The Texas State Board of Insurance regulates the state's insurance and
fire prevention industries primarily under the provisions of the Texas
Insurance Code, the basic objectives of which are to ensure the financial
soundness of the insurance industry and to protect the insurance consumer. The
board determines agency policy, sets rules, promulgates and approves rates in
certain property/casualty lines of insurance, hears appeals of administrative
rulings, and enforces statutory mandates. The board appoints, with the consent
of the senate, the commissioner of insurance, who acts as the executive and
administrative officer of the agency. The commissioner of insurance oversees
four specialized units and four broad programs. Three of the specialized units
are (1) Hearings, which conducts formal
administrative hearings; (2) Conservation, which
attempts to rehabilitate and conserve insurance entities with impaired
financial conditions; and (3) Liquidation, which
operates under court order to liquidate insolvent companies. The agency's four
broad programs are the Regulated Lines and Licensing Program, the Financial
Program, the Compliance Program and the Administrative Services Program.
Regulated Lines and Licensing, with its property,
casualty, life, and licensing sections, has jurisdiction for most of the
statutory filings processed by the board. The Financial
Program is responsible for monitoring the solvency and business affairs
of insurance companies licensed in Texas. The Compliance
Program enforces state law regarding unfair trade practices and unfair
competition by an insurer or its representatives. The Administrative Services Program includes all of the
agency's administrative and support activities.

The types of records present include legal documents,
correspondence, memoranda, insurance records, Board Orders, and telegrams of
the Texas State Board of Insurance dating from 1957 to 1968. To preserve
original agency differentiation, files in this series were kept under original
headings of Appeals and Hearings before the Board
and Files for Appeals and Hearings.

Files under Appeals and Hearings before the
Board cover a broad range of subjects including, for example,
applications for approval of rate increases or mergers between insurance
companies or appeals from commissioner's rulings and interpretations. |
|
Files for Appeals and Hearings, for
the years 1965 to 1968, have a narrower scope dealing almost exclusively with
applications to the board by insurance companies for approval of increases in
premium rates and plans for reduction in Permissive Deficiency Reserves (PDR).
In order to be granted a certificate of authority or to continue its
certificate of authority in force, an insurance company must show the board
that it maintains in reserve sufficient funds to meet requirements set forth in
articles of the Texas Insurance Code. If it does not meet these requirements,
it must present the board with an acceptable plan for a reduction in its PDR.

ranging from 1957 to 1963, are arranged in chronological order. Beginning in
1964 however, a change was adopted in the agency's filing method. Files for the
year 1964 are arranged alphabetically by folder title. And for subsequent files
under this heading, for the years 1965 through 1968, arrangement is
alphabetical in one grouping regardless of year. These records are

Records consist of orders, minutes and rulings together with
attendant correspondence and memoranda concerning a wide range of Texas State
Board of Insurance duties and responsibilities. The records date from 1927 to
1960. For example, the board must review and analyze all new and revised policy
forms offered by licensed entities in Texas. It is responsible for issuing and
renewing all licenses and certificates of authority. It must monitor the
solvency and business affairs of all insurance companies licensed in Texas and
perform financial examinations to determine the financial condition of
corporations, firms, and persons writing any kind of insurance in this state,
including their ability to meet all their obligations. Its approval must be
sought, for example, in merger agreements and dissolution proceedings. It
analyzes the annual statements required of all companies licensed to do
business in Texas. It investigates complaints against companies and agents, as
well as entities accused of conducting insurance business without
authorization. It also reviews insurance company advertising to determine
compliance with board rules. After due consideration the board then issues
orders, rulings or minutes of official action stating their decision. |
