         <head>Agency History</head>
         <p>The Texas State Board of Insurance regulated the state's insurance and
		  fire prevention industries primarily under the provisions of the Texas
		  Insurance Code, the basic objectives of which are to ensure the financial
		  soundness of the insurance industry and to protect the insurance consumer. The
		  board appointed, with the consent of the senate, the commissioner of insurance,
		  who acted as the executive and administrative officer of the agency. Associate
		  commissioners, under the direction of the commissioner, oversaw operations of
		  four of the agency's major programs: the Regulated Lines and Licensing Program,
		  the Financial Program, the Compliance Program and the Administrative Services
		  Program. Under the Regulated Lines and Licensing Program was the
		  Insurance-Related Activities Section whose duties included the regulation of
		  health maintenance organizations. All health maintenance organizations (HMOs)
		  must operate in compliance with the Health Maintenance Organization Act (HMO
		  Act), enacted in 1975 in regular session of the 64th Legislature, Senate Bill
		  180.</p>
         <p>In 1991 the legislature changed the agency's name from the Board of
		  Insurance to the Department of Insurance, reserving the name State Board of
		  Insurance for the department's three-member governing board. Sunset legislation
		  in 1993 abolished the board and gave its powers to a single commissioner of
		  insurance appointed by the governor.</p>

         <p>Records present consist of charter files, approval correspondence,

		  records are from the Texas State Board of Insurance. Some records are from its

                  <p>These records consist of correspondence and copies of contracts,
				  agreements and reports dating from 1977 to 1991. Records were generated by
				  compliance on the part of Health Maintenance Organizations (HMOs) with
				  provisions of the Health Maintenance Organization Act. Subsequent to receiving
				  its certificate of authority, an HMO must submit to the commissioner, for
				  approval, disapproval, or for information only, any modifications or amendments
				  to operations or documents submitted to the commissioner during the process of
				  applying for a certificate of authority. Any modification, addition, deletion,
				  revision or amendment for which the commissioner's approval is required will be
				  considered approved unless disapproved within thirty days. Actions requiring
				  approval of the board include service area expansion requests, the acquisition
				  of one HMO by another, applications for Certificate of Need, and amendments of
				  bylaws. The commissioner may postpone any action for an additional thirty days
				  only if more time is needed for proper consideration. </p>
