The 65th Legislature created the Texas Prosecutors Coordinating
Council in 1977 (Senate Bill 113) to provide a centralized agency of the
judiciary capable of delivering technical assistance, educational services, and
professional development training to prosecutors throughout the state. The
Council was composed of nine members which included four citizens and five
prosecutors. The four citizen members could not be licensed to practice law and
were appointed by the governor and approved by the Senate. The five prosecutor
members had to be incumbent, elected prosecuting attorneys and were chosen by
other prosecutors in an election and had to include at least one county
attorney, one district attorney, and one criminal district attorney. The
Council appointed an Executive Director to manage the everyday operations and
represent the Council in any court case in which the Council was a party. The
name of the Council was changed in 1981 by the 67th Legislature to the Texas
Prosecutor Council, but its structure remained unchanged.
The Council was responsible for operations related to prosecuting
attorneys' offices throughout the state. The council had authority to: accept
and investigate complaints of prosecuting attorney incompetency and misconduct;
develop and adopt minimum standards for the operation of prosecuting attorneys'
offices; approve courses for in-service training and professional development
of prosecuting attorneys, their assistants, and staff, and provide travel
expenses for professional development counsel; respond to requests for
technical assistance from prosecuting attorneys; receive and consider
suggestions to improve the administration of criminal justice, and investigate
such matters as may be referred to the Council by the governor or the
legislature; cooperate and coordinate with the Texas Judicial Council to
improve the maintenance and reporting of criminal justice statistics;
coordinate with the Texas District and County Attorneys Association (TDCAA) to
carry out these provisions; respond to the request of a judge for
recommendations regarding the appointment of a special prosecutor in case of a
disqualification of the prosecuting attorney; and take such action as may be
appropriate for the improvement and more efficient administration of criminal
justice.
The Prosecutor Council came up for sunset review in 1984 and the
staff of the Sunset Advisory Commission determined that cost savings and better
coordination could result from the transfer of the Council's functions to other
state agencies. The Sunset Advisory Commission adopted this recommendation and
the Texas Prosecutor Council was abolished as of September 1, 1985. Agencies
that are responsible for the same functions as the Prosecutor Council include
the State Bar of Texas, Office of the Attorney General, and Texas Judicial
Council.

Restrictions on Access
Materials do not circulate, but may be used in the State Archives
search room. Materials will be retrieved from and returned to storage areas by
staff members.

privacy (V.T.C.A., Government Code, §552.101), home address of prosecutor's
office employee (V.T.C.A., Government Code, §552.1175), and access device
information (V.T.C.A., Government Code, §552.136), an archivist must review
these records before they can be accessed for research. The records may be
requested for research under the provisions of the Public Information Act
(V.T.C.A., Government Code, Chapter 552). The researcher may request an
interview with an archivist or submit a request by mail (Texas State Library

description and detail about the information requested to enable the archivist
to accurately identify and locate the information. If our review reveals
information that may be excepted by the Public Information Act, we are
obligated to seek an open records decision from the Attorney General on whether
the records can be released. The Public Information Act allows the Archives ten
working days after receiving a request to make this determination. The Attorney
General has 45 working days to render a decision. Alternately, the Archives can
inform you of the nature of the potentially excepted information and if you
agree, that information can be redacted or removed and you can access the
remainder of the records.

The Texas Prosecutor Council reported to the governor and the
legislature on or before December 1 of each year regarding all of its
proceedings, recommended changes in jurisdictions, needed funding for local
offices, and other matters to improve local prosecution within the state. This
series consists of printed annual reports issued by the Council, as required by
statute, dated 1981-1984. The reports include a general narrative discussion, a
financial statement, summaries of major requests for assistance by prosecutors,
and disciplinary proceedings against prosecutors. |

One of the major legislative mandates of the Texas Prosecutor
Council was to provide technical assistance for prosecutors. Records consist of
technical assistance requests, other correspondence, committee meeting notes,
copies of legal briefs and court opinions, newsletters, and reference materials
used by the Council, dating 1980-1985. Technical assistance involved
interpretation of laws, resolving conflicts of interest, hiring experts, or
possibly providing a special prosecutor. The assistance could be simply over
the telephone or it could be major assistance involving in-house research or
on-site visits with the use of outside experts or special prosecutors. Funding
for such major assistance was originally provided through a grant from the
Criminal Justice Division of the Governor's Office but later the local
prosecutors had to bear as much of this cost as possible. The Council also
provided technical assistance in the development of reference manuals for
prosecutors on specific issues, such as properly drafting indictments or trying
hot check cases. The technical assistance requests are filed by name of the
requesting prosecutor. Usually the only items in these request files are cover
correspondence from prosecutors asking for assistance and a certified mail
receipt because the Prosecutor Council returned all other records from each
case file to the initiating prosecuting office via certified mail.
Documentation of assistance efforts of the Council can be found, however, among
the records in this series. For example, some of the request files contain
copies of legal documents including amicus curiae briefs filed by the Council.
The reference materials concentrate on the development of the indictment, hot
check, and civil law manuals for prosecutors by the Council. |

development courses, and funds to attend training courses. Records in this
series focus on professional development courses. These include the
investigators' school, a basic prosecution course for new prosecutors, and law
enforcement workshops. |

