human Resources Code, Section 12.003 and/or Texas Government Code, Section 552.101); medical records ((Texas Occupations Code, Section 159.002)); driver's license numbers and license plate numbers (Texas Government Code, Section 552.130); bank account numbers (Texas Government Code, Section 552.136); Confidential information provided for legislative purposes (Texas Government Code, Section 552.008); and common law privacy (Texas Government Code, Section 552.101), an archivist must review these records before they can be accessed for research.

The records may be requested for research under the provisions of the Public Information Act (Texas Government Code, Chapter 552). The researcher may request an interview with an archivist or submit a request by mail (Texas State Library and Archives Commission, P.O. Include enough description and detail about the information requested to enable the archivist to accurately identify and locate the information. If our review reveals information that may be excepted by the Public Information Act, we are obligated to seek an open records decision from the Attorney General on whether the records can be released. The Public Information Act allows the Archives ten working days after receiving a request to make this determination. The Attorney General has 45 working days to render a decision. Alternately, the Archives can inform you of the nature of the potentially excepted information and if you agree, that information can be redacted or removed and you can access the remainder of the records.

Most records created by Texas state agencies are not copyrighted. State records also include materials received by, not created by, state agencies. Copyright remains with the creator. The researcher is responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).

The use of legislatively produced audio or visual materials in political advertising is prohibited (Texas Government Code, Section 306.005). In addition, commercial use of legislatively produced audio or visual material is limited (Texas Government Code, Section 306.006)

Detailed Description of the Records

Correspondence and constituent casework, 1982-2001,

Texas Representative Paul Hilbert's correspondence contains communications between the legislator and his constituents as well as state agencies and elected officials. Records primarily consist of correspondence but also include attachments containing background materials (such as news clippings and reports), dating 1982-2001. Much of the correspondence from constituents includes letters of support and opposition to various bills under consideration related to subjects such as annexation, right to life issues, taxes, appraisals, gambling, regulatory issues, small businesses, tort reform, and education. Correspondence also includes flag requests, letters of congratulations to Eagle Scout recipients and other honorees, and responses to several surveys sent to constituents by Hilbert.
Constituent casework is also represented by letters and supporting documents received from constituents requesting help from Representative Hilbert regarding specific personal concerns, such as assistance with annexation, utility, and appraisal issues; child support; medical bills; and tax issues. Documentation includes copies of utility and medical bills, medical records, copies of bank statements, court documents, and reports. Constituent casework is listed at the end of the series under the heading Constituent casework. Constiuent names have been omitted for confidentiality.
Correspondence may have resulted in proposed legislation. Researchers should check the Bill files series for additional records. Bill files highlight legislation that Texas Representative Hilbert authored, sponsored, or had an interest in as the representative of District 150 (portions of northwest Harris County) during the 68th (1983) through the 77th (2001) Texas Legislature. Texas Representative Hilbert's subject files document topics of interest to Hilbert or his staff. This background information may have been used for future legislation, as research for work on committees, or for constituent casework. Representative Hilbert received many materials from special interest groups, state agencies, and small businesses regarding specific bills or issues under consideration. Records include correspondence, charts, maps, reports, presentations, plans, photographs, memorandums, fact sheets, presentations, clippings, directories, VHS tapes, and a CD-ROM, dating 1980-2001. Researchers should also note that many of the subjects reflected in this series are also present in the Correspondence and constituent casework series.

Restrictions on Access
Communications between Representative Hilbert and citizens/residents of the state of Texas as well as the Texas Legislative Council are considered confidential under Texas Government Code, Chapter 306 and Chapter 323.
Because of the possibility that portions of these records fall under Public Information Act exceptions including, but not limited to, home addresses, phone numbers, social security numbers, and personal family information of government employees and officials (Texas Government Code, Section 552.117); confidentiality of certain email addresses (Texas Government Code, Section 552.137); and common law privacy (Texas Government Code, Section 552.101), an archivist must review these records before they can be accessed for research. The records may be requested for research under the provisions of the Public Information Act (Texas Government Code, Chapter 552). Refer to the overall restriction statement for instructions on requesting access through the Texas Attorney General.

Researchers are required to wear gloves provided by the State Archives when reviewing photographic materials.
Researchers wishing to access videotapes or the CD-ROM must contact State Archives staff to obtain the necessary equipment.

Records include photographs, visitor registers, office policies and procedures, Capitol information, Hilbert's constituent newsletters, speeches, press releases, position papers, schedules, and biographical files, dating 1977, 1979, 1982-2001, undated, bulk 1983-2001. Many of the photographs were created by House Photography and often include other members of the legislature including Speakers of the House Gib Lewis and Pete Laney, as well as Governor Ann Richards.

Restrictions on Access
Because of the possibility that portions of these records fall under Public Information Act exceptions including, but not limited to, home addresses and home phone numbers of government officials (Texas Government Code, Section 552.117); certain email addresses (Texas Government Code, Section 552.137); common-law privacy (Texas Government Code, Section 552.101); and confidential information provided for legislative purposes (Texas Government Code, Section 552.008), an archivist must review these records before they can be accessed for research.
