Abstract: The Laredo Archives consist of the official documents preserved at Laredo under the rule of Spain, Mexico, the Republic of Texas, and the United States. Edicts from the Spanish king, the viceroy, and the archbishop, together with correspondence of the alcaldes, military and land records, election returns, census records, and other local matters were accumulated at Laredo in the conduct of the government. Materials are transcripts and microfilm copies of the Laredo Archives, dating from 1749 to 1896, with the bulk dating from 1768 to 1834.

Ownership and Custodial History

By an act of the Texas Legislature, on February 1, 1850, the Laredo Archives were ordered removed from the possession of the county clerk of Webb County and delivered to the city council of the City of Laredo (3rd Legislature, Regular Session, Chap. XC). However, for years the whereabouts of these records was unknown.

The collection was stored in the basement of the old Webb County Courthouse, where it was neglected and exposed to fire, flooding, and dampness, resulting in the deterioration of many of the documents. In 1934, after an order was given for the papers to be destroyed, a janitor, Pancho Ramírez, working in conjunction with Webb County court reporter Sebron S. Wilcox, identified the papers and removed them for conservation work. Wilcox then enlisted the help of Florencio Andrés, a priest of the Oblates of Mary Immaculate who was serving at San Agustín Church of Laredo. Working together over many years with no remuneration, Wilcox and Andrés diligently dried, cleaned, sorted, and identified the documents.

In 1936 the Work Projects Administration began a project to transcribe the Spanish documents, and in 1940 this work was placed under the supervision of the Texas Historical Records Survey. The project was continued as the Statewide Records Project until 1942, when work was interrupted by World War II and never resumed. Typed transcripts were completed only for records dating through 1836. In total, four copies of the existing transcripts, totaling 38 volumes of typescript, were completed and filed with the National Archives in Washington, D.C.; the Dolph Briscoe Center for American History, the University of Texas at Austin; the Webb County Courthouse; and the Texas State Library and Archives Commission.

In 1960, following Wilcox's death the preceding year, the original documents comprising the Laredo Archives were donated to St. Mary's University in San Antonio by the Wilcox family. In 1968 the collection was placed in the Special Collections room of the new Academic Library, designed for the preservation of documents and including a large fireproof vault with temperature and humidity controls. St. Mary's University hired a professional archivist, Carmen Perry, and a bilingual assistant, who codified and described the records before undertaking a preservation project in 1973, filming the entire collection of manuscripts on 16 rolls of 35 mm microfilm.

Further work on the collection ceased when Wilcox's heirs sought compensation for the papers from St. Mary's University. The Texas State Library and Archives Commission (until 1979, Texas State Library and Historical Commission) then requested that the state act on the agency's behalf to prevent any such action, concerned about the potential sale or dispersal of public documents. The state petitioned for a temporary restraining order to prohibit either the Wilcox family or St. Mary's University from selling or otherwise disposing of the collection. The order was issued on May 21, 1971; at the same time the assistant attorney general also petitioned the court to place the archives in the custody of the state on the grounds that, as the successor to the Mexican government, the State of Texas had a legal right to all official papers held by the Spanish and Mexican governments of Laredo. On July 18, 1972, the State of Texas, the City of Laredo, and St. Mary's University agreed on a tentative settlement that gave the state title and ownership of the archives but allowed the university to retain possession of the originals. In December 1979, in the final jury trial of the matter, the court upheld a previous decision that St. Mary's had lawfully acquired its title to the Laredo Archives. The court further decreed that the parties involved had agreed to abide by the terms of the 1972 settlement and ruled that the personal papers of Sebron S. Wilcox were to be returned to his family.