The Texas Crime Biters Program was designed by the Prosecutor
Council to acquaint citizens with ways to prevent crime and protect themselves
from criminals. Records include correspondence, reports, and packets of
handouts and kits from several crime prevention programs presented in 1983. The
Crime Biters Program included public meetings and handouts. Two versions of the
program were developed: one for children and one for senior citizens. Funding
for the programs was provided by a grant from the Criminal Justice Division of
the Governor's Office. The programs were presented by investigators and
sponsoring prosecutors, with the Council providing materials, travel expenses
and other supportive services. Packets of handouts included tips on crime
prevention, safe driving, safety in the home, or similar topics. |

The Status of Prosecution Study done by the Texas Prosecutor
Council in 1980 revealed that law enforcement personnel often fail to provide
prosecutors with the necessary and accurate information to prosecute a case
successfully. Therefore, the Council developed a workshop to improve the skills
in report writing of law enforcement personnel. Records include correspondence,
forms, worksheets, and handouts from law enforcement workshops, 1980-1982. The
Council proposed to train and use investigators from prosecutors' offices as
the instructors for the law enforcement workshops. These records document the
training of the investigators. |

These records are from a series of workshops sponsored by the
Texas Prosecutor Council to improve the report writing of law enforcement
personnel. Records include correspondence, workshop agenda, critiques, and
workshop handouts, dating 1980-1985. The Council wanted to improve the accuracy
of the reports, from the viewpoint of the prosecutor. The workshops used
prosecutors' investigators as instructors and utilized visiting prosecutors to
explain the use of the police officer's report in the prosecutor's office. The
workshops began in December 1980 and over 4,000 persons had taken part by
1985. |

The legislature was interested in the improvement of criminal
justice administration in Texas when it created the Prosecutor Council and one
key concern was to improve the maintenance and reporting of criminal justice
statistics. Accordingly, the Prosecutor Council conducted several intensive
studies of prosecution offices and practices in Texas in an effort to fulfill
this legislative mandate. Types of records include correspondence, staff memos,
questionnaires, and statistical summaries, dated 1979-1984. Council collected
data via special questionnaires it had designed, analyzed the information, and
submitted it to the legislature. This provided an alternate source of criminal
justice data for the legislature other than that supplied by the Office of
Court Administration. Records are divided into the three studies, or surveys,
done by the Prosecutor Council: Status of Prosecution Study, Budget Update
Study, and Sentencing Questionnaire. Most of the records concern themselves
with the development and analysis of the surveys and include questionnaire
design, collection of questionnaires, and data analysis. |

The 66th Legislature, via Senate Resolution 605, charged the
Senate Committee on Jurisprudence to study, in cooperation with the Texas
Prosecutors Coordinating Council, the quality and uniformity of criminal
prosecution in Texas. Records of the prosecution study include copies of Senate
Resolution 605, correspondence, Texas Prosecutor Council staff memos and
monthly project report, questionnaires sent to and answered by prosecutors,
meeting notes, questionnaire development, statistics, and a copy of the final
report, entitled The Status of Prosecution in
Texas, 1980. Records date from 1979 to 1981. In accordance with this
resolution the Council received a grant from the Criminal Justice Division of
the Governor's Office to conduct the study. The goals of the study were to
develop minimum standards for staffing, compensation and equipment for
prosecution offices; identify and classify the laws affecting prosecution; and,
identify and evaluate present prosecution districts in Texas. A major component
of the study, and reflected in the records, was a questionnaire sent out to
prosecutors to gather statistical data on the funding and operations of
prosecution offices. The study resulted in a number of recommendations in the
Council's report to the Senate Jurisprudence Committee. |

The Advisory Committee of the Texas Prosecutor Council asked the
Council to update the budget information collected in the 1980 Status of
Prosecution study. Types of records include correspondence, completed
questionnaires, salary affidavits, questionnaire analysis and requests from
prosecutors for data. The records date from 1981 to 1983. The Council
Subcommittee on Services devised questions for a Budget Update Questionnaire
for prosecutor offices. The questionnaire sought salary and budget information
from prosecutors across the state including the amount of state and county
funds available. Other sources of income were questioned including hot check
fees, contracts with the Texas Department of Human Resources, drug and gambling
forfeitures, and Criminal Justice Division grants. The information was used in
planning budgets and to present to the Commissioners Courts and the 1983
legislature. The data gathered by the TPC was the only source available to the
legislature on prosecutors' budgets besides the annual reports of the Office of
Court Administration. |

In 1984, the Texas Prosecutor Council conducted a survey of
sentencing practices among prosecutors. These records consist almost
exclusively of completed questionnaires. A questionnaire was sent out asking
prosecutors how they felt about plea bargaining, sentencing guidelines, parole,
community standards, and what the consequences would be if plea bargaining were
abolished. Questionnaires are divided into returns by county attorneys,
district attorneys, criminal district attorneys, and county attorneys with
felony responsibilities. The responses were compiled into statistical
percentages. |
