Agency History

The office of the Deputy Insurance Commissioner supervised the Financial Monitoring Group of the Texas State Board of Insurance from 1974 to 1979. During this period, the group was responsible for monitoring financial practices of insurance companies and supervised, conserved, liquidated, or acted as receiver for companies with financial problems. This group also issued licenses to allow insurance companies to practice in Texas, maintained charters and records, made regular financial examinations of the companies, and enforced the Insurance Holding Company Act and the Insider Trading Act. The group was composed of four divisions: Liquidation, Examination, Supervision and Rehabilitation, and Holding Company and Acquisition. The Financial Monitoring Group was reorganized in 1981/1982 when both the Conservation and the Liquidation Divisions were placed directly under the supervision of the Commissioner of Insurance. The other functions of the Group were assigned to the new Corporate and Financial Affairs Group.


Scope and Contents of the Records

Types of records include incoming and outgoing correspondence and memos, Texas State Board of Insurance planning reports, copies of court orders and official orders from the Board of Insurance dealing with receiverships and liquidations, minutes of insurance association meetings, clippings, newsletters and the monthly balance sheets for all insurance companies in such financial difficulty that they were under court orders to be liquidated by the State Board of Insurance. The records date from 1974 to 1979.

The files reflect both the internal management of the Financial Monitoring Group and its supervision of insurance companies in financial or legal difficulty. The Liquidation Division of the Financial Monitoring Group administered the liquidation of insurance companies. As part of this process, the Division kept track of the amount and location of assets of the companies with monthly balance sheets.

To prepare this preliminary inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

Types of records include incoming and outgoing correspondence and memos, Board of Insurance planning reports, copies of court orders and official orders from the Board of Insurance dealing with receiverships and liquidations, minutes of insurance association meetings, clippings, and newsletters.
Records consist of subject files from the office of Mr. Tom I. McFarling, the Deputy Insurance Commissioner in charge of the Financial Monitoring Group from 1974-1979.
The files reflect both the internal management of the Financial Monitoring Group and its supervision of insurance companies in financial or legal difficulty. For example, the files marked "Personnel" contain records concerning McFarling's supervision of the staff of the Financial Monitoring Group while folders labeled "Chronological Reading Files" consist of McFarling's outgoing memos and correspondence with insurance companies. Other folders show his involvement with the National Association of Insurance Commissioners (NAIC), the Texas Property and Casualty Insurance Guaranty Association, and with pending federal and state legislation on insurance matters.

Balance sheets for all receiverships, 1976-1978,

Records consist of the monthly balance sheets for all insurance companies in such financial difficulty that they were under court orders to be liquidated by the Texas State Board of Insurance. These balance sheets are the copies sent to the Deputy Commissioner of the Financial Monitoring Group as his record copy and date from 1976 to 1978.
The Liquidation Division of the Financial Monitoring Group administered the liquidation of insurance companies. As part of this process, the Division kept track of the amount and location of assets of the companies with monthly balance sheets. The monthly balance sheets list the total assets and liabilities of each company. The balance sheets are in alphabetical order by company name and list the total assets and liabilities of each company. Another listing shows the bank balance and certificates of deposit of each company and in which banks these funds were being kept.
