Rights of Tenants in Low Income Housing Tax Credit Properties: A Policy and Legal Analysis

This professional report examines the legal rights of tenants in Low Income Housing Tax Credit Properties. The report analyzes the policy underpinnings of the failure of Congress to include protections against arbitrary eviction and denial of applications for housing. Despite the lack of legislatively created protections, the report asserts that Constitutional Due Process requires a Low Income Housing Tax Credit landlord to show "good cause" in order to evict a tenant or deny an otherwise eligible applicant. Finally, the report suggests several strategies that may be pursued to attain the goal of good cause protection.
