Born to Champe Carter, Sr., and Mary W. E. Montgomery in Amherst County, Virginia, April 29, 1840, Champe Carter, Jr. moved with his family to Stanford, Kentucky, in October 1847. In 1859, Champe Carter, Sr. followed his son, Edward, to Texas and settled in Milford, Ellis County. Carter remained in Kentucky where he attended Centre College in Danville and graduated in 1861. Immediately after graduation, he ran the Union picket lines on horseback, and joined his family in Texas where along with his brothers Edward Hill, Richard Ellis, Thomas Montgomery, Charles L. and Powhattan enlisted in the 15th Regiment of Texas Volunteer Infantry. Wounded at the Battle of Fordoche Bridge, Louisiana, September 29, 1863, Carter eventually was declared unfit for field duty and assigned to General John B. Magruder's staff for the remainder of the war.
After the Civil War, Carter attempted farming, worked for the Bureau of Freedmen, Refugees and Abandoned Lands, and returned to Kentucky where he received an A. M. degree from Centre College in 1869. Upon returning to Texas, Carter practiced primarily real estate law in Robertson County specializing in locating, buying and selling land, and perfecting titles. In 1872 he started to actively seek veterans of the Republic of Texas and their heirs as clients. Intensely interested in Democratic politics, he was appointed to the Robertson County Board of Examiners in 1880, served as county judge in Robertson County from 1884 to 1885, and was a notary public intermittently between 1881 and 1886.
In 1870 Champe Carter, Jr. married Ruth Victoria Randolph (Vic), daughter of John F. Randolph and Jane E. Calvert, with whom he had five daughters: Randolph, Montgomery, Pattie, Roberta Lee and Jennie, and one son: Champe Carter III (1871-1874). Although residing and working primarily in the towns of Owensville, Calvert, and Franklin in Robertson County, Carter traveled extensively throughout Texas. By 1886 he had acquired a considerable estate of land scattered throughout the state.
Victora Randolph Carter died unexpectedly in January 1885. Soon afterwards, Champe Carter, Jr. planned and began to implement a relocation to Abilene and Anson, Texas. Before the move could be finalized, he died in August of 1886. His brother Charles L. Carter, also an attorney and land dealer, assumed custody of the children and the estate. He attempted for the next 18 years to manage an estate that included substantial debt, five minor children and land located in disparate counties of Texas. Over time, Charles was forced to sell much of the land. Randolph, daughter of Champe Carter, Jr. and wife of George C. Berry, won a lawsuit against her uncle and the much-reduced Champe Carter Estate was transferred to her and her sisters in 1904.

Correspondence, financial records, printed materials, legal documents, memoranda, notes, land surveys, maps and photographs document patterns of land transfer in nineteenth century Texas and specifically the career of Champe Carter, Jr. (1840-1886). The Champe Carter Family Papers are organized into four groups. The largest of the groups, the Champe Carter Papers, comprises 6.2 linear feet of materials the bulk of which are related to his professional work. The second group, the Charles L. Carter Papers, consists of correspondence and financial and legal records documenting C. L. Carter's legal and real estate businesses and his efforts to manage the Champe Carter estate. The third group, the Randolph Carter Berry Papers, contains correspondence concerning her father's estate, printed materials, a brief family history, notes and memoranda, and a map. The fourth group, the Family Papers, documents the business, financial, and personal lives of the Calvert, Carter, Randolph, and Montgomery families through correspondence, legal, and financial documents. Each of the four groups is further divided into series and sub-series.

This series includes sent, received and third party correspondence within which letters, envelopes and postcards are arranged together to unite the communications of each correspondent. In addition to the general correspondence received (.8 linear feet), there are over 200 sub-series of repeating correspondents, usually regarding legal matters or land location. The arrangement is alphabetical and then chronological within each sub-series. A rich source of information concerning early Texas history and genealogy, the correspondence is often with Texas veterans or their families attempting to prove land patents or sell those lands awarded to them by the state of Texas for service to the Republic. Of particular interest is the correspondence both sent and received with the Bureau of Refugees, Freedmen and Abandoned Lands which concerns accusations of misappropriation of funds by Carter in his work with the Bureau. Correspondence from family members is set aside as a separate sub-series under correspondence received. These letters generally concern personal family news from Kentucky and Texas, but the letters from Charles L. Carter relate primarily to business. Some third party correspondence, apparently belonging to Champe Carter, is arranged at the end of the correspondence series. |

