Abstract: This collection is primarily composed of abstracts of title pertaining to tracts of land in Chambers, Hardin and Liberty counties. The abstracts contain deeds, affidavits, field notes, powers of attorney, oil leases, plats and certificates. They were primarily compiled by various abstract companies in those counties. The abstracts were created between 1904 and 1972, with the majority created between 1946 and 1966; information within the files dates back to 1830.

Abstracts of Title

An abstract or title company plays an important role in real estate transactions. Real estate buyers need a title company to verify the accuracy of the real estate records for the property regarding ownership, existing liens and other potential claims affecting the property. The title company also facilitates the purchase by making sure that the necessary documents have been prepared and recorded to transfer title to the property as agreed to between the seller and buyer.

Every real estate transaction requires accurate information regarding title to property. A title company specializes in reviewing these documents and preparing a report called an "abstract of title" that identifies the current title to the property and existing liens, as well as a relevant history of the property ownership. An abstract will (1) determine the legal owner of the property; (2) reveal any mortgages, liens, judgments, or unpaid taxes that will have to be satisfied before the property is conveyed; and (3) detail any existing easements, restrictions, or leases that affect the property. After a buyer signs a contract to purchase real estate, a local title company should be hired to conduct a title search and prepare an abstract of title.

Title companies are often the closing agents for real estate transactions. In its role as agent, the title company obtains signatures on all of the closing documents, and the title company also receives and distributes payments related to the conveyance transaction. After the parties have signed all the documents, the title company will record documents that need to be recorded, such as deeds and mortgages, in the local county land records office.

Scope and Contents of the Collection

This collection consists of abstracts of title compiled by various abstract companies, primarily in Chambers, Hardin and Liberty counties, Texas. Files contain deeds, affidavits, field notes, powers of attorney, oil leases, plats and certificates. The abstracts were created between 1904 and 1972, with the majority created between 1946 and 1966; information within the files dates back to 1830.

To prepare this inventory, the described materials were cursorily reviewed to delineate series, to confirm the accuracy of contents lists, to provide an estimate of dates covered, and to determine record types.

Arrangement of the Collection

The majority of the records are arranged alphabetically by county and then by league/survey. All abstracts that concern the same tract of land are grouped together whenever possible. The two most recent additions to the collection are listed at the end and are not alphabetized with the rest of the records.

Restrictions

Restrictions on Access

Materials do not circulate, but may be used in the Sam Houston Regional Library and Research Center search room. Materials will be retrieved from and returned to storage areas by staff members.

Restrictions on Use

Under the Copyright Act of 1976 as amended in 1998, unpublished works are protected for the life of the author plus 70 years. The term of copyright for published material varies. Researchers are responsible for complying with U.S. Copyright Law (Title 17 U.S.C.).