Scope and Contents of the Records

The Laredo Archives consist of typescript transcripts and microfilm of the original manuscripts, held at St. Mary's University in San Antonio, Texas. Sometimes called the Spanish Archives of Laredo, the Laredo Archives comprise 3,452 handwritten official documents totaling 13,343 pages dating from between 1749 and 1896. Although the earliest item is dated 1749, the bulk of the archives begins in 1768 with the Spanish crown raising Laredo to the status of villa, a town with its own governing body. The Spanish language portion of the archives continues through the end of Mexico's governance of Laredo in 1846 and contains records of boundary surveys and land allotments; Indian raids; church, school, and social development; royal decrees and edicts; local laws and ordinances; civil and criminal litigation; census, tax, and trade statistics; wills and estate settlements; and a document signed by Mirabeau B. Lamar, who commanded the American forces occupying Laredo during the Mexican War. A few documents, dating from 1846 through 1896 and written mostly in English, relate to the affairs of the City of Laredo and Webb County.

The Laredo Archives are described by Anita Saxine in Texas Libraries, Winter 1980, as containing: "an allotment of lands to settlers; boundary surveys; royal edicts and decrees; ordinances and local laws; census statistics; Indian raids; record of wills; settlement of estates; tax and trade statistics; church, school, and social developments; and civil and criminal litigation." The records do not include marriage, death, nor birth certificates. They do not include the actual land grants.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types. These records have not been processed. This folder inventory is a transcription of the original box and folder titles as they were received. Researchers are advised to review the finding aid for subjects of interest. Inconsistent titles and dates are evident. Misidentifications and misfilings are possible. No more precise method of access to the transcripts is available at this time.

The Laredo Archives consist of the official documents preserved at Laredo under Spanish, Mexican, Republic of Texas, and American rule. These transcripts are the result of work of the Work Projects Administration (and its successors) and remain incomplete. The original Laredo Archives are on permanent deposit at St. Mary's University Library in San Antonio and comprise 3,245 documents of 13,343 pages dating from 1749 to 1846. The transcripts comprise 24 boxes, totaling 11,198 pages and dating from 1749-1834. Almost all of the original documents and all of the transcripts are in Spanish. Wilcox's filing system has been retained. The records are in expanding wallet files. The contents list below reflects the physical box and wallet location, with the subsequent box and folder description representing Wilcox's filing system, as recorded on each wallet. Wilcox's box and folder numbers, also typed on the transcripts, are not valid call numbers, but do serve as a general key to the location of documents. Boxes 1957/028-1 through 1957/028-22 (Wilcox boxes 1-5) date from 1749 through 1834. Wilcox boxes 6-8, dating from 1835 through 1896, were not transcribed and remained with Wilcox in Laredo until their donation to Saint Mary's University upon his death. Their contents were microfilmed by St. Mary's University in 1973 and are included in the Microfilm series, described below. Box 1957/028-23, containing two expanding wallet files labeled "Miscellaneous" and "Trash," and box 1957/028-24, containing two wallets labeled "Waste" and "Trash," comprise draft transcript fragments and errata with no apparent order or further description. The researcher is cautioned that the transcripts have not been checked against the originals by Archives' staff.
Arrangement
The transcript records remain arranged as received. The arrangement is chronological although there are some exceptions. The pages run consecutively, although the folder numbers do not. Each copy separated and in the original order. Pages of the transcripts were numbered sequentially and some appear to be missing.

The Laredo Archives consist of the official documents preserved at Laredo under Spanish, Mexican, Republic of Texas, and American rule. The original Laredo Archives are on permanent deposit at St. Mary's University Library in San Antonio and comprise 3,245 documents of 13,343 pages dating from 1749 to 1846. Almost all of the original documents and all of the transcripts are in Spanish. The microfilm records contain the entirety of the Laredo Archives, dating 1749 to 1896.
Arrangement
The microfilm records are arranged in chronological order with documents divided into sections. Preceding each section is a cover page listing the dates, and occasionally a description, of the documents in that section. This inventory is a synopsis of the archives as reflected in the cover pages, where each title is a summary of the items within a specific date range as outlined on the cover page for that section.