The professional sub-series includes tax receipts of Carter's legal clients, bills of cost and other documents generated by or on behalf of his legal clients and legal practice. Financial documents relating to Carter's service on the Robertson County Board of Examiners are included in School District Finances under the professsional sub-series. Organized by subject, the sub-series in legal documents pertain to the Bureau of Freedmen, Refugees, & Abandoned Lands, Champe Carter's military service in the Confederate Army, personal affairs, professional business, and client files. The Bureau of Freedmen, Refugees, & Abandoned Lands sub-series (1866) contains affidavits attesting to the good character of Champe Carter, Jr. by freedmen and various citizens of Robertson County. The military sub-series (1863 - 1865) includes all military papers relating to Carter's service in the Confederate Army. Articles of agreement, contracts, deeds, letters of credential, and general legal documents record Carter's personal legal dealings and interests in the personal legal documents sub-series (1859-1886). Also included are documents retrieved from A. Calvert's safe by Richard Ellis Carter August 26, 1886. Professional documents (1833-1889) record the legal interests of Carter's clients and include two bound Attorney's Docket books, a bound Memorandum of Law Cases, abstracts of title, affidavits, certificates of redemption, contracts, court orders, deeds, interrogations, land grants, petitions, power of attorney, statements of fact and summons. Of particular interest are those documents relating directly to Texas veterans. Client files are arranged alphabetically and unite the documents of various forms under the aegis of particular clients. In addition to legal documents, these records may also contain correspondence, financial documents or memoranda. Of particular interest are the case files of Eli Chandler (1798-ca. 1866), F. A. Thomson, D. U. Barziza (1838-1882) and J. D. Grant and the estates of Memucan Hunt (1807-1856), Louis P. Cooke, James R. Robertson and James Hughes. |

Correspondence, financial documents, legal documents, memoranda and the estate of Champe Carter, Jr. illuminate the business, financial, and personal affairs of Charles L. Carter. Divided by major correspondents and general correspondence, Correspondence (1871-1916) documents primarily Carter's land dealings and his attempt to manage his brother's estate, especially as it relates to the J. R. Robertson Estate. Major correspondents include Champe Carter, Jr., Sterling Robertson, P. H. Carter, and W. E. Howth. The correspondence of L. N. Campbell, Mrs. F. R. Christian, Mrs. F. H. Napier, and Fred L. Napier all regard the Robertson Estate. Promissory notes, tax receipts and tax assessments comprise the financial documents (1892-1896). By this time his land assessments and those of his brother's estate are intermingled. The legal sub-series consists of deeds (1883-1900). |

The Estate of Champe Carter, Jr., a series within the C. L. Carter Papers, documents the taxation and assessment of the estate from the time of Champe Carter's death until it was turned over to his heirs around 1904 as the result of a lawsuit by Randolph Carter Berry. Financial documents consist primarily of tax receipts and assessments paid by Charles L. Carter on behalf of the estate. Legal documents consist of sworn statements and land transfers that concern the administration of the estate. |

The personal correspondence of Randolph Carter Berry (1886-1936) largely concerns the contest with her Uncle Charles for the control of her father's estate. Two letters collected by Berry for their historical importance and written by Anson Jones (1845) and Sam Houston (1848) are arranged as a series of collected papers. Of interest is a broadside advertising town lots in a new community in Hale County, Runningwater, Texas. Newspaper clippings reveal Berry's interest in Texas history. The series Creative Works contains materials concerned with family history including a genealogical chart tracing the Carter family line in Virginia from 'King' Carter. Notes and memoranda written by Berry on scraps of paper and envelopes illuminate her thoughts, feelings, and research concerning her family and her father's papers. Many of her notes were also written directly on documents within the collection. |

The fourth group, Family Papers, includes correspondence, financial and legal documents, printed materials, creative works and memoranda received by or created by family members related to Champe Carter, Jr. or his wife Ruth Victoria Randolph Carter. All correspondence by family sent to Champe Carter, Jr. is in his series of correspondence. All correspondence received by family members from Champe Carter, Jr. is contained in this group. Of particular interest are the letters exchanged between James H. Calvert and his wife Jane Ellen Randolph Calvert (1849-1865) which document their courtship and married life. Correspondence between Carter family members reveal their financial interdependence and their familial bonds. The correspondence from Champe Carter, Sr. to his children expresses concern, advice, and a desire to assist them. Personal memorandum books from Champe Carter, Sr., and Thomas Montgomery Carter display the thoughts, concerns, and daily business transactions of their lives. Documents of George F. Randolph include Confederate-era furlough records, correspondence and a photograph. John F. Randolph's papers include tax receipts, correspondence, and his Arkansas militia commission signed by Governor Thomas S. Drew. Third party correpondence is that deemed to be by a family member but indeterminate by name. |
